Old Greyhound Site Compliance Requests

SPEAKER_02This is the one I worked together many, many years ago. I'm representing Massasoit Greyhound Association, and I'm also representing Patriot Recycling, which is the second item on the agenda. And as you may know, um the track is going through a lot of changes, and um I think most of the building is down at this point, if not all of it. And um I don't know what future plans they have for the facility, uh, but as part of a recent, I guess it was a title search, uh, it was discovered that there were two uh notice notices and petitions that uh hadn't been officially closed out, and they still appear as open on um at the Registry of Deeds. And so I was asked to put together these uh requests for certificate of compliance for uh both of those projects, items one and two. And um the first one dates back to 2004, and it was for the installation of um some drainage improvements, and the overheim was the kennel area, and it included putting in a storm scepter unit for storm water quality and uh like that. So their work was done and it operated for all of these years as intended, but we just never filed for the certificate of compliance, just slipped through the cracks. But um since then the property's been subdivided, and another notice of intent was submitted for the uh simulcast facility, and that facility, as you know, is is constructed and um changed the entire drainage system out there, and uh the work that was done in 2004 is no longer in place because of the new order of conditions that they received to put in a formal drainage system, and that includes stormwater detention basin, four-base, piping, pretty much the whole thing. And um, so um the old system was removed and everything's been revamped and upgraded as part of the simulcast facility. And as far as I know, the the notice of intent for that work, or the order of conditions rather, still remains an open item. And uh at some point down the line when everything is constructed, uh they'll come back in and uh request a certificate at that time. So what we're trying to do is close the loop on this one, and um as I mentioned, none of the none of the items that are shown on the plan are there anymore, and um nor are the kennels and all of that. The building is sitting right there. Um so um for the purpose of closing out that order, we're just requesting that a certificate be issued that I can bring down to the registry and get get it taken off the chain. So that's the purpose of this first request.
SPEAKER_11Something is not there anymore.
SPEAKER_07Yeah, kind of well, it's uh uh I mean it's it's please straightforward mic, but it's such a long project and there's been so quite frankly, I didn't really get to see this until now. Okay. Yeah. Um so we really need to look at it because there's some over the years there were some times there were enforcement orders that were issued on the property. Right. So uh we need to kind of look at those together to make sure that everything, because these the ice bills are so old. One of the ice bills is 2004. Right. So we need to kind of look at it and see that it's still consistent.
SPEAKER_02Okay. Uh but none of those pieces remain in place. Okay. None of those pieces remain in place.
SPEAKER_07Yeah. So I know, but I'm saying in terms of what is now, uh going on there to make sure that at least it's not beyond what's here. Okay.
SPEAKER_02Keep in mind that we're not requesting any approvals uh for the work that was done under the separate notice of intent, which I think was 2024.
SPEAKER_07Yeah.
SPEAKER_02And uh so that has that work has nothing to do with what I'm asking for today.
SPEAKER_07Oh, and and 100%. Yeah. But because this is so old, right? And we just should not be able to physically I know unless anybody else on on the commission. I know I haven't and uh think that from my perspective, it's always good to do a side visit. I understand, especially on the commercial side. I understand that it's so active. Okay.
SPEAKER_08And my my point with that would be there's so many different hostels with so many different projects on it, that I think at some point we need to look at it as a whole and kind of and kind of say, okay, this is what we've got now from 2024. This is what's active, this is old stuff. Because I know there was out in the back area, I'm not sure if you were the engineer on that. Yes, there was replication area that was supposed to go in, it Bill did a site visit that was never done. So that's still outstanding. If that was done, completed. So I think at some point, this is probably a good opportunity, is to sit down with everything and take a look at the whole thing: what's old, what's new, what's active, what's been completed, what hasn't.
SPEAKER_06Okay.
SPEAKER_08Um, because there's a lot going on.
SPEAKER_02There is. There is, it's a busy place. And um, but you know, where these are all individual um orders of conditions, you know, they are separate projects. And um, in terms of the one-out back, um, that has its own order of conditions, but it did include replication. And I know that he did do replication up there.
SPEAKER_08Yeah, like I said, last time moved yeah, I don't know how many years ago that was.
SPEAKER_02It was a while ago. Yeah. It was a while ago. But um I think that's next on the list for a certificate of compliance. Yeah. To have you come out and take a look.
SPEAKER_08I mean, this would be, like I said, this would be, to me, my opinion, perfect time to sit down and just compare all the notes, go out, look at this. Yep, this doesn't exist anymore. The 2024-1 supersedes it, take it off the table. Okay, and the same thing with the next one on the list.
SPEAKER_02All right. Um, we just realized that um that these things were open just recently, yeah, and I couldn't have gotten in for the previous meeting. And um, unfortunately, um having these items remain open may cause some significant timing issues with the future development of the property. And August, beginning of August, will likely be too late, and things will need to get postponed. And I'm just wondering if there's anything we can do so that we could make something tonight that would be contingent on a site walk, and we'd go through all of these open things and uh you know, some sort of contingency measure, but um have something drafted up that as soon as we do the site walk, we can then move ahead and um and file these at the registry and uh so that the project can move forward without any delays. And um it would be a significant hardship, and I apologize that we just found out about it recently, and uh you know we should have known, but we didn't until attorney said the title search, and I got it in as fast as I could, but not early enough uh the previous year.
SPEAKER_08I don't know how to see with that.
SPEAKER_07Well, the commission actually only has one meeting in July.
SPEAKER_02I know, I know, and then the next meeting is August. Right, and that that presents a significant hardship for them, but I understand the situation. But if there's any way we could make some arrangement, uh it would be most appreciated.
SPEAKER_07Well, this is a uh certificate of compliance of a request, and you you're acting on those during a public hearing meeting, but it's not a literally a public hearing percent in terms of notification of a bodies and and look at uh advertisement in the paper. So you know you can pick it up and shelve it anytime you want. Uh, and there's no time constraint on the commission to act on a request for certificate of compliance. Having said that, if the commission uh feels like it's uh um uh it's in it it's it they can accommodate that in terms of what the other question, you could vote if you choose to, vote to issue a certificate of compliance after you've done your site visit, and if everything is done to your satisfaction, vote then that as part of that vote, that any three members can swing back one time and sign the certificate.
SPEAKER_04That would be Is it just on this one or is it gonna be on the other one too?
SPEAKER_07Well, they're both at the same current, yeah. Yeah, right.
SPEAKER_04Okay.
SPEAKER_07So so that way if you go out and there are issues, you're not obligated to act within any specific time frame. You're only doing them a favor. So, but if you go out and and you have questions and and you notify them, they cannot address it, then that's on them. Then you don't sign it. So you if you're voting the issue of a contingent upon site visit, and then uh signing of the certificate will only take place individually by members coming in to sign it if in fact the commission is satisfied after an inspection.
SPEAKER_02I'd be happy to meet the commission members out there at any time and walk towards it.
SPEAKER_08I'm just gonna say we could have uh three-member site visit. Yeah, but advertise it.

Does this parcel include the old sewer plant that was there?
SPEAKER_02I don't think it does. Um, I'm not certain. Okay, but we all know the sewer plant is not there anymore.
SPEAKER_08But um I know that they they did do I thought it was on the property, but I just I'm not seeing it here on the drawings.
SPEAKER_02No, it wouldn't be on that. Um that drawing is 2004, so that was built after that, as far as I know. Wasn't it? No, I forget what year that thing was built. But um I don't believe it is, but I can verify it.
SPEAKER_08Yeah, if you could just verify if it's a separate property, you'll okay.
SPEAKER_02Yeah, because I know they remove some property lines for the Sinocast Center, yeah, and uh that's on its own parcel, and I don't know if it includes the former treatment plan.

Patriot Recycling Berm And Stormwater Controls
SPEAKER_08next one. Sure.
SPEAKER_02Um the date of the order of conditions was two thousand twelve. And uh time flies. And at that time, the asphalt broken concrete processing operation that they now do out back on the opposite side of the railroad bed uh was under full operation out front, and uh right in that that area that's shown there. And they had been doing that since 2005 out there. And uh early on we requested a uh uh determination of applicability. That was in 2005, or maybe early 2006, and we got a negative determination at that time, and then the commission came out and did a site inspection in 2012 and said, you know, we really should do some some stormwater controllers and make some improvements here. And um so we filed the notice of intent and we discussed what type of improvements before I pulled all this together, and it was agreed that uh a three to four foot high mulch berm all the way around the perimeter uh would be effective in controlling stormwater runoff, and also that there'd be a uh an access weight established between the mulch berm and the operation, any stockpiles or active operations. And um, so we put the mulch berm in, and we did that by survey based on the plan that I prepared then. Actually, it's that plan, and uh they constructed the berm and they've maintained it since 2012, and it's still there, and it's still functioning as it was intended. Um in fact, we carried that same design into that next order of conditions for the parcel on the other side of the uh the railroad bed, and uh so the berm actually wraps all the way around uh over the railroad right crossover and down into uh the parcel on the west side. So the berm remains in place and still functioning, they maintain it, they bring in new loads of mulch and supplement it as they have to because they do deteriorate over time. And uh this is another one of those situations where I actually thought the thing, the order of conditions ran in perpetuity, but I don't think any of them do, really. So but uh they've been maintaining it all along, and I they're gonna continue to maintain it until they come in with a new site plan for whatever it is they intend to do with this in the future. So they're not gonna go out and remove the berm because there is still some some earthwork activity out there, and uh the screening topsoil and other activities out there. They're not necessarily affiliated with the processing operation to the west of the railroad bed. So um so they're gonna continue to maintain that as long as they're doing work out there and until a new order of conditions is issued for future work.
SPEAKER_08Did we I know there was a proposal brought forward for a couple industrial buildings here, probably back in the same time frame 24.
SPEAKER_02I I don't know anything about that.
SPEAKER_08They were. Yeah.
SPEAKER_02Yeah, like so I wasn't part of that.
SPEAKER_08And I know it was approved, so there's another order of conditions you may want to check on. Okay. Um I don't ever remember anything closed out on that.
SPEAKER_07That's the one that CWB CWD contract was. Came in came in for.
SPEAKER_08Because when they were doing the simulcast building and there was a proposal on the table for two industrial buildings up in that front packing lot. Okay. So there may still be an order condition, open order conditions on that project.

Sandy Hill Garage Plan Revisions
SPEAKER_08All right, next up is a continued notice for the 10 35 Sandy Hill DEP two six nine ten eighty-seven proposed thirty by forty garage.
SPEAKER_06I am uh Greg from Outback Engineering. I'm representing the applicant Braden Becker. Um as requested at the last hearing, we made some changes to the plan. Um first off, um inside the 25-no uh no activity zone, there was some uh retaining wall, gravel, and fencing. So we've removed all that behind the ear over the house, and now we proposed a loam and uh a wetland seed mix, restoration mix. Uh there was a shed that was partially in the 25-no activity. We were proposing to move that out of there. And then there was uh DEP said there was a disturbance way back in 2005 by the previous owner, and you guys you asked us to put it on the plan, so we did. So you have any questions?
SPEAKER_08Um I worked at the other day and um went out there. Well, I didn't go out there, but I looked at the the two plans from last time and this time, and uh they did everything that we asked on.
SPEAKER_10Did anyone contact NASCE EP to talk to any of the different items that we saw?

SPEAKER_03I I will, yeah. The only animals that are back there now are here and workshops from uh you don't.

SPEAKER_07And what you can do is so that the EP knows that you considered it in your order, you're gonna make a reference to it, and that the fact that that area needs to remain undisturbed and allowed to go back naturally. Once you address that, then DEP will basically bring it to your attention, you know, to demonstrate that you actually considered it, and this is how it was resolved.

I realized that I had um turn on the erosion patrol line on the plan that I printed for this uh lot. So I reprinted it with the erosion control line shown. And there's a revised date on that plan. Um so this is in the West Pine Estates subdivision at the end of Pine Street on the west side. It's on Spruce Street. Uh we were here before you a few times doing some of the lots on Cypress Lane and a few of the other lots up among Spruce Street, and now we're here for lots eight, and then next will be lot nine. Um on the plan here I highlighted the wetland line in green. Um the yellow line is the 100-foot buffer zone. And for this lot, the house, the driveway, all utilities are outside the 100-foot buffer zone. Um, and actually the only grating is outside the 100-foot buffer zone, but there will be some work to install a lawn within the 100-foot buffer zone, and all work is outside the uh greater than 50 feet away. At the limited clearing, we have some erosion control, which has already been installed. Um, I think Dave, when you went out there to inspect lot 10 and lot 7, the line, you know, just it just continues all the way through already. So I don't remember what I'm saying. Yep. Uh I have a letter too to uh um certified that it's gonna be installed. So I can submit that. Um so tonight I'd be asked uh open to any questions, and um it's our hopes that you issue a negative determination with any conditions you may have.
SPEAKER_08Kind of the same we've had with all of them. Um the only condition I would add would be um signage at the 25 or deal with the other ones.

Kings Pond Bridge Borings And Dam Safety

Proposed borings will be performed using a track-mounted all-terrain vehicle, drill rig in advanced using rotary wash drilling techniques. Public hearing will be held on Wednesday, July 8th, 2026 at 5 30 p.m. in the Rainham Veterans Memorial Town Hall. 558 South Main Street, Rainham Mass, a hard copy of the NOI application and plant are available for review at the Rainham Veterans Memorial Town Hall. Actually, going to fix this bridge. Yeah.

SPEAKER_03Sam Campbell from Green. Peterson Inc., we are the town's design engineering consultant and uh permitting consultant for the Gardner Street Bridge and Kings Pond Dam Replacement Project. Um, I think to start out, you know, just give a little background on kind of why we're here this evening, and this plan set might look familiar to some of you as this is the uh construction plan that was submitted as part of the previous notice of intent for this project, which was DEP file number 2691056. Um, so that was the notice of intent for which the commission issued an order of conditions for the replacement of the bridge and the dam itself. Following the issuance of that order of conditions, we've been working with the DCR Office of Dam Safety on the design of the temporary shoring and cheap pile uh dewatering system that will be installed during construction. And DCR Office of Dam Safety requested some additional geotechnical information to ensure that that system would function properly during a variety of storm events and you know just ensure that we don't have any washouts or issues like that during construction. So, for this notice of intent, what we're proposing is two additional boring locations. And when you see these plans, it's highlighted in color here. There's essentially two options that will be advanced. So in pink, that's plan A. The goal there is they'll bring in a crane. The crane will drop a barge or other small floating platform from the road into the pond, then lift the drill rig onto that, and they'll take two borings directly within the pond within an area protected by turbinity curtains. And that represents about 10 total square feet of impact to the pond. So just the two boreholes, it'll go straight down, get the geotech information, pull it all out. If for whatever reason, due to utility conflicts or just access at the pond, they're not able to launch a barge and take the borings within the pond itself, what they'll do is pursue option B, which is highlighted in yellow here. That option includes taking those two borings as close as they can get to the pond, but on the banks of the pond itself, so rather than in the water. The plan itself, we're requesting approval for all of them, you know, just on a single plan so that they have the flexibility in the field to, you know, uh advance whichever option works best. Um as I said before, about 10 square feet of impact to land underwater for option A. Option B represents about 100, or sorry, 150 square feet in each location, 300 square feet total of impacts to riverfront area. Um I think that covers most of it. You know, everything else you see on this plan is the design for the dam and the bridge replacement, which hasn't changed since we previously uh submitted for that notice of intent. The only other thing that I'll mention is if you recall, we had uh significant coordination with Division of Marine Fisheries for that past project, and they requested that we adhere to a in-water work time of year restriction for American Eel, which is present in Kings Pond and the uh Pine Swamp Brook or Forge River. Um that time of year restriction we anticipate adhering to again for the test borings, and that is from March 15th to June 30th, and then again from September 15th to October 30th. So the goal would be to try to get these borings done this summer before that September 15th time of year restriction starts back up. But of course, if for whatever reason that can't happen, they'll come back in the fall to take care of it. Once that information is obtained, we'll be able to submit again to Office of Dam Safety through their 253 permit process, uh, finalize the design of the sheeting that you see here, and then actually get this bridge rebuilt.
SPEAKER_08And talking with the highway superintendent, they have just about all the permitting done with this, and then dam safety came in and said, no, we want one more test before that's why as it stated, that's why we're here.
SPEAKER_03Yep. Yeah, so the you know, you folks issued the order of conditions. We also have our chapter 91 approval, 401 water quality cert from DEP, 404 authorization from the core, and at this point we're just trying to break ground before any of them expire.
SPEAKER_08So any comments, questions?
SPEAKER_07Yeah, the uh uh the sheeting will be temporary anyway during construction. Yep, yeah.
SPEAKER_03Yeah, either extracted or cut six inches below the mud line, so there won't be any you know visible uh sheeting.
SPEAKER_07So what are you using for sheeting? Metal?
SPEAKER_03Yeah, so for the dam, once we get this information, so no sheeting proposed as part of the boring process, those will just be floating silk booms. The sheeting itself during construction, we're anticipating steel sheet piles. Um, you know, interlocking piles that'll dewater the upstream area. Um there's a bypass pike that'll keep flow downstream, and then once they're done, they'll then pull them out. If they can't pull them out for any reason, they'll cut them below the mudline area will backfill and there'll be no evidence of them. Uh in the city.
SPEAKER_07Yeah, you want to know though. You're bad as the case. They're not able to pull it. You want to know that.

SPEAKER_08Yeah. Like I said, this is just one last turtle from dam safety.
SPEAKER_07Yep. One point I call it dam safety.
SPEAKER_03Actually, that was driven by, if you recall, dam safety's concern was they wanted the pond to be fully drained for all of construction. We wanted to minimize the impact and not do the full drawdown. So there's going to be some standing water in the pond. They said if you're going to do that, we need to know more geotech. And that was my I didn't want it to drain the whole pond. No, next thing you know, it's all grown in by the time you're done, the neighbors are becomes a wetland. Yeah. All right. Uh anything else before you close the hearing? Uh yeah, I think unless folks have questions.

Right Of Entry For South Street Work
SPEAKER_08up is um actually I'm just gonna skip the last one and we'll come back to it on the informal now. Uh discussion on action for requests for a right of entry for zero South Street East Map 17, lot two. This is in regards to the uh bridge replacement, the old colony bridge replacement on South Street. And during the final construction meetings and stuff, it's been determined that there's a piece of conservation property that we own at the corner of Sandy Hill and South Street, and there's a chain link fence there and one tree that's in the way for the sidewalk construction and grading. So, and they also want to during construction be able to park equipment right there in the corner. So I'll let him explain the rest. That's where we're at. Sure.
SPEAKER_03Uh so once again, Sam Campbell, Grinning Peterson Inc. uh. Before I go too far into this, I'll just kind of explain some context here. So this is a Mass DOT project, uh, and Beta Group is actually the engineering consultant for this, but my colleague Sid works with Norm over DPW doing um you know essentially DPW resident engineering services, so that's why GPI is here talking about a beta and mass.job. But the parcel, like Dave said, is on the corner of Sandy Hill Street and South Street East, uh, highlighted the boundaries here in yellow. Standard roadway reconstruction project, they have a linear easement along the frontage of the property on South Street East, highlighted in pink here, that they need just to facilitate the roadway improvements. Um, work within that easement is going to include clearing and grubbing of existing vegetation, removal of that chain link fence, removal of an existing stump, grading out to tie into existing conditions between the sidewalk and the grades on the property, installation of an erosion and sedimentation control barrier, application of loaman seed and a roadside riverbank seed mix, so a native seed mix, and temporary construction area, so just you know, routine site access for uh personnel and equipment. Um these plans are right-of-way plans, so they don't actually show the uh you know physical improvements, it's just the property boundaries of the usement area. I'm not sure if they've already filed a notice of intent with you folks, but this is just to the There was a whole conversation I had with Sid just before I got here.
SPEAKER_08Because it was a limited project, um DO DOT and DEP did not request a notice of intent for the project. Okay, and if it's the bridge, it's probably their bridge exemption that they're because they're not doing the pilings, they're just doing the roadway. So there was no notice of intent filed for either radium or tarnum.
SPEAKER_03Okay. Yeah, so I mean, as far as my piece of this, it's just to explain kind of what the easement is, and I think you spoke with Norman Sid about the process, so it I think it's relatively straightforward, but so at the end of the day, the disturbance is probably a foot or two into the conservation area.
SPEAKER_08Um I can give you it's it's about 1200 square feet. 1200 square feet. A bunch of roadway. And it's yeah, it's just a bust roadway, it's just so they can get the sidewalk in there and the associated back grade.

SPEAKER_08So um low impact, I would say grant them the I thought he mentioned parking equipment. Parking equipment during the in during the construction phase at the edge of the of the conservation area. They're not going to be in the conservation area, it's at the conservation line. They were originally talking about stockpiling stuff there, but that's off the table.
SPEAKER_03Yeah, so they're proposing a five and a half foot wide. It's in that concrete sidewalk. So that's the back of the sidewalk there. You can see for that easement extends that you can just enough space to store some material and equipment while they're building it. And you know, that easement line carries through to this residential property here. Which is also town arrangement, but that's selected conservation.

SPEAKER_03Yeah, so they'll whatever area is disturbed, they're gonna hit that with uh native seed mix, and then typically um they'll come back before they do final close out and just make sure that the RE signs off that you know disturbed areas are vegetated, there's no you know, outstanding elements of any of the construction in that way.

SPEAKER_03Exactly.
SPEAKER_08And it's it's basically because the road is this wide now, in order to come up to today's standards. Correct me if I'm wrong, but they have to put the sidewalk in, which puts the road lay a new road layout for the town a little bit wider than what the road is now. More or less. Yep. Okay. So that's how we get the grading that falls into the conservation area.
SPEAKER_10Okay.
SPEAKER_03Yeah, it's an issue now, not an issue, but on a lot of these DOT jobs, you know, they need to provide at least some pedestrian and bicycle accommodation, so that bumps out your roadway cross-section, and then typically these, you know, old, this is a 2025 layout, so it looks like they actually adjusted it recently, but a lot of these layouts are from you know the 60s and they weren't accounting for as much as you can. Yeah, exactly. And people on the sidewalk not paying attention either. Yeah.
SPEAKER_07Well, if you if there's anything like a uh 106 in a West Bridge order, you'll have a back lane, and then as soon as you go past the intersection, move back to the moving to the middle.
SPEAKER_08Yeah, the sheriffs where they reach my skin and treat as no. Oh, that's right. You gave me a paper.
SPEAKER_03And I don't think that needs to be signed tonight either. I think that's something that you know you want to look at the plans, confirm anything with Citronorm, talk to town council. Um yeah.

Brickstone Enforcement Follow Up Steps
SPEAKER_08formal. Uh last week or last meeting, we had a enforcement order for 1736 Broadway for the Brickstone restaurant. Um they had gone into um areas that were not supposed to without notifying us. So we issued an enforcement order. We asked them. Oh, sorry, what that's okay. Uh we asked them to come to this meeting, discuss it. Uh I see no one's here. Um, so I guess I would send them a second letter, certified letter, saying that from this point forward we're going to issue.
SPEAKER_07So notify them that they need to appear at the August meeting, at which time, if they don't show up, that the Commission tends to uh impose our financial fines.
SPEAKER_08Okay, we can't do the fines at this point.
SPEAKER_07No, because the the question is to meet you.
SPEAKER_08All right. We had asked them to come, didn't we, in the letter?

Still nothing. Still nothing. The only thing they did was remove the asphalt that they had dumped in there. But they cut down trees, they put up fence in within the hundred um foot, and they're just crapping trash back during construction. And even though it was probably there ahead of time, they bought the property, they inherited the problem just like this gentleman on Sandy Hill. Um, it's their responsibility to fix it. How many trees did they take down? And what count? Just probably two. They were probably 12 inch. We had them. Well, I mean, that's gonna be for discussion when they come back before us.
