How Long Does High Court Enforcement Take?
Intro
High Court Enforcement is a powerful and effective enforcement tool that allows businesses and individuals to reclaim any debt over £600 owed to them when they have a county court judgment in their favour. But how long does it usually take for a judgment to be fully enforced? In this podcast, we discuss the steps involved in High Court Enforcement (HCE), so that you can understand how long the process may take.
What’s Involved?
The first step of the HCE process is obtaining a County Court Judgment. This is issued by the county court. Often this type of judgment is issued throug the Money Claim Online system but they can also be given out as a result of a hearing, or a claim that is issued in a local county court. Once the judgment has been obtained, it needs to be converted into a High Court Writ of Control to enable a High Court Enforcement Officer to then go ahead and enforce it. This then takes the judgment out of the hands of the county court bailiffs who continue to suffer severe staffing shortages in providing a prompt enforcement service.
The legal framework for this process is codified in Schedule 12 to the Tribunals Courts & Enforcement Act 2007 and the Regulations made under the legislation. These include The Taking Control of Goods Regulation 2013 and the Taking Control of Goods (Fees) Regulation 2014.
After waiting the 7 clear days provided by the Regulations for a Notice of Enforcement to expire, Enforcement Agents will attend your debtor's business or home address. They will look to take legal control of goods to the value of your judgment, our fees, and interest and costs. Often the visit by the enforcement agents is enough to get the debtor engaged in the process of sorting out payment. But if that doesn't happen then the next step will be for goods to be removed and sold at auction. Ultimately the tactic is to compel payment by using the leverage of taking control of goods needed by the debtor.
Even after all the necessary legal steps have been completed, there is still a chance that you may not receive any money back – especially if your debtor has few assets and little disposable income. In such cases, other forms of debt collection may need to be explored in order to achieve payment in full.
