A judicial conduct commission documents a pattern of abusive behavior, staff departures, and a suspension, only for a state supreme court to reverse removal and reopen the door to future judicial roles. We weigh accountability, bias, and how courts should protect both dignity and fairness without sacrificing trust.

• misconduct findings that cite staff departures and disrespect
• suspension following commission review and delayed hearing
• high court reversal allowing return after thirty days
• tension between bias claims and accountability standards
• risks to courtroom culture, due process, and public trust
• proposals for transparent oversight and fair remediation

Setting The Stakes

Municipal Court Judge Tracy Flood, the situation surrounding Bremerton Municipal Court Judge Tracy Flood represents a deeply troubling erosion of judicial accountability and a dangerous precedent for the justice system. While Judge Flood, the first black woman elected judge in Kitsap County, claims racial discrimination in the complaints against her, the documented pattern of abusive behavior toward court staff cannot be dismissed as mere tone policing. The Washington Commission on Judicial Conduct found evidence that Flood engaged in repeated misconduct so severe it drove nearly twenty staff members out of her courtroom. She was suspended in January 2025 after the commission determined she failed to treat court staff and attorneys with patience, dignity, and respect. A fact-finding hearing into her conduct had been delayed multiple times, suggesting a prolonged period of dysfunction in her courtroom. Despite this substantiated misconduct, the Washington Supreme Court overturned her removal in January 2026, allowing her to pursue judicial positions again after 30 days. This decision, which cited race and bias claims while ignoring the Commission's findings, sends a chilling message that serious professional misconduct can be excused by invoking racism. The court's intervention effectively rewards abusive behavior and undermines the integrity of the judicial oversight process. No wonder minority status judge Lori K. Smith, voted by her peers as woman of the year, ensured that a white Christian male was law lynched by City of Enam Claw Detective Grant McCall's setup of false allegations and arrest. Proverbs 2010 Differing Weights and Differing Measures, the Lord detests them both. The Consider Podcast. W. Consider.info. Examining today's wisdom, folly, and madness.
