They took out"},{"speaker":"David Barton","startTime":114.7,"endTime":117.16,"body":"prayer, they took out Bible"},{"speaker":"David Barton","startTime":117.16,"endTime":120.1,"body":"reading, took out a lot of stuff"},{"speaker":"David Barton","startTime":117.16,"endTime":120.1,"body":"out of out of public schools."},{"speaker":"David Barton","startTime":120.1,"endTime":122.5,"body":"And then in '71, they said,"},{"speaker":"David Barton","startTime":120.1,"endTime":122.5,"body":"Look, we're just we're going to"},{"speaker":"David Barton","startTime":122.5,"endTime":126.64,"body":"give you a new test. But it only took the"},{"speaker":"David Barton","startTime":144.64,"endTime":148.45,"body":"court four years to get it"},{"speaker":"David Barton","startTime":148.45,"endTime":151.54,"body":"right, and really roll that back"},{"speaker":"David Barton","startTime":148.45,"endTime":151.54,"body":"at least the announcement of it."},{"speaker":"David Barton","startTime":151.84,"endTime":154.96,"body":"And so if you go back to 2019,"},{"speaker":"David Barton","startTime":151.84,"endTime":154.96,"body":"our friend Kelly Shackleford,"},{"speaker":"David Barton","startTime":154.96,"endTime":157.96,"body":"First Liberty that had that"},{"speaker":"David Barton","startTime":154.96,"endTime":157.96,"body":"Bladensburg cross case, and that"},{"speaker":"David Barton","startTime":157.96,"endTime":161.14,"body":"Bladensburg cross was a war"},{"speaker":"David Barton","startTime":157.96,"endTime":161.14,"body":"memorial cross after World War"},{"speaker":"David Barton","startTime":161.14,"endTime":164.59,"body":"One, there was a couple dozen"},{"speaker":"David Barton","startTime":161.14,"endTime":164.59,"body":"guys killed in the County in"},{"speaker":"David Barton","startTime":164.59,"endTime":167.68,"body":"Maryland, and the mothers"},{"speaker":"David Barton","startTime":164.59,"endTime":167.68,"body":"erected this cross to the memory"},{"speaker":"David Barton","startTime":167.71,"endTime":171.67,"body":"of their children. And the lower"},{"speaker":"David Barton","startTime":167.71,"endTime":171.67,"body":"court said, you know, you can't"},{"speaker":"David Barton","startTime":171.67,"endTime":174.85,"body":"say the primary purpose of a"},{"speaker":"David Barton","startTime":171.67,"endTime":174.85,"body":"cross is secular, so that cross"},{"speaker":"David Barton","startTime":174.85,"endTime":177.61,"body":"has got to go, they even"},{"speaker":"David Barton","startTime":174.85,"endTime":177.61,"body":"suggested that you could break"},{"speaker":"David Barton","startTime":177.61,"endTime":180.07,"body":"the arms off the cross and just"},{"speaker":"David Barton","startTime":177.61,"endTime":180.07,"body":"make it a single pillar, and"},{"speaker":"David Barton","startTime":180.07,"endTime":182.08,"body":"then it'd be constitutional,"},{"speaker":"David Barton","startTime":180.07,"endTime":182.08,"body":"just don't make it look like a"},{"speaker":"David Barton","startTime":182.11,"endTime":184.96,"body":"cross. And that got to the Court"},{"speaker":"David Barton","startTime":182.11,"endTime":184.96,"body":"and the Supreme Court said,"},{"speaker":"David Barton","startTime":184.96,"endTime":187.72,"body":"that's crazy. We're not doing"},{"speaker":"David Barton","startTime":184.96,"endTime":187.72,"body":"that. And the court said, if"},{"speaker":"David Barton","startTime":187.72,"endTime":190.99,"body":"something is a long standing"},{"speaker":"David Barton","startTime":187.72,"endTime":190.99,"body":"historical, traditional"},{"speaker":"David Barton","startTime":190.99,"endTime":193.75,"body":"practice, we're going to assume"},{"speaker":"David Barton","startTime":190.99,"endTime":193.75,"body":"it's constitutional like crosses"},{"speaker":"David Barton","startTime":193.75,"endTime":196.84,"body":"at a cemetery, etc. So with"},{"speaker":"David Barton","startTime":193.75,"endTime":196.84,"body":"that, you can start saying well"},{"speaker":"David Barton","startTime":196.84,"endTime":199.42,"body":"my goodness, there's a whole lot"},{"speaker":"David Barton","startTime":196.84,"endTime":199.42,"body":"of stuff that is constitutional"},{"speaker":"David Barton","startTime":199.42,"endTime":202.66,"body":"if you do that, nativity scenes"},{"speaker":"David Barton","startTime":199.42,"endTime":202.66,"body":"and prayer at schools and 10"},{"speaker":"David Barton","startTime":202.66,"endTime":206.26,"body":"commandments and Bible and"},{"speaker":"David Barton","startTime":202.66,"endTime":206.26,"body":"whatnot. And so we didn't know"},{"speaker":"David Barton","startTime":206.26,"endTime":209.62,"body":"how far they were willing to go"},{"speaker":"David Barton","startTime":206.26,"endTime":209.62,"body":"but at least they knock down the"},{"speaker":"David Barton","startTime":209.62,"endTime":212.11,"body":"test and they said Lemon tests"},{"speaker":"David Barton","startTime":209.62,"endTime":212.11,"body":"really is a flawed test. It's"},{"speaker":"David Barton","startTime":212.11,"endTime":216.22,"body":"not very good. And then last"},{"speaker":"David Barton","startTime":212.11,"endTime":216.22,"body":"year, there were two cases where"},{"speaker":"David Barton","startTime":216.22,"endTime":218.26,"body":"they just kind of put the nail"},{"speaker":"David Barton","startTime":216.22,"endTime":218.26,"body":"in the coffin and said we're"},{"speaker":"David Barton","startTime":218.26,"endTime":221.74,"body":"done with Lemon, those 7,300"},{"speaker":"David Barton","startTime":218.26,"endTime":221.74,"body":"cases were all wrongly decided."},{"speaker":"David Barton","startTime":222.04,"endTime":225.67,"body":"We need to roll all those back."},{"speaker":"David Barton","startTime":222.04,"endTime":225.67,"body":"And part of it came with our"},{"speaker":"David Barton","startTime":225.67,"endTime":229.36,"body":"friend Mat Staver at Liberty"},{"speaker":"David Barton","startTime":225.67,"endTime":229.36,"body":"Counsel who had that flag case,"},{"speaker":"David Barton","startTime":229.54,"endTime":232.84,"body":"where that Boston City Hall flew"},{"speaker":"David Barton","startTime":229.54,"endTime":232.84,"body":"more than 200 Different"},{"speaker":"David Barton","startTime":232.87,"endTime":235.96,"body":"commemorative flags, but they"},{"speaker":"David Barton","startTime":232.87,"endTime":235.96,"body":"refuse to fly a Christian flag."},{"speaker":"David Barton","startTime":236.14,"endTime":238.99,"body":"We'll do anything except"},{"speaker":"David Barton","startTime":236.14,"endTime":238.99,"body":"Christian. And they did that"},{"speaker":"David Barton","startTime":238.99,"endTime":241.99,"body":"because of Lemon test and so the"},{"speaker":"David Barton","startTime":238.99,"endTime":241.99,"body":"court at that time said, No,"},{"speaker":"David Barton","startTime":241.99,"endTime":244.99,"body":"you're going to fly that flag"},{"speaker":"David Barton","startTime":241.99,"endTime":244.99,"body":"too. And the Lemon test, this is"},{"speaker":"David Barton","startTime":244.99,"endTime":249.16,"body":"just a terrible test, and it's"},{"speaker":"David Barton","startTime":244.99,"endTime":249.16,"body":"not appropriate. And then later"},{"speaker":"David Barton","startTime":249.16,"endTime":252.19,"body":"that year with Kelly"},{"speaker":"David Barton","startTime":249.16,"endTime":252.19,"body":"Shackleford's case, Bremerton"},{"speaker":"David Barton","startTime":252.19,"endTime":255.82,"body":"versus Kennedy or Kennedy versus"},{"speaker":"David Barton","startTime":252.19,"endTime":255.82,"body":"Bremerton, Coach Kennedy who had"},{"speaker":"David Barton","startTime":255.82,"endTime":259.69,"body":"prayed in the football games"},{"speaker":"David Barton","startTime":255.82,"endTime":259.69,"body":"there at Washington state. And"},{"speaker":"David Barton","startTime":259.69,"endTime":262.72,"body":"they told him you can't pray and"},{"speaker":"David Barton","startTime":259.69,"endTime":262.72,"body":"it was privately after the game"},{"speaker":"David Barton","startTime":262.72,"endTime":266.2,"body":"he'd go up by himself to center"},{"speaker":"David Barton","startTime":262.72,"endTime":266.2,"body":"yard line, kneel down have a"},{"speaker":"David Barton","startTime":266.2,"endTime":269.11,"body":"silent prayer. And you can't say"},{"speaker":"David Barton","startTime":266.2,"endTime":269.11,"body":"the primary purpose of that"},{"speaker":"David Barton","startTime":269.11,"endTime":271.96,"body":"prayer is secular. But you can"},{"speaker":"David Barton","startTime":269.11,"endTime":271.96,"body":"say the constitution does give"},{"speaker":"David Barton","startTime":271.96,"endTime":275.23,"body":"you a free exercise of religion."},{"speaker":"David Barton","startTime":271.96,"endTime":275.23,"body":"So how can the primary purpose"},{"speaker":"David Barton","startTime":275.23,"endTime":278.29,"body":"of a prayer being secular, how"},{"speaker":"David Barton","startTime":275.23,"endTime":278.29,"body":"come you're allowed to strike"},{"speaker":"David Barton","startTime":278.29,"endTime":280.75,"body":"down the explicit language for"},{"speaker":"David Barton","startTime":278.29,"endTime":280.75,"body":"the free exercise and that's"},{"speaker":"David Barton","startTime":280.75,"endTime":283.87,"body":"where the court said we're done"},{"speaker":"David Barton","startTime":280.75,"endTime":283.87,"body":"with Kennedy. And so with that"},{"speaker":"David Barton","startTime":283.87,"endTime":287.2,"body":"being done, it has opened a new"},{"speaker":"David Barton","startTime":283.87,"endTime":287.2,"body":"door. And most Americans are not"},{"speaker":"David Barton","startTime":287.2,"endTime":291.52,"body":"aware of the fact that there's"},{"speaker":"David Barton","startTime":287.2,"endTime":291.52,"body":"some 7,300 different court"},{"speaker":"David Barton","startTime":291.52,"endTime":295.18,"body":"decisions that were decided"},{"speaker":"David Barton","startTime":291.52,"endTime":295.18,"body":"limiting religion in public that"},{"speaker":"David Barton","startTime":295.18,"endTime":298.18,"body":"are now pretty much off the"},{"speaker":"David Barton","startTime":295.18,"endTime":298.18,"body":"table. Now, that doesn't mean"},{"speaker":"David Barton","startTime":298.18,"endTime":300.31,"body":"it's all back in, doesn't mean"},{"speaker":"David Barton","startTime":298.18,"endTime":300.31,"body":"we're going to aren't having"},{"speaker":"David Barton","startTime":300.31,"endTime":302.38,"body":"Bible reading in schools or"},{"speaker":"David Barton","startTime":300.31,"endTime":302.38,"body":"prayer in schools or anything"},{"speaker":"David Barton","startTime":302.38,"endTime":304.48,"body":"else. It means that the court"},{"speaker":"David Barton","startTime":302.38,"endTime":304.48,"body":"has opened the door and said,"},{"speaker":"David Barton","startTime":304.69,"endTime":307.15,"body":"hey, if you'll walk through it,"},{"speaker":"David Barton","startTime":304.69,"endTime":307.15,"body":"and if you can prove that it's"},{"speaker":"David Barton","startTime":307.15,"endTime":310.66,"body":"historical and traditional, then"},{"speaker":"David Barton","startTime":307.15,"endTime":310.66,"body":"we're willing to say that it's"},{"speaker":"David Barton","startTime":310.66,"endTime":313.87,"body":"constitutional, even if it's"},{"speaker":"David Barton","startTime":310.66,"endTime":313.87,"body":"religious. And by the way, let me just"},{"speaker":"David Barton","startTime":320.29,"endTime":323.44,"body":"tell everybody that you just"},{"speaker":"David Barton","startTime":323.44,"endTime":325.72,"body":"need to be doing this everywhere"},{"speaker":"David Barton","startTime":323.44,"endTime":325.72,"body":"you have an opportunity. If"},{"speaker":"David Barton","startTime":325.72,"endTime":328.36,"body":"you're on the city council, make"},{"speaker":"David Barton","startTime":325.72,"endTime":328.36,"body":"sure you open city council with"},{"speaker":"David Barton","startTime":328.36,"endTime":330.25,"body":"prayer. If"},{"speaker":"David Barton","startTime":330.25,"endTime":333.25,"body":"you've got kids graduating this"},{"speaker":"David Barton","startTime":333.25,"endTime":335.77,"body":"year, make sure they include a"},{"speaker":"David Barton","startTime":333.25,"endTime":335.77,"body":"prayer at the graduation"},{"speaker":"David Barton","startTime":335.77,"endTime":338.5,"body":"ceremony, make sure they have a"},{"speaker":"David Barton","startTime":335.77,"endTime":338.5,"body":"baccalaureate service at a"},{"speaker":"David Barton","startTime":338.5,"endTime":341.05,"body":"church, because these are all"},{"speaker":"David Barton","startTime":338.5,"endTime":341.05,"body":"the things that have gone on for"},{"speaker":"David Barton","startTime":341.35,"endTime":344.74,"body":"decades and centuries in"},{"speaker":"David Barton","startTime":341.35,"endTime":344.74,"body":"America. Go back to doing this"},{"speaker":"David Barton","startTime":344.74,"endTime":348.07,"body":"because the court has said hey,"},{"speaker":"David Barton","startTime":344.74,"endTime":348.07,"body":"we're willing to roll back this"},{"speaker":"David Barton","startTime":348.07,"endTime":351.58,"body":"other stuff. So with that, we've"},{"speaker":"David Barton","startTime":348.07,"endTime":351.58,"body":"just seen a lot of guys in the"},{"speaker":"David Barton","startTime":351.58,"endTime":355.27,"body":"legislature willing to say,"},{"speaker":"David Barton","startTime":351.58,"endTime":355.27,"body":"okay, let's go back to what was"},{"speaker":"David Barton","startTime":355.27,"endTime":358.57,"body":"constitutional for decades and"},{"speaker":"David Barton","startTime":355.27,"endTime":358.57,"body":"decades, even centuries.
