Hello and welcome to the Christitutionalist Politics Show. I appreciate you taking the time to listen to me. As indeed, it is just me on the podcast outside, at least for the initial episodes. All substance, no must, no fuss. I am your host, Joseph M. Lenard. And last name is spelled L E N A R D like most pronounced Leonard, but without the O. And as Graham Norton would say on his late-night talk show, let's get on with the show.

Today's show title and theme related to theelibertybeacon.com article titled, My Dumb, tries to flip off the scotus affirmative action edition. Last week, we had basically part one, the student debt transfer edition. This week, the similar theme, the leftist basically saying, scotus, modus, whatever. Do they have an army to actually enforce their rulings? No, they don't. So we're going to ignore them. We're going to just create something pretending it's new. That is exactly the same as what scotus said is unconstitutional. And we can't do, but, oh, bleep you, we're going to do it anyway and dare you to now have to challenge it again through the courts. And if JustASS, as I call him, Chief Justice Roberts would do his job and not try to moderate the court and give these partial or compromise rulings like I discussed the last week. Baker case out of Colorado should have made the website design case they just ruled on irrelevant. The Colorado Baker case wasn't a compelled speech issue, but they didn't do a proper and full constitutional ruling. Robert seems to want to drag these things out. Well, we have a court that is now in a position to finally uphold the constitution and try to undo 50 years of bad law, bad rulings, bad precedents, and he drags his feet and drags us all out. And it will take us 20 years to undo it and we don't have 20 years to undo it all. But affirmative action is the title here. And I get upset at people who seem to never learn jumping up and down thinking that the scotus ruling regarding affirmative action will somehow now be the end of it. Not quite. Are you new? Were you born yesterday? Or as Bugs Bunny used to say, what a gulla bull. I don't mean to insult anybody's intelligence here. So please understand I'm saying these things in part to rile you. Yes, and in part tongue and cheek. But to make a point, not so fast, we shall see already some are reposturing historical repeats coming, both the affirmative action and both Biden already announced an undoing a reworking a rewording through a different statute and department deep state agency, whether it is actually constitutional in and of itself is a whole other question. And Norton v Shelby, which we will talk about many times needing to get discotus and deal with these unlawful overstep overreach in many cases, the indeed propertune usurpation of law of the Constitution of what Congress authorized. But that's another episode, another article the Norton v Shelby County, Tennessee.
What I want to quote here is, Stephen B. Presser wrote an article for the Chronicles magazine called Robert's Lefta Lupo in the affirmative action decision. And if it sounds like I'm reading that, it's indeed because yeah, I'm reading that from my notes, try to have notes to not screw things up as I still learn to do a podcast of my own on my own, carrying the whole show, except for, of course, when I have guests on to interact with as a savage done filter co host. It's a lot easier on my part to be the sidekick of the show and just intervene and interact and jump in women where I have something to add to the show, not have to actually drive the show. Anyway, rabbit hole, sorry. But Robert said, telegraphing, what I was saying, they're going to rework the same thing, meet the new boss, same as the old boss, some new rules, some new laws, some reworking of the same old crap, do the same thing, but just in a different slightly different fashion. And it hasn't fixed anything. And again, I will mention the you of them decision years ago, should have made this affirmative action case irrelevant and unnecessary. Because once again, Robert, the chief just asked, moderated the decision of that case, and didn't talk affirmative action as a racist, unconstitutional violation of equal protections, as they should have them. So they rehearing cases, they shouldn't have to. So they would have time to hear other necessary cases. They should be listening to him ruling on. But Justice Robert said this, nothing in this opinion, just handed down, he's undermining should be construed as prohibiting universities from considering an applicant's discussion of how race affected his or her life, be it through discrimination, inspiration, or otherwise. So he's hinting at, they can still do essays.
Do you remember, since I talked about movies a few episodes, Elle Woods movie, right with Reese Witherspoon, legally blonde, I'm turning 61 this year. Sometimes the facts can't be accessed as quickly to get to the time as I want them to. But yes, legally blonde, remember, she did a video essay, and they looked at the video essay and discounted everything else about her and her grades and eligibility, and decided to let her into harm. Same thing, Robert is hinting at here, the same workaround, the same excuse, the same race baiting, racism, others will be discriminated against. And as I talked to Bruce and Phil of the abolitionist roundtable, Wham Radio Saturdays 9am, you can go to wamradio.com, click the live link, regular shows on Saturdays, live shows, not the usual repeats, like most stations do, about these really being an issue of class, not race. The left wants to, of course, make everything, including this all about races, nothing to do with race, it has to do with class. What about poor whites and Hispanics in the urban failing schools who are having trouble also getting in the college, and or also with other unqualified people, then drop out. Now, if you want to go to law, if you don't qualify for Harvard, perhaps you go to Chicago law.
This is not keeping people out of school, it is just that you go to a school, you are more readily able to handle your law degree is still as valid in any state. If it's Harvard or Chicago law or you of them law or yada yada yada, whatever, that part is lost in all the argument. If you setting people up to fail by allowing them into somewhere, they're not up to speed. And that's what we're talking about. We're not saying they're dumb, they're stupid, they're incapable, they're just not at the statistical level, the grade level, the standards level of most of the other people going there. And therefore, they can't keep up, they fall behind, they drop out. So you have not done them any favor in so coddling them and saying, oh, you need my help, let me help you. I'm helping you. No, you're not helping them. You're setting them up to fail. That's not helping anybody, anywhere, anytime, anyplace, when you do that, that is just the left. Again, trying to create a dependency of a victimhood, you need me without me, you can't get anywhere, you will never amount to anything. And that is just saying those is the salt bigotry of low expectations.
And what about the Asians, who their families take the time to not necessarily directly homeschool, but as I discuss, hope does in my book Terror Strikes Coming Soon to a City Near You, make sure she set aside time every evening to sit down with their three daughters. What was in your books today? What did the teachers talk about? What were they trying to impress? And indeed, bolster when they are getting proper education and say, no, no, no, no. This is clear leftist indoctrination, rewriting the history, a warping of reality, trying to engage in leftist, locust, delusional manure. You need to be involved, but Asians often have family structure that they set aside that time to make sure their children are excelling, are doing their homework. If they don't have homework sent home, they're giving them homework to do so they stay above the curve. And we need that for all families. That is what helping is about encouraging them to do more and to do better, not belittle them, but also not participation trophy them. That, oh, you're special, you're so special. Doesn't matter how bad you're really doing, you're special. That doesn't help anyone. Never. It only sets them up to fail.

BRUCE FLEURY: Don't quit your day job, Joe. And if you have one, right,
JOSEPH M LENARD: you guys know I don't. So this is all I got now. But anyway, first, Phil, I thought I'd address with you this is being recorded for the affirmative action episode. But I more want to talk indirectly with you, Phil. We've all talked on air on the A.R.T. show about your take, which I agree with you wholeheartedly, on civil rights, the Civil Rights Act. I'd rather you address that because that really addresses the whole affirmative action thing. It's all special rights rather than equal rights.
PHIL STARGELL: Yeah. And that leads to us as a race of people not being able to see through the fact that for as long as we have been in America as slaves, as freed men, and whatever, the majority of black Americans are almost controlled through the voting process, at least, by the Democrat Party. It's been that way, and it's going to stay that way as long as the Democrats are willing to break the whole country in order to buy a vote. And now we see them doing that with the illegal situation. They're bringing all of those people in here for one reason and one reason alone to vote. And Republicans actually believe that they can compete with the Democrats. And that's the bad part about it, because you can't compete with somebody that's willing to play Santa Claus with somebody else's money.
JOSEPH M LENARD: Yeah. And what I, as soon as I can say it, what was it? The Civil Rights Act was a Republican act put forward by Republicans years before the Democrats in the Senate kept filibustering it. LBJ said, don't vote for it, but stop filibustering it. That way I can sign it and write LBJ said, I'll have them niggers voting Democrat for the next 200 years. That isn't me saying it, people. I'm quoting what LBJ said. And it was a lot of games.
PHIL STARGELL: That statement was made after signing the Civil Rights bill. And can you imagine what would have happened had a Republican made a statement like that? You can see, I can remember being a kid hearing Eisenhower's hear for speech. And he said, you people. Now that's an army term. I don't know, you know, that's you people, you bring young people over here and I get my people over here and we'll take this writ. That's Eisenhower speaking his idea of how to rally people. He said, you people at this speech that I heard on the radio and I could you could actually hear people in there yelling, you know, get it right, get it right. You know, and I remember hearing that. And what it was was that they they objected to him using the term you people. And they they spliced that the race that race card on him. And he was ever ever ever able to outlive that particular moment. But what can he do? He integrated the schools in Arkansas, which if you remember was one of the the tutors of Bill Clinton, Thomas, and Bill Clinton later on was able to use some of the terms and some of the ideas of Thomas. If you remember, Thomas said, you you have to win by by one vote and 51% right. You got to have 51% the win. They lesson. He said it's sort of hard for the other people to get 51 when I start out with 13%. Now this is in the 50s. So where were the black people they were at 13% that father was talking about that he knew he controlled and it was supposedly Arkansas was one of the most racist country states in the country. That's the kind of when I say control, the Democrats have control the black vote for ever since we got the vote in.
JOSEPH M LENARD: Well, I have to push back on that. I mean, if you see the movie with Matthew McConaughey, the free state of Jones, that's a great film. Following the Civil War, that's why the Democrats created the KKK, the Lynch Republicans, not just Lynch Blacks, but Black and White Republicans, because White Republicans were signing up free blacks to vote as Republicans and they were voting Republican. And the whole movie, Free State of Jones, talks about the racist Democrats south leadership still blocking blacks from being able to vote because they knew they vote Republican until LBJ signed the Civil Rights Act under false pretenses to take credit for that Republican act.
BRUCE FLEURY: First of all, Joe, what the Free State of Jones referenced that reminded me of the movie Mississippi Burning, which is a specialized account of the actual circumstances under which the four civil rights workers from Chicago, actually three of them plus one black, I believe, one young black man from down south, were murdered by the Klan and the Klan's efforts to cover that up. And there was one scene in there you might recall between one of the FBI agents and one of the Klan says as far as he was concerned, there was all these, you know, black Mississippi residents that had the right to vote, but they weren't going to. And he goes, and the FBI agent goes, well nobody dared.
PHIL STARGELL: I think that what we are missing here is when I say controlled, they control the black vote ever since they got it. Not that got ever since originally getting the Vote.
JOSEPH M LENARD: Democrats convinced them under the L.B.J. lie. They, as in the Democrats got their vote through that false pretense. Okay, I thought you meant ever since blacks got the vote to begin with. Okay, now we're on the same page, but we're saying the same thing. Right.
PHIL STARGELL: Here's what I mean. If they didn't vote Democrat, they wouldn't let them vote. Right. That's the okay. Right. They brought about the Jim Crow laws. It was put in because black people voted for them in order to for them to be able to put it in. And the reason why they voted was the same thing that they do now. They tell you that they're going to, you know, give you this and give you that. Well, in that case, they told black people that these laws will be separate, but equal will give you the money, and you do it at what you want, but just stay over here and stay over there. Well, we're going to vote for it. Guess what? That wasn't happening. They didn't give them equal money. They didn't give them anything.
JOSEPH M LENARD: Yep. And the left likes to talk about the first black this, the first black that well, the first black and congressman, U.S. House of Representatives, was a Republican. The US senator that was black, a black Republican, the first one Stodus Justice, a Hispanic, dominated as a Republican, but they blocked all that. So the first 20 black congressional members were all Republican, but Democrats today like to pretend all that history didn't happen.
PHIL STARGELL: But what that did happen with the these first blacks were done by Democrats. That was the same thing that was said running up to Obama being elected president. The question was asked many, many times, who do you think will be the one that ever be a black president? And people that they were asking the media was asking that question. And what they come up with was yeah, but it'll be a Democrat. And everybody thought it. But the thing is that after slavery and during reconstruction, the first black senator was his place was taken by guess who?
BRUCE FLEURY: Pitchfork Ben Tillman. And Tillman, was quite a piece of work as the audience will find if they simply look up Ben Tillman, that's Tillman with two L's. This is a man Joe who took full advantage of the black codes down south and show you know all about that. Absolutely. Yeah. And he had his own version of the Klan, this is called the Red shirts. And he would and they would actually go across state lines to prevent black black voters from from going Republican.
JOSEPH M LENARD: Yeah. Well, Bruce, I want to address one last thing. And then I'll go where running longer than I was anticipating even. But the whole affirmative action thing is not although the left, the demo cracks demo KKK rats, make it about race. Yeah, it's really about class, right? Poor white poor Hispanics in the failing urban community schools. Also our disadvantage, but they're never talked about only poor blacks in the urban centers received the affirmative action. This is not about race. It's about class, but the left can't win that argument. So the media, the liberal controlled media constantly talks about it. Is he racing right, Bruce? Well, yeah. And it's a good thing.
BRUCE FLEURY: Glad you brought that up because there was an article in the Detroit news yesterday. And you might want to look it up where where wretched Twitmer's administration is showering money on certain education dollars on certain black districts, okay, in the state of Michigan, predominantly black districts. Okay, now wait a second. I thought this was a public education was for everybody, right? Well, it's not public education, first of all, because the government is completely screwed that up. They took a concept which which lifted millions of Americans up educationally, because they focused on, you know, teaching what you need to know to get along in this world instead of all the stuff we're seeing now. But the the the the the the the the D.C. unions, the AFT, the the N.E.A. I mean, my lord, listen to some of these, some of the things that come out of these these people's mouths and guess what, guys, the N.E.A. president is a woman and the AFT president is a female. And these are two of the most radical people in you'll ever fear coming down the plank. My advice, folks, if you've got kids in a failing public school, get them the heck out. Yeah. situation in Baltimore is in Baltimore, Maryland alone, Joe, you know the situation. There's not even single student that can read a grade level. Yeah. And how much money are we spending for student in the state of Maryland or the state of Michigan, California for crying out loud? Yeah. These kids aren't learning anything.
JOSEPH M LENARD: And what you what you what you said about Michigan Governor wretched Whitler is in each that that's all money laundering. Yeah. That money isn't going into those classrooms to help those kids. None of that money will get tutors for those kids like Tudor Dixon, you know, tutor and with a T and Tudoor with a D who ran for governor last as Republican was talking about making money available for tutors so that these kids could be brought up to speed and actually read and write and do math at grade level. But wretched Whitler is funding money to the teachers, which then is laundered back to the FASCICRATS party. That's what's going on here. The money isn't getting to the kids, which is why people you've got to become Republican. You've got to vote Republican so we can get you vouchers. It's your damn tax money. The money should follow the child, not the district who have your own money to spend to a charter or a private school or whatever, because competition and loss of that money is the only thing the left understands. If they start losing all that money, then they'll change until then they're never going to change anything.
BRUCE FLEURY: And one last thing here, Joe, because I know you're going to need to wrap this up soon. Quite simply, when a candidate for office comes in front of you and goes through their whole spiel about how they deserve your vote, what they're going to change? Now I asked him one question, if far as education goes, what do you think of school choice? Do you support it or don't you? And if they don't support it, that can tell you everything you need to know about this person.
JOSEPH M LENARD: Phill any closing thoughts and then we'll end the call. Any thoughts?
PHIL STARGELL: Yeah, yeah. To look at the teachers is the correct thing to do because they are responsible for the makeup of the Senate and the Congress right now because of the idea that Hollywood and the media got behind the idea that a woman's right took over with the rights of the unborn. And her rights were more important than the child itself. And that's what we've got to do. And so now everything has changed and the power structure of the country has gone because of that one issue, the abortion issue. And we have to understand that we've got to go around that and win on other things because this is a losing issue for the Republicans and they have abandoned it in my estimation at the top of the political houses around. They don't want anything to do with trying to offset or change. So, you know, I think they've abandoned it.
JOSEPH M LENARD: In the purple and the blue states anyway, exactly. Yeah, I mean, we're still getting some good stuff in some of the more red states, but you're right. It seems like the party, the Republican party has in a lot of places, indeed written that off and don't want to talk about it as part of this whole moral issue. And it also goes back to LBJ's, the great FDR and then LBJ, especially the great society and the loss of fathers in the family. And that's part of that control, again, buying vote welfare, which is unconstitutional. The founder said promote the general welfare. Well said individual welfare checks is a violation of that concept. It's a violation of equal protections. But anyway, those are other rabbit holes to go down on another at another time. Hello, it's me again. I forget what song that is. And of course, I'm not here to freak you out with my bad singing. But we needed a third segment of this show as during the discussion with Bruce and Phil, the issue of money came up. And that is part of the issue here. They try to constantly make it about money, money, money, money, as well as the race, race, race, race. We've got to funnel more money into the urban centers per pupil. Overall, the centers are giving so much more money, more and more and more of it than the other areas, the rural areas, like the city of Detroit, I'm sorry, I didn't look it up. It's not necessarily relevant because what is happening in Detroit is happening with the urban centers versus the rural centers everywhere else. So the specific dollar amount here is not relevant because it won't equate to exactly what's going on in your area, your state, your section of the country. But for example, let's just say $15,000 attached to that child's head in the urban center, whereas another area, they may only get $10,000 for child. Well, how is it then exactly? They can do so much better with less money elsewhere. Even let's say it's equal, right? $15,000 everywhere. Well, compare that to 50 years ago, adjusted for inflation and all that, whatever, of course, it's always going to inflate up to some degree. But how was it that we once had so much less per pupil and were actually educating the children? It tells you that the fact isn't about money. It is about certain people then lining their pockets with all this money and money laundering back to the Fascist Party or the Deep State in Washington. Ever since the creation of the Department of Education under Jimmy Carter, an unconstitutional agency, this is a 10th Amendment, states rights, local issue, it got worse. Education gets worse every decade on since the creation of the Department of Education because then they control the money, therefore they control with strings attached. You want this money to the states, then you have to take these strings attached. It wasn't about education, it was about power and control and indoctrination, like the Hitler Youth in Germany. I'm sorry to bring that up. I know that's going to ruffle some feathers, but that isn't in the case, just like with socialized medicine. It's about power and control and coercion. So now we, the Deep State in DC, regardless of who the president is, regardless of who your governor is, unfortunately the states have become dependent on the federal money and therefore knuckle under to the strings that are attached. And we must eliminate, if not eliminate, steal it down 90% the Department of Education and return that either as block branch to the state or as direct vouchers to families with children in school, attending school. The dollars attached to the child as we had already previously discussed because that's all the left understands money. They keep growing the bureaucracy in DC and the bureaucracies in the school. Her pupil, her administrator ratio has gotten worse. There are more and more administrators and less and less teachers. So yes, if they say the teacher to student ratio is an issue, I've got no problem with that complaint. I agree. I understand a teacher with 20 students can spend more individual time with each student than a teacher with 30 or 40 in a classroom. Well, fire, some of these unneeded administrators, especially the di crowd, the diversity inclusion equity garbage. We are the most diverse and inclusive nation on the planet, the American melting pot. It is not cultural appropriation. We melt a melting pot. We come together, borrow a little bit of each other's culture to make a very unique American culture. So it's not racism. It's not cultural appropriation. It's as Tom McDonald says in one of his videos, blonde hair, blue-eyed guy, white guy, singing, and he's got dreadlocks in his hair. You may call it appropriation, he says. I call it pan homage because I think it's hella awesome. And that's the case here. It's only modern cultural wokism that is interjecting this race into everything. And the other thing, the left always loves to talk about root causes. Well, you know what? The statistics show that a two-parent family, that child is always going, well, I'm sorry, excuse me, let me back up, not always. We cannot make that blanket statement. We have to deal in facts and reality. The left is not. They just want unicorn delusion. What they say they're feeling are is only what matters. But a two-parent family home, those children do better. That's just a fact. It is not desirable. But what happened under the LBJ Great Society? They split the black family, divide and conquer, and keeping them as Candace Owens says, not me saying it, the demo KKK rat, new form of plantation. They never gave up the notion of owning the slave. But instead of working the fields, now they are just a plantation of votes. And when are people going to wake up to that, which is why Candace Owens, who was a liberal, saw the light, finally woke up, got awakened from her woke stupor is now a conservative Republican and created the blutted movement to bring the facts, these facts, the reality to people still living in a delusion watching the enemy as I call them on the nightly news, all controlled by leftist liberals towing the demo KKK rats party line talking point.
