In today's show we cover the recent successful appeal of a Washington state woman who had overturned her conviction on a charge of first-degree (reckless, unintentional) manslaughter over the stabbing death of abusive boyfriend.
The reason for the reversal of the conviction? The woman's trial attorney--and, apparently, the trial court itself--MISTAKENLY believed that self-defense was not a legal defense to the crime of reckless manslaughter.
It is true that the legal defense of self-defense operates in a subtly different manner when raised against reckless manslaughter than when raised against an intentional killing, and we'll discuss just how that works.
The real take home message, however, is that it is extremely dangerous to presume that even a well-experienced criminal defense attorney is really comprehensively informed on the actual law of self-defense--and if they get it wrong, it's YOU who goes to prison.
