Sask Court Finds Breath Testing With No Suspicion Is Constitutional - What That Means For Canadians
A court in Saskatchewan has ruled on the constitutionality of breath testing at the roadside with no suspicion of impairment, or even alcohol consumption. He found that it is a violation of Charter rights against search and seizure, but that this violation was justified under s. 1 of the Charter, which means that the law is constitutional.
