David R. Carmichael is an attorney with Boswell & Dunlap LLP in Polk County, Florida who is Board Certified as an Expert in Criminal Trial Law. In this podcast episode, Todd and David explore the topic of Florida's Risk Protection Orders (RPOs), also known as Red Flag Laws, which were enacted in response to the tragic Parkland mass shooting in 2018.
RPOs are legal orders that allow law enforcement to temporarily confiscate firearms and ammunition from individuals who are deemed to pose a significant risk to themselves or others. David, who has represented the Lakeland Police Department, Winter Haven Police Department, and several other local law enforcement agencies, has conducted more RPO hearings than any other individual in the country. The discussion covers the history and implementation of these laws, their effectiveness in preventing gun violence, and the complex legal and constitutional issues surrounding them.
