Police Tased Him and His Pet Snake for “Matching the Description” Because He Had Dreads. OVERTURNED

Police tased Robert Holliday after he "matched the description" from a 911 burglary call. He was walking his two pet snakes around his own apartment complex. A Florida appeals court just reversed his resisting arrest convictions and ordered a judgment of acquittal. Here is why matching a description is not enough for reasonable suspicion under the Fourth Amendment.

In Holliday v. State (Fla. 5th DCA, Oct. 2, 2026), deputies responding to a 5:00 a.m. 911 call surrounded a man with dreads, a black shirt, and red pants, told him he was not free to leave, and tased him when he walked away. The caller never mentioned the boa constrictor and ball python around his neck. The court held that officers corroborated only innocent identifying details, so the stop was an unlawful Terry stop, and a charge of resisting an officer without violence under Florida Statute 843.02 cannot stand when the officer is not lawfully executing a legal duty.
