Claim professionals occasionally clash with policyholders and brokers over selection of defense counsel. Unfortunately, the term "panel counsel" as often become a pejorative term in the eyes of insureds and brokers. In certain cases, policyholders and brokers might make a strong push to install off panel counsel and override and insurers desire to select the defense attorney, even when there is no coverage question or conflict of interest controversy.
