The gavel drops on a winter agenda that quietly packs a masterclass in practical conservation. We walk through a ranch home at 35 Cypress Way with a planned pool near a mapped wetland and show how one smart choice—a cartridge filter or a backwash recharge detail—can protect water quality for years. Add a post-and-rail fence at the 25-foot no-touch line with clear placards, and you’ve got a boundary that survives beyond the build and keeps mowers, fill, and future “improvements” out of sensitive ground.
From there, we move down Spruce Street and keep the guardrails consistent. Lot 10 earns a clean approval outside the 100-foot buffer, with the crucial reminder that any work between 50 and 100 feet comes back to the commission. Lot 11 hits pause when a limit-of-work drifts inside 50 feet—so we continue it to fix the plan, not the policy. Lot 12 gets a green light by respecting the 50-foot line from the start. Along the way we talk erosion control at the no-touch boundary, the subtle role of soils and micro-ridges in defining wetlands, and why visible markers matter when topography doesn’t tell the whole story.
We close by looking ahead to a Chick-fil-A redevelopment within the 200-foot riverfront area. That triggers a deeper dive on RDA vs NOI, when stormwater calculations are needed, and how early coordination avoids late-stage surprises. If you’re a builder, homeowner, or planner navigating Massachusetts wetlands and riverfront rules, this is a clear, candid walkthrough of what earns approvals, what prompts continuances, and how to design once instead of revising twice. Alright. Evening everybody. I'd like to call the January 21st meeting of the Conservation Commission to order. Please be advised all these meetings are recorded. Oh jeez.
SPEAKER_03:My voice is going to be a little lazy. I'm just getting over a cold. So all public hearings and meetings were by the Rhanium Conservation Commission on Wednesday, January 21st. Excuse me. 2026 at 530 p.m. in the Radium Veterans and Morial Town Hall. Don't I'm within the meeting room 5 feet south of the industry reinhand mass are related to filings and joint hearings, indoor meetings under Mass General Law Chapter 131 and 40 has united in the town of Ranium Wetland Protection by Law.
SPEAKER_07:Alright. First up is request for determination of actability for zero commerce way. That has been continued to February 4th. Okay. Next up is continued notice for the vote to move it to.
SPEAKER_02:Motion to continue request for determination.
SPEAKER_03:I will second that. Motion made and seconded.
SPEAKER_07:All in favor? Aye. Aye. Opposed. All right. Next up is a notice of intent for 35 Cypress Way, lot six, West Pine Estates. Map 13, lot 56-6, DEP number two six nine ten eighty-four.
SPEAKER_05:Thank you, Mr. Chairman, Evan Watson, W engineering representing the applicant.
SPEAKER_07:Just one second.
SPEAKER_02:Okay, ready? Everything's good. As provided in Massachusetts General Law, Chapter 131, Section 40, and the Rainham Conservation Commission will hold a public hearing on application of West Pine Estates for a notice of intent located at 35 Cypress Way Rainbow. Property is owned by West Pine Estates and is shown on it as partial 55-6 on the Rainham Assessors Map 13. Zero Cypress Way, also known as Mirror Way Circle. The hearing will be held on Wednesday, January 21st at 5 30 p.m. at the Rainham Town Hall, located in 558 South Main Street. Copies of the NOI plan may be reviewed at the FCC office during its normal business hours at the Rayum Town Hall. The RCC office may be contact by calling 508-824-2706.
SPEAKER_06:Okay. Sorry about jumping the gun. This is lot six, 30 Cypress Way in West Pine Estates. So the locus shows it's at the end of this small little cul-de-sac here. So this one we have the erosion control set up at the 25-foot no touch zone. And this style house is a little bit different. It's a ranch, so it's a little bit deeper. And we want to have a pool. I don't know if the pool will be installed right away, but you want to mention you want to have it, so I thought the plant would be already approved. Or would be permitted to get sewer and water in the front, driveway here. And then all the grades basically come from the front into the roadway, and from the back gets this way towards the emotion control.
SPEAKER_04:So that's no septic system here. That's good. But um I don't see there's any provision for any provision for backwash for the pool.
SPEAKER_07:Yeah, well things talk. Um when we do pools, um, especially where you're so close to the wetlands, they have to be either a uh cartridge type or have some type of um drywall. Recharge for the for the back watch. Okay. That's one of the stipulations we do for pool permits for uh ones that are close to wetlands. Okay. Okay.
SPEAKER_06:Um is that something you would normally see on the plan, or is that something that just comes out as a condition?
SPEAKER_07:It'll be as an order of condition on a pool permit. Okay, sure. So that's we'll write it up as an order of conditions, but that's you know that way.
SPEAKER_04:But but just keep in mind that if they do it a rail well, then that requires a plan modification.
SPEAKER_07:True, because it doesn't show on it yet, right? So I would suggest cartridge filter.
SPEAKER_01:We'll have the information down to our body, they have to do a cartridge system. Okay.
SPEAKER_07:Um my only other thing would be um excuse me some type of barrier, post-rail fence with signage at the 25 no touch.
SPEAKER_06:So because we have the pool, we there is a fence that uh surrounds the pool on this side, and um I didn't put the placard um detail on here, but I was expecting that we put placards there on the rest.
SPEAKER_04:Yeah, but you just said that the pool may not be built right away, which means that that fence around the pool will not be built right away.
SPEAKER_06:So you'd like to see a pulse and rail fence at the 25?
SPEAKER_07:At the 25, yeah, with signage. And I would I would suggest that we continue it right to the property line at the 25. I mean, you've got your hay bills curling in, you know, whatever the 25 is from property line to property line. And you know, even if they do put the pool in later, uh, there is going to be a strip of land between there and the 25, no touch. And I don't want to see them, you know. Because we've wanted to this in the past where they, well, I can make the grass all the way to the flag line. So it just gives us a little security.
SPEAKER_06:Very good. All right. No problem with that.
SPEAKER_03:No violating. No, you explain my concerns.
SPEAKER_02:And the erosion control barrier is right at the 25.
SPEAKER_06:It's a little bit in front of it, but yeah, pretty much at the 25.
SPEAKER_07:This lots looked, I mean, contour lines only go to the edge of the pool there, but um does it drop off pretty quick in the back there?
SPEAKER_06:It's it's a little bit strange. The wetlands on this entire site are really dictated more by the soil type, not by topography. Okay. So if you were actually to look at the top, there's a ridge in here, and all the topography runs in this direction, it doesn't head forward for that. So there's an existing little ridge here at the wetland line. Okay. Makes a lot of sense. So whatever we pull back this way, that ridge one along this way, and then so it's it's relatively flat. Um, but again, these the soils that are on this side are very sandy and nice, and so as they jump over there, they get uh talky and tight.
SPEAKER_01:All right.
SPEAKER_07:No. I try to I've been out there a bunch of time to try to remember. It was a head scratcher to delineate it because uh I know there's a couple that kind of drop off, but on the other side of the street, it really drops off. The other side of the thing.
SPEAKER_05:Okay.
SPEAKER_07:Alright, uh, what would you like to do? Final number.
SPEAKER_06:I'd like you to approve the uh the plan with the um suggested uh modifications as a condition of approval.
SPEAKER_07:Okay, so you'd like to close the hearing?
SPEAKER_06:Yes, please.
SPEAKER_07:Okay.
SPEAKER_02:Uh motion to close the hearing. Motion to close this close motion attempts 35 Cypress Way, Lot 6, Western United States. Map 13, lot 55-6, DP 269-1084.
SPEAKER_07:I will second that motion. Motion may second it. All in favor? Aye. Aye. Aye. Approved. United. Okay. Thank you.
SPEAKER_02:Yeah. Um motion to issue notice of intent. 35 Cyprus Way, lot six, West Pine State, map 13, lot 55-6, DEP 269-1084. With the um special conditions concerning uh post and rail fence and backwash filter for the I will second that function.
SPEAKER_06:I I both have the next one I have on the board is ten. Yep, just give me two minutes here. Yep, that's fine, just uh losing density. Not good, Dave. It's the twenty first, right?
SPEAKER_07:Next up is going to be Quest for determination with applicability for eighty Spruce Street, lot ten of West Pine Estates.
SPEAKER_04:Uh eighty Spruce.
unknown:Okay. All right.
SPEAKER_03:Can I read the notice now? Yep, go ahead. Okay. Yep, sorry. Um this is published from the Taunton Daily Gazette as of January 13th, 2026. This is for Watt 1080 Spruce Street. This is the legal notice of the Commonwealth. County Radium Conservation Commission notice public hearing. Excuse me. As provided, the Massachusetts Channel Blasch Chapter 131, Section 40 of the Radium Conservation Commission will hold a public hearing on the application of West Pinada States LLC for a request for determination of applicant applicability located at 80 Sprue Street Rainham Mass. The property is owned by West Pine States LLC and the show of the parcel 55 to 10 on the Radium Assessors Map. Zero Sprue Street Austin Court. The hearing will be held on Wednesday, January 21st, 2026, at 5 30 p.m. at the Rainham Town Hall. Located factory itself in the street Rainham Mass. Copies of the RDA. Employee may be reviewed at the RCC office during its normal business hours at the Rainham Town Hall. The RCC office may be contacted by calling 508-824-2706. All understood persons are on card to attend the public hearing. Tower Ringham Conservation Commission. Alright, very good.
SPEAKER_06:This is Bot 10. And this is on the straight section of Spruce Street, which is the main road. It's on the left side of the road. There is a wetland just about at the rear property line, all the way out. And the 100-foot buffer zone highway right here. So the house, the driveway, and all the utilities are proposed outside the 100-foot buffer zone. This is a sidewood garage. And then we put the road to control at the window clearing, which is about 80 feet away from the resource area.
SPEAKER_07:Okay. Again, pretty straightforward. The only question I'm going to ask for you, Azu, can we put something in writing that specifies that no work or anything done beyond the 50 foot? I mean beyond the 100 foot has to come before us. So in the future, if they want to make more grass, they know to come before us. Okay.
SPEAKER_02:That would be a special prediction on that three together. Yeah.
SPEAKER_07:I mean, other than that, it's pretty straightforward. And look once again, we can think down the road because I could convene people think, oh, the wetlands are way at the back of the property. I can just bulldoze and do whatever I want.
SPEAKER_00:Too often.
SPEAKER_07:Huh? All right. Uh any questions of the board? No. Anyone else would like to add?
SPEAKER_06:No, thank you. Ask the opposed for hearing to uh negative determination.
SPEAKER_02:All right. Uh motion to close. Motion to oppose request for determination. 80 Spruce Street, lot 10, West Pine Estate.
SPEAKER_03:I second that motion. Motion second it. All in favor? Aye.
SPEAKER_02:Aye. Opposed. Unanimous. Motion to issue a negative three determination. For 80 Spring Street. Spruce Street, sorry. Lot 10 West Pine Estate. That's just a special condition.
SPEAKER_04:Yeah. You want to say between the 50 feet and 100 feet. Because if it's beyond 100 feet, you don't have to do the issue anyway.
SPEAKER_02:Right, okay. Work between 50 and 100 feet as a special condition.
SPEAKER_07:I would second that. All in favor? I oppose. All right. Next up is request for determination of applicability for 90 Sprue Street, What 11, West Pine Estates. As provided in Massachusetts General Law Chapter 131, Section 40, the Renum Conservation Commission will hold a public hearing on the applicant of West Pine Estates LLC request for determination of the pickability located 90 Spruce Street Renum Maps, property owned by West Pine Estates LLC, and is shown as Article 5511 of Random Center Map 13. Here was Spruce Street. Um Austin Court. Formally known as, yeah. Formally known as Austin Court. Okay. The hearing will be held on Wednesday, January 21st, January 26th at 5 30 p.m. The Rainham Town Hall located 558 Main Street, Rainham Ms. 02767. Copies of the RDA and plan will be reviewed by the uh Rainham Conservation Commission office during its normal business hours.
SPEAKER_06:Thank you again. Um this is 11, which is 9 street. It pizza, yeah. Okay. Um so this is right next door to what the one we just talked about. Same thing with the wet PW in the back. Um the house is placed up by the street, about 50 feet back. And the buffer zone are highlighted in orange. And this site doesn't really require a lot of sight grading at all. Um slot's relatively flat and right about the same grade as the road. So we'll just lift it up a couple feet from the road, and then we have the abortion control set at the end of the board.
SPEAKER_07:The orange line here is your what 50?
SPEAKER_06:The 100. The hundred. So you do have the piece of the building in the bulkhead. Yeah, it would be within the hundred.
SPEAKER_07:Um I'm just gonna make the same recommendation as we did last one.
SPEAKER_04:as the fifty feet for the cut off for the code for determination of a picture number of projects. Yep. While it's kind of shown the number of green, it's actually inside the 50 feet. Right down the C right in that section there you're so you have to straighten that out to be outside the people.
SPEAKER_06:Well there is there's no rating required there. It would just be um basically the I could I could move it back.
SPEAKER_04:Yeah but your resource control is my minute of work. Yep. You wouldn't be putting control here cannot put me a minute of work there.
SPEAKER_06:Okay we can we can move that to 50 it still gives a 50 foot backyard so yeah.
SPEAKER_07:Alright so you need a revised plane that reflects that yeah that's what it's gonna say uh you want we need to continue this we're gonna continue so right that's your determination I don't see anything else could the determination approve any work up to the 50 foot or outside of 50 feet yeah outside of 50 feet right um or any any work out within 50 feet would require the filing of a notice of intent to say it on the you could say that on the RDA right but when you underwise then you get a positive determination that says you need a list of intent on this no that's okay I was just trying to avoid continuing the hearing that's all just uh put it in the uh on the on the determination no but the determination is built on a plan before right yep inside the 50 feet sure okay no problem but we need to continue with it is that no plan okay all right I'll just try to think of a node uh there's no way to just make any condition no because there's not a normal conditions that's true okay that's right all right I was just trying to clean it all up at once but I guess it won't work all right so motion continues next meeting very good which is what February 4th yeah February 4th yeah uh motion corner okay uh uh motion to continue request for determination 90 Spruce Street lot eleven West Pine estates to February fourth I will second that motion may you second it all in favor aye opposed no right uh next up is request for determination of pickability for one hundred Spruce Street West Pine estates lot twelve as a provision of the Massachusetts General Law 131 section 40 of the Rainham Conservation Commission will hold a public hearing on the quest for on the application of West Pine estate LLC for request for determination of peckability located 100 Spruce Street Random Mass the property is owned by West Pine estate LLC as shown on Passel 5512 on the Random Assessors Map 130 Spruce Street aka Austin Coitt the hearing will be held on Wednesday January 21st 2026 at 530 p.m in the Rainham Town Hall located 558 South Main Street Rainham Mess copies of the RDA and the plan will be reviewed at the Random Conservation Commission office during normal business hours all right thank you very much so this is what we say 103 street block 12 is the next one up looks like I did a good job and I put the electric control outside the 50 feet this time.
SPEAKER_06:So we have a house this one's a little bit deeper um this is a few cargo route in front with the nice button behind it.
SPEAKER_02:Same wetland line here in the back and then I just highlighted the 100 foot blocker zone here and then we have the road control line the limit of work which is all outside the 50 foot blacker zone 50 foot zone and same as all these no septic systems all sewer and water food yep okay um yeah like I said the only thing I would suggest is the same wording we had in the first one yeah other than that I don't see an issue you guys say anything no ask you to close the hearing and uh issue a negative determination with conditions okay um motion book a uh motion to close the hearing and request for determination uh hundredth spruce street lot twelve West Pine state I will second that motion motion made second all in favor aye opposed unanimous okay motion to um issue request negative determination for uh 100 spruce street law twelve West Pine states with the same restrictions uh order conditions previous um seconds motion made and second all in favor aye aye opposed unanimous all right thank you gentlemen yeah I'll I'll send you a letter I um I'll erosion control for twelve uh nine ten and six are in place so I'll send you a letter that they're ready for inspection okay yeah as soon as I get the letter on when I'll do it okay all right see you in all right weeks thank you all right thanks thank you all can I review oh all right all right that's why we'll say I don't play my okay next time I will say it at the next period oh okay right all right it just caught me off guard and I wanted to double check submit those to the mandates all right uh we've got a couple bills to sign to approve minutes from the previous meeting oh I'm sorry first um everyone get a chance to review the minutes motion to approve the meetings January seventh seconded second in favor aye aye opposed unanimous second correspondence and other than site visits for those hay bills uh macadamie I did that no I know I didn't know oh oh oh sorry I didn't see it there you go um I did a site visit last week for a lady that um wanted to take down a couple trees um verified she's not gonna remove the stones or anything so all was good there alrighty I had I attended a uh pre-planning meeting that's right for 600 South uh um state highway and that was the old um party city building they're gonna renovate that area uh and construct a new building I informed them that they were within the 200 foot riverfront area that they need to at least submit an RDA to need so do we know what's going there?
SPEAKER_04:Do we know what's gonna be chick filing is going okay um they need to do um were they tearing the building down doing uh building a whole new building do they need to do any type of stormwater calculations or management or if so they will need if they include the product screen if they're not increasing the product screen what it's called income right if I'm removing a group of number building with a bar but if I'm picking a lot of things all are carried out existing building up and does but that would still it's gonna be different it's going to be called because we wouldn't have taken oh no what it's called okay so it would start with 55 that's there's one required and then put a narrative that it's quite wide of expense expensive expensive book it's not because it has to do at least that's why BTP on the feet 44 that's why DTP stepped in so what a bit of an ID so the minimum or IDA I would say right to go full NMI right because because you you could do it then you will full NOI want a 50 feet away from resource.
SPEAKER_00:This is real fun so it's 200 oh the oh yeah you are in or okay okay so we'll have to get that information to have the contact information um so I think we don't yeah just tell them that we would expect an NOI.
SPEAKER_03:Yeah because it wouldn't have food okay all right um anything else I do not have anything motion to adjourn second made second all in favor aye oppose we're done
