SB4 Returns After Fifth Circuit Ruling On Standing
Use Left/Right to seek, Home/End to jump to start or end. Hold shift to jump forward or backward.
Texas politics moves fast, but the receipts move faster. We start with the Fifth Circuit clearing the way for Texas SB4 to take effect again, not by ruling on the merits but by saying key challengers lacked standing. That procedural win still matters because it reopens state-level penalties for illegal entry and illegal re-entry, plus a state process that can speed up removal. I also zoom out to the bigger question underneath every border fight: what is the goal of good government, and how should law protect the innocent while punishing wrongdoing?
From there, we confront what public safety looks like when violent gangs are part of the equation. I break down the Houston-area MS-13 racketeering case and the long sentences handed down, then argue about incentives, deterrence, and the real cost of decades of incarceration. We also hit the election angle when an old John Cornyn Spanish-language ad resurfaces touting support for legalizing DACA “Dreamers” and a permanent solution, raising the uncomfortable reality that campaign messaging never truly disappears and voters are left to decide what counts as disqualifying.
The back half turns to trust and transparency. Justin White joins me for Medicare Monday to talk about AI as a tool, why AI customer service can become a “cheap substitute,” and why pretending a bot is human is a line we should not cross. Then we connect that same transparency theme to Texas schools, from a troubling teacher hoax case to new TEA and SBEC reporting that makes educator misconduct easier to track. We also cover the DOJ backing away from defending the ATF “engaged in the business” rule on private firearm sales, and what that means for Second Amendment litigation in Texas.

Runoffs And The Week Ahead
SPEAKER_10Husky Risley, Ruskin Surgery, Michael Wilson.
SPEAKER_16Welcome back, ladies and gentlemen. I'm your host, Michael Wilson, and you're listening to the Lone Star Conservative. And here we are in another week. The last I guess last week was really the last week of April, because by the start of this week, um we're we're finishing up the month of April this week. What is it? Friday's May 1st, which I mean, there we are, month of May. And as a reminder, given that we're coming up on the month of May, you guys might be aware. And if you don't remember, you need to start thinking about it. We have a lot of runoff elections coming up. And and quite a few of them are not small town podunk elections either. Quite a few of them are pretty significant. Um, probably one of the biggest for us is going to be the Ken Paxton, John Cornyn runoff. And I think you guys are pretty well aware. As I've stated before, we don't endorse candidates as a station, uh, or, you know, myself as a as a political commentarian. But, but without taking the step of actually coming out and endorsing somebody, I am honest about, you know, which things I like, which things I don't like, and by extension, which candidates I like, which candidates I don't like. Uh and so you guys are probably well aware, given my position on basically everything, which of the two candidates that I largely fall in line with politically. Uh with that being said, we are going to talk a little bit later in the show because pretty wild stuff came out. Uh apparently, and I didn't know this. I'm sure some of our listeners might remember it. And if not, I'm sure there are plenty of people who have seen it. I did not see it at the time. Apparently, back in 2020, uh John Cornyn ran an ad, a campaign ad. And this is why you always get to be cautious when you say things, right? They're in podcast form, they're on the internet. I have a distinct feeling that if if I say anything today, and I'm still in politics in 10 years, which is the plan, that it's gonna get brought up. People are gonna point to it and they're gonna say, Hey, Michael, you said this thing a decade ago. What do you have to say for yourself? Hopefully, I am wise enough with my words today that I could say, yeah, I believe that in 10 years. Yes, that's that's true. I did I did mean what I said. But this is why you have to be very careful about the things that you say, especially in an industry like politics, because if you have any skeletons in your closet or things that even appear to be skeletal in nature, they're gonna get found out. And John Cornyn ran this ad back in 2020. This will not be the first story, but I want to kind of tease it since we're talking about runoffs and John Cornyn and Ken Paxton. Apparently, this campaign video highlighted Cornyn's support for dreamer legalization and permanent status, uh, kind of, you know, legalizing illegal aliens, that sort of stuff, before, of course, the ad just disappeared from public view and then never came back. Uh, but yet again, kind of highlighting some major differences between the two candidates in that runoff. With that being said, before we get into all that, let's kick it off here in the first segment by talking a little bit about the
SB4 Gets Green Light Again
SPEAKER_16I mean, really this on the same topic, but it it does have to do with illegal aliens and with immigration. And that's because a federal appeals court has lifted this ban or this block on Texas's border enforcement law, handing the state a major procedural win in its effort to crack down on illegal immigration. Now, for some background, uh, this happened over the weekend, and the U.S. Court of Appeals, Fifth Circuit, that's the one out of New Orleans, voc uh vacated a lower court injunction against SB4, finding that the groups, and this is great, the groups that were challenging the law in the first place, they didn't even have the standing to sue. Now, the negative of that sort of ruling is that since we didn't rule on the merits, if you do find out that there is somebody who does have the merits to sue, who does have the standing, they can then come up and you're still embroiled in the same lawsuit down the line. But in the meantime, this is a great win. Now, because the plaintiffs do not have a sufficient legal stake in the case, the court ruled the lawsuit can't even proceed, meaning that it the law just gets to take effect. Now, Senate Bill 4, for those of you who are not aware, it passed back in 2023, the 2023 legislative session, and it creates state-level criminal penalties for illegal entry into Texas and gives state and local law enforcement a direct role in immigration enforcement. The law establishes two primary offenses at the state level. So this is separate from just the federal level. First, it makes it a crime for a foreign national to enter Texas from a foreign country at any location other than a lawful port of entry. So if you're not coming through an actual border zone, if you're not driving through or flying, whatever the process is, if you're not being checked by customs border protection, if if things are not going the right way, right, then that that already is now a state level offense. You've now broken state law by coming in through some other secondary port of entry that is not is not looked at by the state of Texas. But the second offense that it creates is a separate offense for individuals who re-enter the state after having previously been deported or specifically denied admission. Say that you applied for citizenship, and based on the criteria, whether you have some sort of issues in your background check, former criminal history, whatever it is that got you denied, they denied your application for citizenship. And they said, you do not qualify, you're not eligible to become a United States citizen, so therefore you can't come here. If you then enter after that, that is a separate extra offense on top of merely having to come here illegally. If you come here after being denied, or you've been deported before already, you know better, right? You've faced the punishment already, and you decide to come back. Those, those are all, and and if you enter at a uh you know, non-port of entry, those are all new state level offenses under SB4. Now, it's not just criminal penalties. That's the that's kind of the big bulk of SB4, but SB4 also creates a new state process for the removal of illegal aliens. Under the law, a judge may order an individual accused under this statute, SB4, to return to the country from which they entered. If the person agrees to do that, then the criminal charge can be dismissed. In other words, it's actually pretty great because a lot of the complaints coming from the left over the due process of illegal aliens is that they're not getting their fair dare their fair day in court. Which I don't want to get into the messy analytics and discussions of constitutional rights when it applies to illegals and what that looks like and uh if that applies to deportations and invasions. I I don't want to get into that because that's a whole separate mess. Uh one that we can certainly talk about if that's the list if that's what you guys want to do, right? But it it is a it is a massive conversation to get into the constitutionality uh of due process when it comes to illegal aliens, especially in a time where illegal aliens are not simply people who've come here um in very, very small amounts and just we want them gone, but you have a mass invasion on your hands. Nevertheless, when you have to deal with due process, the judges have ruled on, especially at the state level, you start thinking, how can we get around this? Right? And not not in the sense that, you know, we don't care about the Constitution, not in the sense that we we want to, you know, screw over everybody that no, no. But in the sense that we have a massive epidemic of invasion and we want to balance following the law with mass deportations, even at the state level, right? Even at the state statute level. And it's pretty phenomenal to think about this law because for a very long time, we've kind of been bound by, well, they've been held for 10 months in immigration on an immigration detainer, or they've been held in a facility for a year. And you we we look at that and we say, that's the left goes, that's really, that's really awful they've been held for a year. And I go, Yeah, I agree, it's pretty awful they've been held for a year. Now you think it's awful because you want them released in the country. I think it's awful because I want them deported. And this kind of addresses that because a lot of the main reason that we haven't gotten mass deportations, especially at levels like this, are because, well, the people that are being charged, it takes a long time to go through court. We know this in regular criminal trials as well. How many times have I complained when it takes a year to go to trial or two years to get to a criminal trial? It's incredibly frustrating. And so for a lot of illegals, right, not only are you going to be held for an extended period of time, you may face other consequences, right, for what you've done. Or you could just say, I'll go home. Yeah, I entered the Mexico, I'll go back to Mexico. You got it. You got it, Haas. And you're out. You don't have to deal with court, you don't have to deal with the detainer, you just get to leave. And now our borders are secure. So unlike under the Biden administration, where if you did leave, you could just, you know, come right back, you can just skip the it's like pass go, collect $200. Literally, what happened? Because under this law, oh, you can just leave instead of, of course, you know, being required to go to court, you can just go home and that criminal case is dropped, but then they would just come back. And so it's phenomenal with a secure border and with the opportunity. And this is the same thing the Trump administration offered. If you guys remember, for a while now, the Trump administration has been offering these flights home with thousands of dollars given to the people that are self-deporting. And it's been largely pretty successful. Turns out a lot of people, when they know they're between a rock and a hard place, they'll take the only option they have, really, which is just go home. And and you know what? You're actually pretty lucky that you're getting money because we could just send you home, and that's it. That's that's what's happening to a lot of people that don't want to self-deport, that are getting caught anyway. And you gotta wonder, what a bad investment, right? Could you imagine? It's like you're on a it's it has to remind you of when you're watching like deal or no deal, like you're watching a game show and you see the contestant up there and and they're offered the case, right? They have they have a couple cases left. We'll give you $10,000. And they go, No, I'm picking the right case. And then they pick the case that has the dollar in it. And you think to yourself, Oh, I don't know why you didn't just, I would have been happy with $10,000. I wouldn't have risked it. I would not have risked that. Take the 10. That's kind of the same way you're doing you're looking at illegal aliens like a game show. You watch and you're thinking, man, you just got picked up today. If you had self-deported yesterday, you'd have made a couple thousand dollars, had a nice flight, not had to deal with, you know, being in a facility and going through you could have just done it yourself and moved on. But no, no, no, no. You wanted to keep breaking the law and hope you didn't get caught. That's unfortunately how it works. Now, the legal challenge to SB4, to kind of wrap this story in a nice little bow, started back in December of 23. This would have been right after the, not right after, but but a few months after the legislative session ended, uh, by Los Americas Immigrant Advocacy Center and American Gateways, two immigration advocacy, these these immigration advocacy organizations, as well, by the way, as El Paso County, which decided to join. They argued the law violates the U.S. Constitution and interferes with federal authority over immigration policy. Now, of course, the U.S. DOJ under the Biden administration later joined the lawsuit, similarly arguing that immigration enforcement is a federal responsibility and that Texas could not create its own parallel system. The cases were consolidated, meaning that they all kind of joined into one single lawsuit. And in February of 2024, a federal district judge issued a preliminary injunction blocking the law before it could take effect, essentially saying, Yeah, we we don't know what the case is going to play out to, but we understand they could do irreparable constitutional harm if we let you apply this law until we rule on whether or not it's constitutional. So therefore, you can't apply the law. That injunction remained in place even after the Department of Justice withdrew from the lawsuit in 2025 under, of course, Donald Trump. They said, Yep, we're out. Doesn't benefit us. We like when the state kind of helps us out. That's a positive. We can work together. We don't care. We're not concerned about it. They drop, they dropped the case, but of course you still had El Paso County and the two immigration organizations. And so um they continue pursuing that case. And then on Friday, this this past Friday, um, they ruled that there was no standing, right? Without the DOJ, they're saying, well, what did El Paso County have to do with federal authority? You guys don't have the position to sue. You have no clue. This is not your business, essentially is the answer. Now, notably, the court did again, did not rule on whether or not SB4 is constitutional or if it's preempted by federal immigration law, leaving those questions for future litigation should we be sued by somebody who actually has standing. Uh, and so of course, Ken Paxton came out, he said, taxes is right to arrest illegals, protect our citizens, and enforce immigration law is fundamental. This is a major win for public safety and law and order. Now, David Spiller, he's a state representative who is the sponsor of SB4, praised the ruling. He said, I'm extremely pleased that the Fifth Circuit Court of Appeals issued its on banque ruling vacating the preliminary injunction that previously prohibited the enforcement of SB4, the strongest border security bill in the nation. He added that the decision allows Texas to enforce the law's criminal provisions, including illegal entry and illegal re-entry, and argued the court, quote, rightly recognized the historic sovereign powers of the state of Texas to legislatively protect its citizens. He said, I have constantly stated, despite the claims of so-called immigration experts, my wholehearted belief that SB4 is completely constitutional because it is not in conflict with the president that in Arizona, the United States, it is not preempted by existing federal immigration law. It is not in conflict with existing federal immigration law. And Texas has the absolute constitutional right, authority, and ability to protect and secure its borders and its sovereignty. That's a phenomenal quote, by the way. I mean, that's just it's beautiful on state sovereignty, constitutionality, the goal of all good government.
What Good Government Is For
SPEAKER_16And I've asked this before on the show, but it is worth bringing up what is because anytime that I hear people discuss the constitutionality of things, discuss the role of government, discuss, hey, you shouldn't do that, or you shouldn't do this, or that's not very nice, or that's not good. I always it always drives back to the main root question of all of this, of politics in general. What is the goal of good government? And that the answer to that question can apply, and it'll it'll be, you know, the results will be slightly different. The specific policies will be different, whether or not it's at the local, state, or federal level. But if you can answer the question, what is the role of good government? That that answer should be relatively the same for local, state, and federal. It'll just depend on how it's applied. The end goal should be relatively similar. And you could go the philosophical route, and you could say things like, well, to to pursue and to to build up and encourage that which is good, true, and beautiful. Well, that that's true. That is a true statement. But I think it goes even deeper than that. It is it is to protect the innocent in your country and to punish the wicked. I I I bear the sword. I ultimately think that is the main goal of good government is to protect the innocent and punish the wicked. Because if you if you boil it down that simple, if you're willing to go with me here, I I think it's very clear that everything else kind of falls under that. Because if you're punishing the wicked, well, you have to define wickedness, you which requires that you have good laws. It requires that you define what a crime is. That also requires that you define punishment, which means you get into justice, right? It also means that immigration is largely handled. You're not actually protecting the innocent if you're allowing mass immigration, legal or illegal. If you're changing the fundamental demographics of the country intentionally, if you're changing the culture and the society and making it worse, well, you're not protecting the innocent. So automatically doesn't it it falls under the same principle. I think every role of government falls under this. Whether it's taxation, roads, whether it's you know, military spending, foreign policy, terror, what like literally any policy that that any form, any level of government will have, I think largely falls under. I I say largely because I can't think of anything off the top of my head that doesn't fall under this, protecting the innocent, punishing the wicked. I think the government's role boils down to that. And so whenever I hear somebody say, Well, you know, the Constitution says and you just have to think to yourself, you have to understand that the founders were trying to design the best country they possibly could. And they did a heck of a job, by the way. Round of applause for those guys. I I mean they said dead serious, unbelievable, especially when you remember how old many of them were. What they were willing to give to get to that point. By the time you got to the ratification of the Constitution, you have to remember everything they had just been through over the past 20 years, absolutely insane. And so they they set out with the goal to create the best country they possibly could. And then, of course, over the past really 50 to 100 years, a lot of that got thrown in the trash through immigration, genocide, and by genocide, of course, I'm referring to abortion, through you know, terrible foreign policy, embroiling us in countless foreign wars, which resulted in the death of especially young American men, especially the strong young American men, the ones that were willing to go and fight for their country, by consistently, you know, appealing to Marxism, communism, LGBTQ isms, all of that sort of stuff, they threw a lot of that in the trash. And now we have to claw our way back to being a good country again. And so I think boiling it down to something incredibly simple, like protecting the innocent and punishing the wicked, is the best way we're gonna get back on track. Because everything can be answered by, well, is this either protecting the innocent or punishing the wicked? And if the answer is yes, it's it's good. If the answer is no, it's bad. And if it violates either of the other, if you're saying, well, I'm punishing the wicked, but by nature, whatever you're doing is not protecting the innocent, it's also punishing the innocent, then that's bad. You have to do both of those things. If you're violating either one, it's bad policy. And I think it's very obvious that SB4 does those things, that it is very clear that it is a good policy, that it is good law, and I'm very glad that the court, at minimum, has ended the injunction. It may not have been the win that I wanted, in the sense that I wanted to see them rule on the merits of the case so that we could always have the law. But bare minimum, it is a win enough that we're allowed to now apply the law. With that being said, when we get back from the right, speaking of immigration, we have a couple more things on that. We'll get to John Cornyn in a minute. In the next segment, before we get to any of the John Cornyn stuff, going over that advertisement and how it kind of got taken really off-air. You cannot find it anymore. Uh what we'll talk about first is a big update in this MS-13 case. If you guys don't know, MS-13, gang members, um Salvadorian, obviously, because Venezuela, you have uh what, Trend Airaqua? Salvador, you've got MS-13. El Salvador, you got MS-13. And so you have a group of Salvadorian men who last year admitted to being members of MS-13. Uh we actually covered that, and they were part of this violent conspiracy that resulted in murders in multiple states. Well, eight of those men have now been sentenced uh for those Houston area murders. We'll talk about that sentence when we get back. If you'd like to text in, the number is 713-779-5978. MS-13 Sentencing In Houston Murders
SPEAKER_16Welcome back, ladies and gentlemen. I'm your host, Michael Wilson, and you're listening to the Lone Star Conservative. Now, a group of Salvadoran men who last year, again, admitted to being members of MS-13 and participating in a violent conspiracy resulted in murders, by the way, in multiple states, have now been sentenced. How many names can you have? I mean, I know people that have no middle names. So they're just, you know, first name, last name. Plenty of Americans. Just for whatever reason, skip their middle name. You've also got plenty of people who have the typical three names, right? You got I'm not gonna say my full name because then I'm gonna, I know. I know we're gonna have a listener come up to me when I say something I shouldn't say, and they're gonna use my full name. Um but you have first, middle, last. It's pretty easy. Once you get into Angel, Miguel, Darkie, Aguilar, Ocho, like eight names, what are we doing? Uh, you also have Wilson Jose Discreto Ventura Meja and Walter Chicas Garcia, who all received identical sentences. Martinez Rodriguez was a gang leader who oversaw MS-13 members in multiple states and helped direct drug proceeds raised by the gang overseas, according to the Justice Department. He also proved the April 2018 killing of Naile Guzman, a 14-year-old girl who the gang believed was cooperating with law enforcement, and whose body was found in a shallow grave near Sims Bayou in Southwest Houston. Justice Department leaders said the punishment sent a message to gang members in a statement announced in the sentences quote, today's sentences send a clear message, those who carry out violence for transnational criminal organizations will be held accountable no matter where the orders come from. These defendants used brutality to advance within their criminal enterprise, and now they face the consequences. For other gang members, uh that would be Marlon Miranda Morin, Luis Ernesto Carvajal Perraza, Wilman Inquieto, Rivas Guido, and Carlos Alexei Garcia Gangora received sentences ranging from 35 to 45 years in connection with the conspiracy, according to court records. The men were among eleven defendants in a racketeering case that started all the way back four years ago in 2022, uh, where you had uh an indictment that were that were, you know, uh and really that was when the indictment started, but that had been playing out since like 2018, when you had uh the first arrest case of of 20 MS-13 members here in Houston uh and associates of those people in connection with a series of violent crimes at that at that point. Prosecutors said the men acted under the banner of MS-13 uh to gain power, reputation, territory. They make money through murder, extortion, drug trafficking, robbery, all the stuff that you'd, of course, want to bring into your country, all the stuff that leftist protesters are willing to die to protect, right? Drug trafficking, murder, uh uh, you know, child predatorism, all those sorts of things that are very good. Very it's just diversity, guys. Come on. Why are we bullying them? Why why you know what? I'm being racist. For pointing out that they're coming from a third world nation that does not appreciate the this sort of American values we hold, for pointing out that they are murderers, rapists, and drug traffickers. Definitionally, I'm apparently a racist. So my bad for for saying that, it just so happens to be true, and I just so happen to not care about being called mean names. Uh, nevertheless, again, this is the sort of stuff that we're bringing into our country. This is the sort of stuff that is here, and I'm not saying that every illegal immigrant or every immigrant in general is automatically evil or automatically, you know, violent. What I am saying is that every single one of them is automatically broken the law. And so, in my dealings with a person who's willing to break the law, if they're willing to break one and they're willing to justify that, usually they're the kind of person who, principally speaking, is willing to justify breaking the law. Right? That's just kind of how it goes. And so if they're offered money to do other things, if if you know what whatever it is, it's usually not a good sign if your very first act of coming here was to break the law to get here. That maybe you don't respect American law. Just just naturally by nature of and and I understand you're willing to justify it. Well, I need to provide better for my family. Well, where I'm coming from is dangerous. Well, I don't like the play. I understand all of that. And I you know what? I can't really relate because I was blessed to be born an American. That that's how it works. But what you do what you don't get to do is break the law in an attempt to get a better life for yourself. Right? Because I could do the same thing. I could I could argue, hey, I I was born in a middle class. I I wanted to be upper class. I I wanted to be rich. So I broke into a rich person's house and decided to live there. You know what's gonna happen to me? I'm gonna go to jail. That's that's what's gonna happen. Burglary or whatever the charges end up being, depending on what sort of violence I use. That's what's gonna happen to me. Because you don't get to break into someone's house just because you want to have a better life. You can do everything you can to make a better life. You can work very hard and have better opportunities, sure. But the the cards that you're dealt, those are your cards. You don't have to like them, you don't have to love them. What you don't get to do is cheat by getting new cards. That's what you don't get to do. And that's what every single legal immigrant has done. Every single one has broken a law. That's how it works. Even the ones that, you know, you could argue, well, the law they broke wasn't so severe. They just over they just overstayed their visa. Yeah, is that a is that a law that we have? Yes, it is. Did they break it? Yes, they did. So they're criminals. Yes, they are. It's it's fairly straightforward. It's really
Prison Costs And Capital Punishment
SPEAKER_16not difficult to understand. And it it it's incredibly frustrating, by the way. I just want to highlight this before we move on. The 50 years in prison is is very much frustrating to me. You guys know how I feel about prison, and it's not because I'm a crazy radical leftist who hates prison and thinks that prison is bad. It's because I think that prison is wildly unsuccessful and not harsh enough. I'm what what I'm I'm so far right that if you hear my opinion, sometimes they sound left, right? But for a very different reason. Leftists went in prison because they're too harsh. I mean, they're like, oh no, prisons are bad. No, no, that's not nice. We need better rehabilitation. We we need rehabilitation facilities, not prisons. And I say, I agree we need no prisons because we need to be using the noose way more often, or have like a flogging post in the middle of the town square uh and make people work again. That's you know, but but dead serious, it's very frustrating because these men are involved in murders, drug trafficking, Lord knows what else, that they actually weren't even indicted on because we didn't know about it. And our response is that the American experience, you have eight of them, right? And and let's say all eight of them average it out about fifty years w was was the average. Fifty years multiplied by what's the cost per person. Does anyone know what the cost per person per year is in the state of Texas? It's about 33 grand. Okay. You multiply 50 years by the eight people who are serving, we are gonna spend over 13 million dollars housing these men who are killing people, stealing from people, bringing drugs in and killing people another way. Right? Why are these men not getting the death penalty? They are here illegally, they are gang members, they are violent, and they've why are we wh are we gonna spend thirteen million dollars to give them a place to live for the next 50 years? It doesn't make any sense at all. It it is actually insane and and anti-American to spend my money, $13 million of it, supporting the lifestyle of these men who who have broken into my country and and killed my fellow countrymen. It is it is antithetical to everything American. Rope is cheap. Even in this economy, rope is pretty affordable. So are blades. So are you know what? Ammo's expensive these days. I get it. I understand that ammo is not as cheap as it once was. Still a lot cheaper than $13 million to have a firing squad. Right. I you can pick pick your poison. You can do firing squad, you can do lethal injection is dumb because it it is actually quite expensive because of the anesthesiologist. It's it's a waste of money. But we have death by hanging, death by guillotine, death by firing squad. Pick your poison. All of them are cheap comparatively to $13 million for these amen. And they're more just. And I just don't understand why we're dedicated to because the only argument for prison has always been rehabilitation. Not only does that not work, but even if you assumed it worked, you don't want these men ever out again. You don't want these men back rehabilitated into the country. So what's the point in giving them prison? They've murdered, they've they've hurt, and you don't want them in society ever again. But we're gonna put them in prison and spend tens of millions of dollars. Makes perfect sense. With that being said, after this, after this break, we'll get to it. The story. John Cornyn and his 2020 campaign ad. We'll go over all of it after the break. And then when we come back, after that, of course, to wrap up the first hour of the show, we'll have the weather. But in the next segment, we'll talk all about John Cornyn, that ad, why it was taken off the air. Think you know why. All of that when we get back. If you would like to text in, as always, and you can do this if you have something that you want to see me report on, if you have a disagreement with something that I've said, you have some questions about something that I've said or something that I didn't say, et cetera. The number is 713-779-5978. That is 713-779-KYST. I'm your host, Michael Wilson. You're listening to the Lone Star Conservative. And I'll return with John Cornyn and his 2020 ad. After the break, so stick around. We'll talk soon.

SPEAKER_03The Medicare Minute with Justin White is brought to you by Senior Health Services.
SPEAKER_07If you are of Medicare age or getting close or you have a loved one that is, be careful with those unsolicited phone calls that I know you know about. We get told about them all the time. What you need to know is that many of those phone calls are not even legal. They're coming from offshore call centers. Sometimes they're calling regardless of whether you're on the do not call list. Isn't that nice of them, by the way? It's really sweet of them to just do that because they are thinking that they can't get caught. Bottom line is when you get on there and you talk to them, they're already kind of operating sidelong of what should be done. And sometimes people end up in plans that they did not intend to enroll in. And so what do you do? Call somebody local. If you got a local agent, my gosh, call them and get in front of them. And if you don't have a good agent, think of an organization like Senior Health Services where you can sit down, talk about what you're looking for, and get the help that you need. You don't need to be talking to phone operators in other countries that you don't know who they are, where they are, or what in the world they're doing.

Cornyn DACA Ad Resurfaces
SPEAKER_16A resurfaced 2020 campaign ad shows U.S. Senator John Cornyn promoting his support for the legalization of dreamers, a message that has since been removed, of course, from his YouTube channel. In the Spanish language advertisement, a narrator proclaims that while Cornyn supports secure borders, he firmly supports the legalization of dreamers. The video, which was previously available on his official YouTube channel, was quickly removed after it started circulating on social media. Created by Executive Action under President Barack Obama in 2012, the deferred action for childhood arrivals, the DACA program, allows certain individuals brought to the United States illegally as children, known as dreamers, to remain in the country and shields them from deportation. It says, well, you didn't have any act, right? You didn't have any anything to do with the crime that was committed. Therefore, you can't be punished for the crime. Which some people assume makes a little bit of semblance of sense. Sure. But there are some crimes that that, sure, you shouldn't be punished for, but that you might be receiving benefits from the crime that you shouldn't be receiving. I'll give you an example of this before we kind of move on through this story. If you know you have a son, imagine, and you want your son to have great things. So you go and you rob a bank and and and they don't know where the money went. They catch you one day and they say, Well, you robbed the bank, they they throw you in jail. Ten years down the line, they find out that the money went to your son. It was eight million dollars. He's now got a growing empire, you know, he's doing well for himself. He's made that eight million into 15 million, and he doubled his money through whatever business ventures or whatever else. And they come and they say, actually, we have to take your stuff away. And he goes, No, no, no, no, no, but this is my money. I built this. No, actually, you're you built it on fraud. That money is theft, that's not your money. And that's not fun. That's that's not great. No one feels good about doing that. But was it his it wasn't his money. It was it was stolen. And whether or not he was the thief doesn't change that he doesn't get to keep stolen money. That's a good analogy for understanding the DACA program. I get it. You didn't commit the crime. So I don't think you should ever be put in jail or spoken ill of for being here. But you're now experiencing the benefits of something that was stolen. That the slot you got in college, the job that you got, those things are stolen from an American. And it's it's not cool that we allow you to continue stealing and keeping stuff that was stolen on the mere basis that you aren't the one who originally stole it. Right? Nevertheless, the the program has been challenged by not only Donald Trump, but also Attorney General Ken Paxton, who both argued that it's unconstitutional. The U.S. Supreme Court ultimately blocked the Trump administration's ruling. Uh in a it was a five to four ruling, I believe. So it was it was one of those split decisions, very close to the margins. The messaging aligns with the comments that Cornyn made on the Senate floor in 2020 regarding recipients of the DACA program. He said DACA recipients must have a permanent legislative solution. They deserve nothing less. We need to take action and pass legislation that will unequivocally allow these young men and women to stay in the only home in this in the only country they've ever known. Okay. Correct also described the uncertainty surrounding their status as terrifying and said said that many recipients have built careers and families in the United States. Quote, these young people deserve better. The Senator further noted he had been working with advocacy groups and stakeholders, including the Texas Hispanic Chambers of Commerce, Lulac, and Catholic bishops, to find a long-term solution. He said, I'm willing to work with anyone, Republican or Democrat, who's interested in solving the problem. You also have Brandon Gill, uh, who, of course, has sharply criticized Cornyn once again following this sort of come-up of the ad. He said, John Cornyn released an ad in Spanish pra promoting his support for amnesty. Apparently forgot that we represent American citizens, not illegal aliens. This is absolutely disqualifying. I want my country back, and I'm sick of swampy politicians in Washington who are dying to give it away. In response, we also have a senior advisor to John Cornyn. He said, Paxon and his allies are attacking Senator Cornyn for supporting President Trump's Secure and Succeed Act, which would have ended the visa lottery and reform chain migration. Senator Cornyn has consistently supported all border security efforts and earned the Endorsement of the National Border Patrol Council. Now you might have noticed, maybe it was just me, uh, that he did not say anything about the actual thing he was being called out for. We weren't calling him out for what he supported recently. We weren't calling him out for any endorsements or lack thereof. We were calling him out, or whoever it was, because he appeared to have supported Amnesty for Illegal Aliens, which whether or not you also support Amnesty doesn't change anything. That's what we're calling him out for. And he doesn't appear to have participated in that conversation at all. He doesn't appear to have defended himself, defended his record, nothing. He said he just points to other things he's done that he believes are good as some sort of excuse for the behavior where you run a Spanish advertisement in as an American politician where you justify granting amnesty to illegal aliens. And I get it, the DACA program is difficult for a lot of people. I have a lot of friends who I would regularly consider pretty conservative, who think the DACA program is good. And I think that's a disagreement we can have and a debate we can have, and we should have. Uh my position does not change. I think that justice is absolute, and I don't think that you you you pawn it off, or that you pause it, or that you loophole it because you like certain people, or because you think that you know certain policies are not nice or unfair, or they don't deserve it. That's not how justice works. And I understand that somebody else committed the crime. I get that. But they're experiencing the benefits that are punishing everyday Americans. And and I think it's a fair conversation to have that you still you shouldn't be here either. Just because you've been here a long time, just because you got away with the crime for a certain number of years, at 18 years old, you became responsible for committing the crime that your parents committed when they brought you here. And you decided to keep you you decided that you were now gonna continue to commit it by remaining here illegally. That's your choice, and you should face the punishment for that. With that being said, to wrap up the first hour of the show, when we get back, of course, we're gonna have the upcoming weather report. If you have any questions, thoughts, concerns, feel free to text in at any point during the show. The number is 713-779-5978. That is 713-779-KYST. I'm your host, Michael Wilson. You are listening to the Lone Star Conservative. And I'll return with the weather report right after this short break. So stick around, hang tight, and we'll talk very soon.

Houston Heat And Humidity Outlook
SPEAKER_16Temperatures alone are not going to tell the full story. Rising humidity is going to push fuels-like temperatures well into the 90s, uh, with little relief even at night. The big question is how uncomfortable are we going to get? And and is this it? Are we kind of just done? Is it just going to be hot from here on out? Now, for several days, the answer is pretty simple. It's going to be sticky, sweaty, you can't really get away from it. Like today is going to start really a run of warm, humid days across the entire Southeast Texas region. Highs are going to climb into the upper 80s to around 90 degrees, but again, it's going to feel hotter thanks to the moisture from the Gulf that's surging inland. Heat index values, what it actually feels like outside, is going to reach into the low to mid-90s by the afternoon. Skies are going to stay partly cloudy, uh, and while there could be a stray storm here or there, most areas are going to stay dry. The bigger story is how quickly the heat and humidity build throughout the day. By tomorrow and Wednesday, Houston is going to get locked into this sort of very consistent muggy pattern. A high pressure system to the south is going to keep moisture in place, keeping humidity levels high and consistent. Afternoon hides are going to try stay right around 90 degrees. But again, no relief and the consistent humidity is going to make it feel warmer than 90 degrees. Even after sunset, temperatures will only drop into the mid-70s, which means that those nights are not going to offer a nice cool break from what's going on. So the pattern is going to shift toward the end of the week. By Thursday into Friday, a stronger system and cold front are going to approach Texas, uh, could bring some showers, and it will bring a drop in humidity. Temperatures ahead of the front will still push the upper 80s, but drier air is going to change it, especially when it comes to temperatures. I'm looking right now, and the weather, for the most part, appears to look pretty nice with highs back down in the 70s potentially again. With that being said, that'll do it for the weather report for the day. At the top of the next hour, we're going to have Justin White from Senior Health Services coming on for Medicare Monday. Stick around for that interview. We always answer very pertinent questions. So what's going on in the Medicare industry? In the meantime, you are listening to Lone Star Conservative, text in 713-779-5978. I'm your host, Michael Wilson, I'll be right back with Justin White at the top of the next hour.
SPEAKER_10From deep in the heart of Texas, it's Houston's God-loving patriot, the voice of reason. This is the Lone Star Conservative, Michael Wilson.
Medicare Monday Talks AI Tools
SPEAKER_16Well, welcome back, ladies and gentlemen. I'm your host, Michael Wilson, and you're listening to the Lone Star Conservative. And on the air with us, joining us this morning as we do at 7 o'clock for Medicare Monday is Justin White from Senior Health Services. Welcome to the show, Justin. Hey, good morning. Glad to be here as always. Of course, glad to have you here. I want to get off for today, jumping a little bit into a conversation surrounding tools. And this is going to be a fun conversation to have because I've talked on my show pretty frequently about how tools are inanimate objects that we use for a specific purpose. And unfortunately, one of the big tools that's out there right now that I think people have started treating less like a tool and more like a person has been what is colloquially called artificial intelligence, AI, which it's not like they make it out to be in the movies where it really is conscious and it's like iRobot. It's not, it's not like that, at least not yet, right? It's not humanoid yet. Uh, but it is, it is very advanced computing systems uh that have a lot of good uses and a lot of bad ones. Can you kind of walk us through, especially in terms of like industries that you're in, how we see AI more and more frequently becoming used as a tool and what that looks like?
SPEAKER_06Sure. Um, yeah, absolutely. I mean, I in fact I was at a conference this week in Vegas, and uh we talked a lot about that. A lot of the presenters, the people that are the vendors, I should say, uh, were talking about artificial intelligence uh AI tools uh that they were using, and it just and it just it just permeates everything. And we use AI, obviously, but we we use it to hold our systems and you know to compute different things and stuff like that. We're not putting them on the phone with our clients or anything like that. But I think if the things get more and more busy, um, and uh the economy flows and and just things kind of floating or read takes over, which we all know happens with big companies, um, I think we're gonna start being employed more and more and and some of it will make sense, some of it will be very inappropriate ahead of its time, like in my opinion, AI customer service. It'll be you know, where they're just clearly trying to save money and just delay or whatever it is that they're trying to do, and we end up with something somehow substandard, but more importantly, does not have that human empathy, that human touch. And we're we're gonna avoid that as long as possible.
SPEAKER_16Right, no, absolutely. And I think it's it's pretty wild to me because you know, and and I grew up in a generation, right? By the end that I was growing up, phones were very common, not you know, cell phones, smartphones, you know, kind of especially going through teenage formative years, that was very common. And I remember people saying, like, this is so dangerous, uh, they can't get the phones out of the hands. And I remember as a kid, I would always think this is so dumb. And then I got older and I went, no, that was right. That was actually a really bad idea to have a phone all access all the time was not so great. And and so I started asking, one of the big things that I've asked recently has been, is progress always good? Or does it depend on what we're trying to get to? And my big concern, Justin, with AI in in Medicare or any other industry is what is the ultimate benefit, even if we can get it to a point where it isn't subpar to have customer service run through an AI, how does that benefit the customer? How does that benefit the worker? How does that benefit anybody in the country when you could just have human connection and talk to each other?
SPEAKER_06Right. Well, communication is is going to a low end right now with a lot of folks. And again, on the Medicare and customer service, I mean, you know, the extent to which these AI things misunderstand you or hang up on you on accident or whatever it is. Yeah, and what it is, it's just the inconsiderate nature of the management of the company, of the board of directors saying basically, yeah, we're gonna replace all these people with robotics because it's cheaper for us, and they're just not ready for prime time yet. You know, that's that's the issue that I get, it's just not ready for prime time. But you know, but I think there's lots of really, really good things about AI when you can actually have conversations with it about things that you're truly interested in, and it's remarkable insight, but it does not replace people. And there is a place where there's gotta be a debate between what's good for us in terms of you know how important is a profit margin over the needs, just the communicative needs of a population or people generally, and and what about making sure that there's things for people to do? Right. You know what I mean? It's just crazy.
SPEAKER_16Yeah, no, and these are all conversations that we're gonna have to have, um, especially when we look at industries where, you know, uh I mean, Medicare, I'm sure, uh, as as somebody who works in the industry, you know, where people are especially vulnerable, uh, people are especially, you know, needing assistance from other people who care about them, right? And that's one reason why we've talked about, you know, what senior services does differently than a lot of other companies. One of the big things is the fact that you guys are local and actually do care about people in a different way than a lot of these these companies do. That also I think plays into the conversation. A robot can't, like we'll never be able to care about you in the way that a human being can. And that's one thing that senior services is above the mark on is hey, we we do actively care about you as our as our customer, somebody that that works with us, we care about you. Um and right.
SPEAKER_06No, absolutely. You know, and and here's the one of the scary things for me is that yeah, we do care. And and we care because we're humans. Um AI right now still sounds robotic. It has no real way to empathize, but as it gets better, one of the big problems that I have with AI is the way they have them talk to people is they're pretending to be human.
SPEAKER_16Yes.
SPEAKER_06And I have no doubt that at some point, probably in the very near future, they're gonna create AI that's gonna be smart enough where it will be it will have an algorithm somehow to pretend empathy that will eventually feel real. And at the end of the day, you're you're still dealing with a cheap substitute, a computer bank in a vault in a room somewhere, pretending to be human, and you're on there, you know, or the people are on there listening to it, feeling like, oh, I've got the real deal here. And it's just a big game, it's just a big act. And that's that's the thing that bothers me. I'm glad when they say I'm the virtual assistant as opposed to getting on there and trying to make it fool everybody into thinking they're a person, and that's that's another part of the debate there as well. But yeah, it's it's just coming, and like I said, we're gonna we're gonna use it, but use it on things internally, but we still believe very much in getting that human-to-human contact where we can discuss and then use AI as a backstop, a backdrop to give us information to make sure that we're accurate. But I think that's I think that's a pretty nice little hybrid mix of using both uh resources.
SPEAKER_16Right, and I get it. There's the conversation, right? I remember when the internet was first becoming popular when you had Google, and people said, Oh man, this is gonna be bad, you know, people aren't gonna have to go read books anymore. And there are a lot of, you know, people, my dad grew up in a time where the the teacher would say, you have to learn all of this because you'll never have a calculator that you can just take anywhere with you. And it's like, well, everybody does now. It's it's a very simple app on your phone. It's one of many. And so I understand that there are beneficial uses for the tool, right? AI is great at a lot of things. Uh, but if you want to maintain that human touch, then, ladies and gentlemen, to our listeners, you got to go check out Senior Health Services. You can go to senior health services.com or give them a call for a totally free consultation with a human being at 281-894-7540. Justin, as always, we appreciate you giving us your time on Monday mornings. Uh, we always love the conversations we get to have, always something very different every week. Uh, it's very exciting. And Lord willing, we'll talk to you again next week.
SPEAKER_06Absolutely. Thank you, Michael. Thank you to all your listeners, and you guys have a great and blessed week. And uh, as you always say, God willing,
AI Should Not Fake Humanity
SPEAKER_06we'll talk next.
SPEAKER_16God willing, we'll talk next week. With that being said, ladies and gentlemen, one more time. And and here's the thing with AI, and I've said this before, I'll say it again. Progress is not always inherently good. I know that is a controversial phrase for me to utter, but progress is not always good. And he mentioned a phrase there that I actually really liked. He tells he called it a cheap substitute. Because what humanity is attempting to do, uh, and and there's there's lots of conversations about this, what humanity is attempting to do through AI right now can have a lot of beneficial uses, a lot of things that it's good for. But this intentionality behind trying to make it human, that that seems to be the goal is let's create a human, uh, seems uh so so like we're trying to play God here uh that I think it is incredibly concerning. And and to what end? Because the end goal of any tool should be to make the process simpler, easier, and better. How does the process get simpler, easier, and better by trying to feign what God made? How does that help anybody it doesn't? Is it is it great to have virtual assistants? Sure. There are lots of things. AI is is way ahead of the curve on a lot of things. People that are using it are way ahead of the curve on lots of things uh in terms of using it as a tool. People that are able to use it for programming, people that are able to use it for engineering, people that are able to use it for mathematics, people that are able to use it for research, editorializing, right? If you guys remember the first original days of Grammarly, this is like Grammarly on steroids, where you can have a paper that you've written out that you got a first draft, and you can have it do so much, so much editing uh that you you can replace a team of editors with it. I mean, there are a lot of really good tools that it's very good at doing. There are also things that it should never do, even if it became good at them. Faking humanity, faking human connection is a terrible idea. I remember when the first advertisement came out. If you need a friend, check out this AI. And it was, I I immediately saw it and thought dystopia. I I immediately saw it and thought this has to be one of those one of those crazy, insane novels that dives into a post-dystopian world where nobody cares about anybody else anymore because all we care about is robots. I I I mean, it really does start to look like that. Now, I don't think that's ever gonna happen. Um I actually do think that God is sovereign. Uh, and it kind of reminds me of the Tower of Babel a bit. I I do think that we're gonna reach a point where we realize, okay, we actually can't replace human nature and human culture. We actually can't replace humanity with robots. It actually doesn't work. There are things they can do and things they can't. Uh, and things like customer service. And I've said this before, I feel pretty safe in my job. I don't think you're ever gonna get a robot that's gonna speak to you in such a way that you can hear and feel the passion. I've said the same thing about movies, books. You can tell. I think you'll always be able to tell when AI is involved and to what degree it's involved, because you can feel human nature. You can feel that. It's something that we have that God's given us in communication and politics and everything else. We understand humanity. And senior health services also gets that. They believe that that humans should talk with humans. And there are lots of good tools that AI is good at. There are lots of good things that AI does in terms of internal work, research, all that sort of stuff, programming, etc. And there are things that humans should do. And customer service, speaking with one another, that's one of those things that humans should do. So if you're looking to speak to a human, especially a local human that knows what you're going through, give them a call at 281-894-7540. One more time. That is 281-894-7540. With that being said, let's go ahead and jump into our next story before the break. Uh,
Teacher Hoax And Hiring Blind Spots
SPEAKER_16and that is just a little bit of background in Splendora because you had that high school teacher. You might remember she was accused of this hoax where she cut herself and then tried to blame a student. The school went into lockdown. She tried to get this, it appears like get this student in trouble was the was the design of this hoax that she just completely made up. We don't we still don't, I don't think, know like what kind of malintent she had towards the student, what she'd gotten into with this student. But that was that was what happened. Now, uh documents are coming out. Apparently, she had a documented history of disciplinary issues, complaints at a previous district. Nicole Trulove, she was arrested earlier this month, charged with filing a false report and tampering with evidence after investigators said she cut herself, blamed a student, and activated a panic alarm, prompting, of course, a large law enforcement response. The Montgomery County Sheriff's Office said the April incident at Splendor High School began when she activated a wearable alarm, triggering a lockdown and drawing more than eighty law enforcement officials to the campus. Investigators later determined no student assault had occurred, and there was no ongoing threat to the school. Now, records obtained via an open record request from her previous employer that was Cold Spring Oakhurst CISD show multiple incidents involving student complaints, administrative leave, and informal reprimands before her resignation of that district in May of 2025. So back in March of 2022, district leaders in her last district placed her on a professional growth plan, citing concerns about classroom management and professionalism. The documents state that she grabbed a student by his arm in order to keep him from walking away from her. In March of 2025, a student reported that TrueLove grabbed her face to force eye contact. The student wrote, At some point I realized she was standing behind me. Without warning, she grabbed my face, squeezing it together to force me to look up at her. I resisted and pulled her hands off, but she put them back on smooshing my face again. In a written response, included in the records, True Love said she placed her hands on the student's cheeks to get her attention and apologized for her actions. She said, I have no idea that I embarrassed her. Additional students described physical contact, including being slapped on the head or touched to regain focus. One student whose name was redacted said she slapped me upside the head like once to motivate me from the back. She did caress on the head, it was bad. Other students told administrators' behavior appeared joking or not intended to cause harm. Yes, I've seen Mrs. True Love squeeze, hit, or slap someone, however I feel it is a joking matter, and not purposely trying to hurt someone. I think the issue is when someone says, okay, don't hit me, she doesn't understand no. Following the incident in March of last year, the district placed her on administrative leave with pay. Semmer record says she was placed on paid administrative leave in 2023 after an incident involving racist language in the classroom. A letter from a principal states a recording captured her denying and then admitted then admitting to using a racial slur while speaking with students. In October of last year, the district issued a formal reprimand after multiple students reported that she told them to intentionally perform poorly on a beginning of year assessment. The rubber man states the district determined the testing data had been manipulated and ruled her ineligible for incentive compensation for that school year. Additional documents cite concerned about attendance and prior reassignment in the district. The records also showed she disputed some allegations, writing in one response that claims against her were false hearsay that could not be substantiated. In April of last year, the superintendent notified her he recommended that her contract not be renewed in the best interest of the district. She submitted a handwritten resignation the same day, effective at the end of the school year. Splendor ISD said it checks the state's do not hire registry as part of its hiring process, and that true love was not listed. A district spokesman said officials were not aware of the full scope of her prior disciplinary records. And by the way, this coming from William Rhodes, the Splendora ISD Executive Director of Human Resources, he said Splendora ISD follows established hiring protocols in accordance with state law and district procedures. As part of our standard process, we verify an applicant certification to the State Board for Educator certification to ensure there are no active sanctions or reprimands, conduct reference checks, including recent supervisors and screen Texans and screen candidates through the Texas Do Not Hire Registry. We were not aware of any disciplinary records. Meanwhile, uh the attorney representing Cold Spring Oakhurst CISD said we were in the process of providing the documents to the TEA regarding this educator, as is the long-standing custom and practice of our district. Meanwhile, the Texas Education Agency has opened an investigation, and the criminal case in this particular instance remains ongoing. She's bonded out of jail and resigned from her position within Splendora ISD. But I think this highlights that we need significantly different standards for our teachers. I understand there are things that you might miss. Things will be imperfect. And I'm not saying that we throw the baby out with the bathwater and say, well, if we can't get it perfect, then we can't hire any teachers. Not my claim at all. But the issue is if you have a teacher that has been reprimanded numerous times, that has basically been forced to resignation, have been placed on administrative leave, in the the the contact of multiple different investigations, there is a very real conversation to be had that that person, through whatever process we use, should be flagged as a you probably shouldn't hire this person, even if they're not on the specific registry that you searched. That those disciplinary records should be public, they should be accessible. And whether you blame Cold Spring, you blame the state, or you blame Splendor, we I don't really care to place the blame on anybody. I I really could not care less where the blame actually falls. What I care about is fixing the issue, finding a solution. And whatever the solution is should make sure that the teachers that you're hiring in any district have not been the subject of numerous disciplinary records, have not been the subject of numerous investigations, issues, reprimands, and firings. And when you add all those things together with her additional history of arrests for theft in former years, I think the the end result, the conclusion that we must reach is there is no world where this woman should have been hired as a teacher in this district. And not that we could have foreseen the particular crime that was committed coming, not that we could have said, hey, this was just bound to happen, right? You can't know that. But it was very obvious that this person, this, this m this this this woman was not an above-par teacher who should have been brought into the district. That is very clearly the case. And whatever we're using as our basis for background checks and making sure that things are are above board was very unsuccessful and very clearly going to be unsuccessful based on the metrics we applied. And we should have higher standards for the people that we hire. With that being said, when we get back from the break, we're gonna talk about the DOJ because they've now dropped the defense of a Biden-era gun rule that Texas fought against. Attorney General Ken Paxton argued that this rule undermined the Second Amendment by criminalizing private gun sales. We'll talk about this update coming out from this from the DOJ, what the defense rule was, all that sort of stuff when we get back from the break. DOJ Drops Defense Of ATF Rule
SPEAKER_16Welcome back, ladies and gentlemen. I'm your host, Michael Wilson, and you're listening to the Lone Star Conservative. Attorney General Ken Paxton is touting a major win for gun owners after the Trump administration, the Trump Department of Justice, backed off defending a Biden-era rule that targeted private firearm sales. Now, the move leaves in place a court injunction that blocks enforcement of the regulation in Texas and other states while litigation continues. The Bureau of Alcohol, Tobacco, and Firearms, we all love those guys, engaged in the business rule pushed under the Biden administration, which sought to dramatically expand who counts as a dealer under federal law. By redefining the term dealer, the rule would have forced many ordinary gun owners who occasionally sell firearms to obtain a federal license and run background checks or risk civil and criminal penalties. Now, Second Amendment advocates and multiple states, right? You had numerous states on the lawsuit, argued the rule effectively created backdoor universal background checks, criminalizing private noncommercial transactions that Congress has historically protected. They also warned that the policy flipped the presumption of innocence, presuming that gun owners were engaged in the business unless they could prove otherwise. In other words, instead of presuming that you weren't engaged in the business, giving you the benefit of the doubt, it automatically assumed that you were the presumption of guilt. In May of 2024, Paxson led a multi-state coalition suing the Biden administration and the ATF over the rule, arguing that it exceeded the agency's authority and violated the Second Amendment. Soon after, a federal judge issued a temporary restraining order, followed by a preliminary injunction blocking enforcement of the regulation against Texas and other plaintiffs. The court found the rule likely unlawful, noting that it shifted the burden onto gun owners to prove innocence rather than the government prove guilt and could penalize conduct that had been legal just days before. Now, may I remind everyone that these sorts of lawsuits, these sorts of cases are not free, they are actually quite expensive. That that making sure that our policies are good, that they are in line with the Constitution, and that they are protecting those who are automatically deserving of protection, aka the people, the citizens, that that takes time, effort, dedication, and resources. It it takes a fight, which takes a village. And one of the main people, one of the main groups leading these sorts of lawsuits, leading these sorts of fights is our sponsor, Gun Owners of America. Gun Owners of America is consistently at the forefront of all these sorts of lawsuits, but they do more than just sue the government. Right? That is an important facet, by the way. If you're not willing to go to bat uh when there is an unconstitutional ordinance or an unconstitutional rule or an unconstitutional law, then you're worthless. But that can't be the only thing that you do. It also requires campaigning, making sure that people who are elected to any position are going to defend your rights. It also requires lobbying those people. It also requires making sure that once they're actually in the office, that they are held accountable to what they said they'd get done on the campaign trail, making sure that your rights are defended through whatever bills are pushed forward, and making sure that the unconstitutional ones are never there to be sued in the first place. And if they are, that they are sued adequately. And that requires your support. You can go to gun uh G Oahuston.com. That is G-O-Ahouston.com to become a member. It is an annual membership. It's not monthly, it's not by it's it's annual, and it is twenty-five dollars per year. Twenty-five dollars. I mean, you do the math out, that's it's like a little over two dollars a month for you to be a part of the fight to guarantee that our rights are defended and protected. Again, that is G-O-Ahouston.com. That is the only way we're gonna continue to see lawsuits like this win, play out, and make sure that your rights are defended. To continue this, there has been a significant development in this case. Uh this month, the U.S. Department of Justice asked the Fifth Circuit Court of Appeals to dismiss its own appeal of the injunction of the case known as Texas VATF. That retreat effectively cements the existing protections for gun owners in the plaintiff states, leaving the Biden era rule sidelined while the underlying lawsuit proceeds. And so Chris McNutt, president of Texas Gun Rights, said this is pretty phenomenal. He came out and he said, This is exactly what happens when the federal government's gun control schemes are dragged into the light. They collapse. This rule was never about public safety, it was about building a system to monitor and control lawful gun owners, and the DOJ knows it and can't defend it. Gunners of America, you guys know them, uh, they also called the DOJ's move a surrender that leaves the ATF rule politically and legally isolated in federal court. With the current administration no longer actively defending the regulation, Paxton and other plaintiffs now have a clearer path to seek, broad relief, which is incredibly important to making sure we win this case outright. Including, by the way, a nationwide injunction uh to basically fully vacate the rule. Paxton is, of course, uh crediting the change to President Donald Trump and his new administration, which has moved to abandon the position and drop the appeal in general, meaning that, of course, this still has to play out in court, but we now have the basis we need to actually win it. He said, the Second Amendment is a cornerstone of American freedom, and I will never allow it to be undermined by unlawful federal overreach. He argued that backing off the appeal restores the rule of law for gun owners across the country and sends a signal that federal agencies cannot rewrite gun statutes to criminalize law abiding Americans. For now, gun owners in Texas and other plaintiff states remain shielded from the ATF's expanded dealer definition while the case continues in federal court. Private non-commercial gun sales between individuals covered by the injunction can continue under prior law without the sweeping new licensing and background check requirements contained in the binaro rule, meaning that if you are a private citizen who would like to sell your firearm, you don't have to undergo all the processes that a dealer would have to, which, by the way, again, is an absolutely insane rule. We can all see how unconstitutional it is. We all see that it is another attempt at gun control. That is so very clearly what it is. They do this all the time, where they know they're not going to win outright saying we're gonna ban guns. Right? You can't do that in a single day. It requires step by step, policy by policy, miniature move by miniature move, until you get to a point where you say, effectively, we've banned the sale of guns. That that is the end goal, by the way, of all of this communist propaganda. That's the end goal, is an unarmed population, a defenseless population that cannot stand up to the whims of a tyrannical government. And I've said this for a long time. You know, you can call it a cliche, and maybe it is, but it is for a reason that the Second Amendment does protect all the rest. That's that's where our rights are enforced. That is the the only basis by which we have to protect our other rights. That we the people can stand up to tyranny and abuse coming from every sphere of government from local to federal. That the Second Amendment protects that. That's our right to defend ourselves from tyranny. That's why a government that desires more and more power is constrained and feels constrained by the Second Amendment and why they're constantly attacking it. Because there's no way for them to do a lot of the things they want to do if they have an armed population willing to stand up against them. And so what's the what's the easiest way to fix the problem? Well, to make sure you don't have an armed population that can stand up to you. And they'll do that through loopholes like buyback programs, they'll do that through criminalizing people who are trying to just sell their firearm to a friend. They will do that through a myriad of policies, even down to things like red flag laws. And I know people who who in Texas may not realize this because we don't have red flag laws. We've basically criminalized red flag laws. But red flag laws are incredibly dangerous, not just because you know, they they use real non-evidence as their evidence, but because of the injunction it creates. I don't know if you guys know this, but in places where you have red flag laws, one of the consistent problems is that people who are accused, right, because the red flag laws look work often on a on a use case by case basis where someone reports you until it's been sought out, until you've won the charges against you. It really is presumption of guilt. Until you've won it, you're not allowed to own a firearm. Until you've been approved to, once you've been reported as as some sort of danger. And sometimes that can happen in a week. You get approved, they say, nope, you're you're good, you're clean. Sometimes it can take years that you're not allowed to lawfully own a firearm in that state until you've been proven innocent. It is legitimate insanity. And we have to stand up to all these policies that are loophole backdoors to a violation of our God-given rights to keep and bear arms, which shall not be infringed. With that being said, in the next segment, we're going to come back and talk about the this former Sweeney volunteer fire chief who has been arrested and now, by the way, indicted on charges related to child sex crimes. Victims came forward after two Sweeney firefighters, including a suspect's son, were charged in separate cases involving children. We'll talk more about the details of the case when we get back. SPEAKER_07If you are of Medicare AIDS or getting close or you have a loved one that is, be careful with those unsolicited phone calls that I know you know about. You don't need to be talking to phone operators from other countries that you don't know who they are, where they are, or what in the world they're doing.

Fire Chief Indicted In Child Sex Case
SPEAKER_16Records show that former Sweeney volunteer fire chief Tim Webb Sr. has been arrested and formally indicted on multiple child sex crime charges. Authorities confirmed that he was booked in the Vrozoria County jail. And again, this kind of happened over the weekend. I believe he was booked into the jail on Saturday. Webb Sr. faces two counts of aggravated sexual assault of a child, two counts of sexual assault of a child, one count of sexual assault, and one count of prohibited sexual contact. Webb senior was removed from his role as the fire chief back in February. At the time, the departure was presented as a leave of absence, and no further details were released by the department. However, the Sweeney police chief confirmed there was an active criminal investigation involving Webb Sr. Court records indicate the alleged incidents date back to 2000, 2001, and 2004. On Sunday, Sweeney Mayor Dusty Hopkins said that Webb Sr.'s case came under investigation after two other members of the Sweeney Fire Department, including Webb Sr.'s son, were arrested on charges of sex crimes against minors. Law enforcement has not confirmed a direct connection between the charges and the cases involving the other firefighters, but officials say the broader investigation remains active and ongoing. Now, Webb Sr.'s arrest comes at the Sweeney Fire Department and is already under intense scrutiny following the arrest of his son, Timothy Webb Jr. Webb Jr., also a former fire chief with Sweeney Fire Department, is facing multiple felony charges in a separate but related child exploitation case. Webb senior is facing thirteen total charges involving five different children. Those charges, again, we've already gone over what they include, but again, four counts related to prostitution of a child. Investigators said some of the abuse involved forcing minors to engage in explicit acts on video in exchange for money with incidents reported between August of twenty twenty three and August of twenty twenty-five. Another former Sweden Fire Department firefighter, Coleman Pollock, was also arrested and charged in separate crimes related to the investigation. Authorities Webb allege that Pollock and Webb Jr. were neighbors, and our investigators are kind of looking into whether the two men may have exchanged explicit images involving victims, you know, bit 'cause it does definitely, you know, raise suspicion when you have two men in the same small town in the same fire department who are next door neighbors who are both charged with very similar crimes. You kind of gotta wonder, was there some sort of conspiracy going on that involved multiple people in the exact same case, even if they may have been different incidents and different victims? One thing that I want to say, that actually I have a couple things. The first I want to address is the importance of fathers. A lot of people don't recognize this. You know the old statement, say as I do, or do as I say, not as I do, right? One of the most nefarious sentences ever ever uttered by mankind. Do as I say, not as I do. Children, by the way, don't learn how to live life that way. Nine point nine nine nine times out of ten, children are going to do as you do, not do as you say. And nothing, no amount of discipline is going to change that. Right? We have discipline for a reason, but the number one influence that you can have on your children is the way that you live your life. And it just so happens that when you have fathers who are doing evil, disgusting, heinous things, you'll often find that rubs off very heavily on children because of how they're influenced. Even if you try to keep it hidden, you keep it boiled down, you say, Well, they don't know about it, this, that, whatever whatever excuses people tell themselves to get away with it and and and try to keep their family out of it, your children are going to be influenced by the kind of person that you are. And when you have fathers who are committing heinous, disgusting, perverted crimes, it follows that you have children who are raised to see those things in a different light. Who are raised ultimately where they end up committing very similar crimes. Even if those crimes are not inherently connected, even if the father never approached his son about the things he was doing. Even when you have cases where they're they're completely disconnected, they it happens that it's a son and a father, but they didn't know that each other was doing the same thing that the other was doing. It happens all the time. Do you know why? Because God created fathers to ultimately be the leaders in the home. And when you you lead by example, and when your leadership involves this sort of pervertedness, this sort of perversion, it just so happens, not coincidentally, that your children fall into many of the same traps that you did. And they do the same disgusting evil things that you did. And and of course, we don't deny on this show personal responsibility, but we also don't deny that you influence other people. Do I have the personal responsibility for what I say? Yes. And does every listener who listens to the show have personal responsibility and moral culpability for the things they say? Absolutely. Right? But at the same time, I have a platform. I have a place that I speak out. And I have people who rely on me to do that, who trust the things I'm saying. If they go and they repeat my talking points, are they ultimately responsible because they took it at face value? Yes, they are. That's why I tell people to critically think through everything that I say. Think through it yourself. Come to your own conclusions. Don't just take my but but I have a level of extra responsibility because of my position. Because people listen to me. God has given me a a specific level of responsibility that differs from other people in that regard because I know that I'm influencing people. And that that gives you a level of responsibility. Same as every father on the face of the planet has extra responsibility to raise their children in the fear and the admonition of the Lord. The other thing I want to say is what we do now, uh, because obviously there should be very high standards for people that we have in positions of any sort of authority. Um, but but in a case like this, when you look at the sort of horrendous nature of the crimes that were allegedly committed, there is only one punishment that makes sense, and it is not prison, and it is not restitution, and it is not it is not any of those things. Sure, should there be a level of restitution? Absolutely, to the victims, for sure. I have no problem with that. But the ultimate goal of justice is to be just. And you know what's what is just to someone who has harmed children, who has touched children, who has manipulated and coerced children into doing disgusting, perverted things. Death. It is the death penalty. It is capital punishment. And as I said earlier in the show, I don't particularly care what methodology we use to achieve that end. Right? I I can be swayed one way or the other. If you say we want to do firing a squad, I say have at it. If you say, well, we want to go back to public square hangings, totally fine with me. If you say, no, actually, I think the guillotine is the cheapest, most effective option, sure. I'm totally down for a head in a basket. Whatever methodology you want to use, I'm good with. So long as the end result is that the person is given the death penalty for the crimes they've committed. And when it comes to the sexual abuse of children, if there is any crime on the face of the planet that deserves capital punishment, it is the sexual abuse of children. Every single person involved in that sort of crime deserves to be put to death as quickly as possible, pending the outcome of due process. We have to we have to achieve that first. We don't have presumption of guilt. We just went over why that's very dangerous in our Second Amendment segment. It is very crucial that we have due process in place. But should these men be convicted of the crimes of which they are accused, should we go through the court, the jury system, and they're found guilty, they should be immediately the the next at sunrise the next the day following the end of the trial, they should be put to death. We should not wait a year for sentencing and then give them ten years in prison. No, no, no, no, no. It should be the death penalty the following day. That that's what I have to say on this case. And a reminder to fathers that what you do has uh inarguably more impact than what you say. And you should be very wary, especially if you're a father, as to how you act, how you behave. Even when you think that you're hiding the things that you're doing, you're not. You will be found out. Your sin will find you out, that's how it works. And your children will see it and they will follow your example. That's how it works almost every single time. With that being said, when we get back from the break to wrap up the show today, first day of the week, we're going to talk about Texas providing new transparency on educator misconduct. Uh, improved reporting by the state board for educator certification was prompted by the TEA's new inspector general for educator misconduct. We'll talk all about what that looks like after the break. As always, if you would like to text in, the number is 713-779-5978. That is 713-779-KYST. I'm your host, Michael Wilson. New Transparency On Educator Misconduct
SPEAKER_16So, for the first time, disciplinary action reports documenting Texas educators' misconduct include key information about the school employees being sanctioned, including the nature of the allegations against them and where they worked. Very important for the story we covered with Splendor ISD just a couple segments ago. The State Board for Educator Certification has published reports of final actions taken against Texas educators' teaching certificates for years. Prior reports provided minimal useful information to the public. An infographic created by Advocacy Group Texas Education 911 explained a lot of the improvements. Before this, the State Board of Educator Conduct reports listed only the educator's name, the date they were disciplined, and the sanction imposed on their certificate, which could be anything from a reprimand to a permanent revocation. Texas Education 911 noted we had no idea what they got in trouble for or where they worked. After these changes were made, the quarterly disciplinary action report lists the school district where the educator worked at the time of the misconduct, the allegation code indicating the nature of the complaint, the length of the imposed sanction, and whether the educator was added to the state's do not hire registry. Now, parents and the public can search to see if any SBEC certified employees in their local school districts have ever been sanctioned for misconduct. Also importantly, the school district itself can see that information because I remember hearing that they were complaining because they didn't know it wasn't on their list. Well, now you have a list. For example, a search of the latest report covering September to November of 2025 shows four Allen ISD educators sanctioned for misconduct. Two were charged with in-school violence, one was reprimanded, and one permanently surrendered her teaching certificate. Two others received one year suspensions of their certifications, one for an improper relationship with a student, and one for failing to report allegations to CPS or law enforcement. The newly reformatted reports reflect a renewed commitment to transparency within the TEA since the appointment of Levi Fuller as the state's first inspector general for educator misconduct, a position newly created by the Tex Education Commissioner Mike Morris and filled by Fuller just a couple months ago starting in February. And so while the the SBEC, the state board, and the TEA, the Text Education Agency, are technically separate entities, they often work together to implement the state's regulations regarding teacher certification, standards, and discipline. And so it's very good that we have more transparency, more open availability, and more knowledge pertaining to these things. Because issues like what happened in Splendor ISD should not be happening. They should be incredibly rare, very uncommon. And the only way you get there, as I've highlighted since the day we launched this show, is by exposing the works of darkness, by being aware of what's happened and holding people accountable. And that
