One Mic Season 13 Episode 10

The audacity of modern crime is deeply disturbing, and the case of Marcus Ealy exemplifies this grim reality. Imagine: a gold necklace, a victim with hands raised in surrender, and an execution-style murder caught vividly on surveillance footage. Even more shocking, Ealy took selfies with the stolen jewelry and shared them online, highlighting the depths of depravity some will reach in pursuing their desires.

Speaker 1:

Hey everybody, it's Carl Gerard. Only One Mic Podcast. Now listen, you can probably hear my voice. That, um, the next story I'm about to give you kind of gets under my skin, man, because people cannot be this stupid at all at all. I don't want to believe that they are, but, uh, this is coming out of, uh, nbc six, south Florida.

Speaker 1:

A man was accused of shooting and killing a person in an execution-style murder that was caught on camera, and now this dummy is hoping a judge would grant him some form of release from jail while he's awaiting trial. You big dummy. The big dummy in question is Marcus Ely. He is accused of committing a cold-blooded execution-style killing on camera, and then the dummy took a selfie with the victim's gold medallion that he just snatched off his neck. Now Ely, who is 22, was charged with first-degree murder and armed robbery for the 23 shooting death of 21 year old Malcolm Avery Johnson Jr. Ely's alleged accomplice, mario Fogar, has pleaded guilty to second degree murder and is expected to testify against Ely. Prosecutors have presented evidence, including surveillance footage and statements from Ely's mother and brother, to support the charges against Ealy.

Speaker 1:

Now I'm going to play you the clip from NBC6 South Florida. And again, this is the stupidest thing ever. You guys, you got to help me out on this one. Does it make sense? This guy is trying to get some form of release from jail while he's awaiting trial. So I want you all to listen to this clip and then let me know what you think in the comments 21-year-old man was killed by two men trying to steal his gold necklace.

Speaker 2:

A deadly shooting happened back in May of 2023 in North Miami Beach. Now, two years later, one of the accused killers is hoping for a judge to let him go home and wait for his trial. Nbc6 reporter Christian Colon joins us with what the judge decided.

Speaker 3:

Surveillance video captured when two men with guns pulled up on 21-year-old Malcolm Johnson Jr to steal his gold necklace. As one man fought the victim, the other appeared to pick up the victim's items from the floor. The robbery turned to murder when the thieves started shooting the victim I just wanted to stop right there just to point out something.

Speaker 1:

The person that they shot you know, uh, you know malcolm avery johnson jr. The man had his hands up. He knew he got got pretty much. They got the car. He's away the vehicle put his hands in the air and this guy just pulls out the joint and just starts letting go on him, even though he's not resisting, he's not fighting for the car, he's not fighting for the chain. Folks, let me let y'all continue.

Speaker 3:

Victim collapsed as the killers drove away. Marcus Ely is in jail for allegedly killing over this gold necklace that police say he took home to his girlfriend to snap selfies. Pictures showed the two posing with the piece of jewelry just hours after the real owner's life was cut short you can see it on the thumbnail, guys, the, the girlfriend and him.

Speaker 1:

They're posing with the necklace that he just stole. She's sitting in court with him now and supported his foolishness. Um, I'm gonna let y'all just go ahead and continue. One assumption on top of another assumption on top of another assumption in this case. Uh, you have a flip, is what you have? That's really what this case is about.

Speaker 3:

Today, Ely's attorney slammed the state attorney's case as weak and requested his client get house arrest to wait for trial. But prosecutors were against any form of release out of jail, since they are confident Ely is a killer. Of release out of jail since they are confident Ely is a killer, especially since the second man seen on video took a 20-year prison deal and flipped on his co-defendant.

Speaker 3:

Defendant agrees that he is willing to testify in open court against Marcus Ely required by the court of the state, including testifying that Marcus Ely fired the gun to murder victim Malcolm Avery Johnson Jr. Mario Fogler told police Ealy was the shooter. Additionally, Ealy's brother called police to confess. He recognized the man on the surveillance video as one of his own.

Speaker 1:

This is a lesson to all you kids out there. You know what I mean. Now, everybody that was in that video flipped on him. But he's trying to go home until he can await his trial. Everybody flipped on him. Everybody said he's the one. Clearly, they have all the video evidence that they need right there. This thing is about almost HD. To go home until he can await his trial. Everybody flipped on him. Everybody say he's the one. Clearly, they have all the video evidence that they need right there. This thing is about almost hd quality. Um, and everybody flipped on. This is ridiculous.

Speaker 3:

I'm gonna let y'all go ahead and continue this I can't in any good conscience say that it would be safe for the community to return this defendant to his home, where the law enforcement has gone to the expense of putting a pole cam to observe what's going on, and at the end of today's hearing the judge denied granting him a bond. She felt the community would be a lot safer with him behind bars, especially since police were already surveying his house through a secret camera before this chain murder even happened. Ealy has pleaded not guilty.

Speaker 1:

I don't know what he thought by even asking for this. You know, and we got to be conscious of this. I mean, you can't just let these cats in the street. Man, like, if you see this video, it's disgusting. The man put his hands up, you got the car. I mean he's like away from's. Disgusting. The man put his hands up, you got the car. I mean he's like away from the car. Still got his hands up, you still decide I'm just go ahead and let this thing go.

Speaker 1:

I could even understand if the guy was reaching, if he seemed like he had a gun on him, if he was, you know, doing something kind of to defend himself. You don't even see this in the video at all, but you know, it makes me think a lot of times, like what is going on with our people, like we have these discussions all the time and it seems like we're just like descending into madness. Man, we should know better than this. We should know better than this. Man, we should know better than this. This is. This makes no sense. Not only should we know better than this, we are. This makes no sense. Not only should we know better than this, we are better than this. I want to believe we are, you know. I mean, I want to believe that we are better than this.

Speaker 1:

Let me know what you think in the comments. Should the judge have granted him some form of release until this trial? Do you think it's better that he's not on the streets? I for one think if he murdered this man in cold blood, he he should be sitting right where he at cool your jets. There's nothing back here for you. This is the immediate future. Right now. You go ahead and you sit here and you think about this until we decide what we're gonna do with you. Like the judge said, who in good conscience would give a murder suspect some form of freedom? That's, that's not gonna. That's not gonna fly y'all.

Speaker 2:

I'm just gonna say my people, my people, how long?

Speaker 3:

how long? Why do?
