In this article, “Supply chain disruption in the face of the COVID-19 pandemic” we review the impact the pandemic has had on the global supply chain, what risks it has created for businesses, and the due diligence organizations should be conducting to ensure they are mitigating potential risks, including regulatory risks, business continuity and disaster recovery, information security standards, policies and processes, litigation risk and key subcontractor risks. The changing circumstances of the pandemic have also highlighted the value of a flexible contractual framework. We also look at how many traditional supply chain contracts do not include sufficiently robust terms and conditions relating to the use of technology in the supplier relationship.
