In this "Brexit Musing" episode, Paul Hughes and Damon Kalt from STEPTOE & JOHNSON discuss the effects of Brexit on UK & EU Competition law. They begin with an overview of the current reach of EU Competition Law. This is then followed by a discussion on how Brexit could cause a potential EU-UK divergence within the Competition Law arena due to changes in: enforcement,  civil suits, merger controls and more, Post-Brexit.

Paul Hughes, Of Counsel, STEPTOE & JOHNSON [Brussels]: His practice focuses on competition law and privacy and data protection, with an emphasis on regulatory compliance and enforcement issues.

Paul has handled all aspects of EU and national merger control, from the initial analysis of a merger's potential antitrust impact through to filing and full regulatory investigation with both the European Commission and national authorities. Paul has also been involved in defending and bringing competition law complaints before the European Commission and national authorities, both for anti-competitive agreements and allegations of abuse of dominance. He frequently advises on the competition law aspects of collaborative and co-operative joint ventures, agency, distribution, franchising and brand licensing. He has worked with specialist strategy consultants on technology licensing and distribution matters and advises on the intersection between competition law and data protection.

As an English solicitor and Avocat at the Brussels Bar, he is ideally placed to advise on the potentially divergent aspects of UK and EU competition and data protection laws in the post-Brexit regulatory environment. Paul has had a longstanding career in the academic community, having lectured and written on competition law, privacy, and data protection issues.

Damon Kalt, Partner, STEPTOE & JOHNSON [Washington]: His practice encompasses all aspects of antitrust law, including private litigation, class action defense, cartel investigations, compliance counseling, mergers and acquisitions, joint ventures, Hart-Scott-Rodino compliance, and representation of clients in connection with civil investigations by the United States Department of Justice (DOJ), the Federal Trade Commission (FTC), and the Federal Communications Commission (FCC), among other regulators. He has extensive experience representing clients across a number of industries, including internet/technology, telecommunications, health care, computer software and hardware, waste services, aerospace, energy, mining, machine tools, financial services, and automotive repair equipment, among others.
