A lot of politics is downstream from culture, and we start there on Star Wars Day with a deceptively simple question: why do the stories that stick usually keep a clean line between good and evil? We talk about what happens when modern entertainment tries to blur moral reality, why audiences can feel the “message” coming, and why objective truth still shows up in the best storytelling.
Then we shift into Texas news you can actually use. We break down Attorney General Ken Paxton’s appeal tied to the Epic City development fight and what a temporary injunction means for the next steps, the agencies involved, and the broader legal strategy. Star Wars And Moral Clarity

SPEAKER_11Welcome back, ladies and gentlemen. I'm your host, Michael Wilson, and you're listening to the Lone Star Conservative. We have made it to another week. Here we are. By the way, today is actually a holiday, if you did not know. It's only a holiday for nerds. So if you're not a nerd, I don't think you're actually allowed to celebrate. I I don't know how they determine that. I don't know what the technical terminology is. How they what are the eligibility guidelines for being nerdy enough to tell it's right today's holiday? I couldn't tell you. But it is a holiday, and that holiday is may the fourth be with you, uh, which is like how you say may the fourth be with you. If you had a lisp, may the fourth be with you. Of course, it's like Star Wars Day. Um and so you know, I grew up on Star Wars and yet another uh group of movies. We don't talk about, by the way, all the sequels that came out over the in the past ten years. If the Star Wars came out in the past ten years, we probably shouldn't really talk about it. It's not very good. Before that, both the original trilogy um made decades ago and and the early 2000s prequels that went over the story of, of course, Anakin Skywalker, all of that was considered good. Episodes one, two, three, four, five, and six. In my book, those are all the Star Wars films that exist. Some of the TV shows were also pretty good, but in terms of Star Wars movies, we just pretend that seven, eight, and nine are not real. I guess when they start making more Star Wars movies, which of course they'll do, they have another Star Wars uh about like one of the bounty hunters coming out later this month. And next year they're slated to do an actual Star Wars film again. And so I'm sure they'll have to play into the the sequels that they made. But seven, eight, and nine, we just pretend it doesn't exist. I say all of this, one, because it's of course it's the holiday, but two, because yet again, it's an example of a show where I think it's very evident, and it should be that in these films there is and it's so funny because writers can't help but do this, and when they don't do this, this thing I'm about to explain. When a writer in an attempt to preach postmodern liberalism, in an attempt to teach progressive ideology, doesn't do this one thing in their books, it's so blatantly obvious that they're doing it in an attempt to convince you of liberal ideology. It turns into a preachy novel if you don't do this one thing. And what is that one thing? What is the one thing that all writers do unless they're making a genuine attempt to avoid the truth? Well, I can tell you what it is. It is that there is a very clear dichotomy between good and evil. There there is there is good and there is bad. And by the way, you don't actually even need a villain to do that. You can have a character arc. I was talking the other day about uh I I'll bring it up again, the movie that's still in theaters, by the way. And if you haven't seen it, I genuinely recommend you go check it out in theaters. It's one of those movies that it's gonna be cool no matter where you see it, but if you have the opportunity to see it in a movie theater, I think that's gonna be the best experience. Project Help Mary with Ryan Gosling, such a phenomenal movie. I just had another friend that went and saw it for the first time this weekend who also said, I can't believe I didn't see it sooner, incredible movie. That's been everything I've heard from all of my friends that I've sent to go see it. But in that film, I don't want to I don't want to give spoilers, but this isn't really a spoiler. There's no actual villain in the movie, and yet there is still a clear dichotomy of good and of evil, of what it means to be good. And so today on Star Wars Day, I just wanted to take a moment and highlight that George Lucas, in both the original trilogy and then in the prequels, there is so very clearly good and evil. And of course, through the prequels, you get into how and actually I think it's quite beautiful, because in the original trilogy, of course, it's it's the whole I am your father, that's when you first find out. Spoiler alert. I don't know, it's been out for 50 years. I don't feel like that can be a spoiler. Uh when you find out that Luke's father is Darth Vader, you know, of course, that starts presenting questions. When you get into the prequels, you know, uh uh thir twenty twenty years later, and you start finding out the backstory of Anakin Skywalker who would become Darth Vader. Not trying to nerd out here, but I think it's important. When you find all this stuff out, what when you when you come to grips with that, it actually makes it even more beautiful. Because I think it it really dives into how evil is not something far away, right? Even though the whole thing takes place far away. Evil is not something that someone just is. I think it highlights very beautifully that people have the potential to be evil. And because of the grace of God, we also have the potential to be good. And that's why you can see this played out through the force, and you can see Anakin, later would be Darth Vader, you can see his path, you can see the track he's on, you can see the trajectory as he's listening to evil people in his life, as he's being convinced of of of into sin and into power. And I mean it really is Star Wars is phenomenal in its own right. Uh, but yet again, you can tell that some of the best movies of all time are ultimately pictures of truth. And by the way, some of the worst movies of all time are movies where the liberals wanted to pretend as though morality was not objective. Imagine a Star Wars that said, oh, you know what we need, morality is really kind of subjective. So really Darth Vader could be the good guy. I know that he just slaughtered a village of women and children, uh, but he could also be good. No, it's so obvious that that is inherently evil. Everyone understands it. That's when you start clicking, okay, Anna's Anakin's a bad guy, right? But all these all these new things they want to preach to you. They want to pretend like, well, it's not so cut and dry. There's a new movie coming out. I don't know if it's this month or next month. It's called I Love Boosters. And it's this group of black women who are stealing from these designer clothing stores and then cutting the clothes, changing them, redesigning them uh to resell them, essentially, as their own items. And the movie essentially justifies it because these black women say, uh, you know, when when the lady confronts them, you're stealing. You're stealing from my stores. And they go, just like you're stealing our ideas. And they start justifying theft because, well, the white lady's the bad guy who really she's enslaved everybody. That's that's what it is. And so you're justified in doing these evil acts of theft, because that's how the world works. You do something bad, so I can do something bad. And that's why I have a feeling I love boosters, it's probably not gonna make very much money. Because nobody wants to be preached to like that. We all know that theft is bad. I don't need an anti-racism movie to come in and justify these black women committing crimes, actually. And by the way, I also don't need to justify it because I happen to also believe that there are plenty of evil people out there who do steal ideas. IP theft is real. I do happen to believe that that's also evil. I do happen to believe that when you have this sort of oligarchial consumerism where you have massive corporations that are putting so much money into elections, I also think that can be really dangerous. I'm not denying that. But when you start preaching that sort of stuff in a movie, instead of just saying, hey, there's good and there's bad, and the good guy's supposed to beat the bad guy, a tale as old as time that works every time you do it. Again, every good movie, name name a good movie that doesn't have a good and a bad and a clear difference. I mean, even the movies that that you know, you start rooting for the bad guy, you still acknowledge they're the bad guy and you know why, and the movie's just trying to be, you know, genius and how it presents that that sort of difference. Anyways, we're getting a little off track. I just wanted to kick it off this morning saying that all of the best stories, all of the greatest, not just films, but the greatest books are all pointing back ultimately to the objective truth of the Bible. The the one story that is actually true. The one thing that all the left would have you believe is a myth, that atheists would tell you is just a bedtime story, the the book that is the Bible, compiled of more than one book, uh, but but that is the holy scriptures, where it is contained the truth of not only our history, uh, but the truth of the gospel. And all of the greatest books and the greatest movies and the greatest plays, all of them ultimately, in one way or another, are doing their darndest to point back to the Bible, even when they don't realize it. And the only way they don't do that again is if they're doing this intentional workaround so that they don't have to preach the Bible. Because they they know it, they can see it. Right? When they when they read a story and they see the good guy defeating the darkness, right? They know, they realize, oh man, you know what we're doing? We're we're we're clearly or when the good guy, you think he's dying, and then he comes back and you're like, Oh, I wonder where you got that idea. It's not like somebody did that already. Well, yeah, somebody did. That was Jesus Christ when he rose on the third day. And so on this day, Monday, the Star Wars day for May the 4th, I just want to remind everybody Star Wars is great. But Star Wars is great because it preaches the truth that we as Christians already know. And that's what films, by the way, are supposed to do. All art ultimately is supposed to point back to truth and to beauty. That's why the best ones do, the highest-rated ones do. The ones that come out and they get good ratings in the box office, they do. They ultimately preach a truth that a lot of people won't hear otherwise. And I think that's a great thing. That's why I've said that more Christians and more conservatives need to be involved in the cultural aspects of our country. It's really great that we're getting out and voting. It's absolutely phenomenal that we're knocking doors and that we're talking politics, and that we're convincing our friends and our neighbors uh and our brothers and sisters in Christ at church uh to vote and to vote for candidates that are going to pres that are going to ultimately, through their policies and what they lobby for, are going to continue pushing the truth of the gospel and of conservative values and traditional values. But at the end of the day, you also have to change hearts and minds. And that doesn't happen by just talking politics. I'm sorry, it doesn't. A lot of people have no interest talking politics. Many of them are not deeply involved in politics, and the ones that are are so brainwashed because of media that did the exact opposite of what things like Star Wars do. Because of films that justified evil, because of books that flipped the narrative on its head and tried to preach postmodern liberalism. And it's it's very dangerous, and it has convinced many, many people to abandon objective truth. And if we're gonna retake the country, I'm dead serious. There needs to be a reality where more Christians, more conservatives, are writing books. And I know it's tough to get into Hollywood as a Christian. I believe you me, I I do understand that. But there are alternative outlets to make films, make good films, to make movies, short films, taking to festivals, right? There are a million ways that conservatives can get involved in cultural changes. And those things are gonna need to start happening if we desire any sort of chance at winning this country back. If we want any sort of chance, and I don't just mean winning elections. Because if you can't tell, look around the country today and tell me if this country is a good place. It's not right now, despite the fact that we won the elections, even if we win the midterms next. Politicians don't change the country. They do change some of the policies. And I'm not denying that that's important, right? If we'd gotten Kamala Harrison, we probably would have had Roe v. Wade codified into law. We'd have far more abortions today, murder of unborn children. Well, that would obviously be worse than it is today. So yes, it is important that we win elections. But even winning elections does not change the dynamic of the people in the country. It fixes some of the problems, but not all of them. And if we're going to fix the other problems, which just so happens to also contribute to the times when we lose elections, it is crucial that we are participating in cultural conversations. Right? That means creating music, creating art, creating films, creating plays, writing books, all of these sort of outlets that people are engaged in. We have to do that. We have to. Because if we don't, you want to know what happens? What happens is what's happened where the left has become increasingly popular, where people are throwing away objective truth, where people are abandoning their ideals and people are being indoctrinated, often without even realizing it, because it's not straightforward. They're preaching it through books and through movies without outright saying it. And that's how so many, especially young people, have become convinced of these very untrue narratives. That's how it happened. And it didn't happen through just see it in, and it didn't just happen through getting bad politicians elected. Obama didn't get up on stage, and a bunch of young people just said, okay, I believe in socialism now. It's not what happened. The films, the books, the teachers, all of these cultural education, the curriculum, that's also cultural. All of the cultural side of things was thrown in their face to demean truth. And they bought it. Hook, line, and sinker. And of course they did, because that's what they were raised on. And so we have to raise our children better, and we have to start participating in the culture, just like we're participating in politics. And we need to start having people raised up who are interested in making movies, who are interested in writing books, who are interested in being involved on the art side of this conversation, who can start drawing people back over to the right in a way that isn't just politics, but in a way that is just truth. Now, now that I spent the whole, you know, now that I've spent the the entirety of the first segment discussing, oh, I don't know, Star Wars Day, uh, we'll jump over in the next segment and talk about uh our Attorney General Ken Paxton, who has now appealed uh this this case regarding the epic city development. If you remember, the judge actually ruled that Texas was supposed to allow the city development to kind of go on. Well, Paxton, uh his his most recent appeal has now halted that order. So as of now, Texas is not being forced uh to move it forward. It was it has now been a temporary injunction blocking that judge's ruling while this appeal case proceeds. Paxton Appeal And Epic City Fight
SPEAKER_11So now, Attorney General Ken Paxton has come out and has announced that the Texas Workforce Commission will not have to unlawfully review documents for the development of a controversial, and for good reason, Islamic community in North Texas following this appeal. Now, last week, you might remember that we had a ruling that we talked about here on the show over in Travis County by a Democrat judge in favor of the CCP and not the Chinese Communist Party, no, no, the Community Capital Partners, who is the they're they're the developers for the proposed epic city that they've renamed the Meadow. It's kind of confusing. Nevertheless, the ruling that the judge made, this Democrat judge, basically said that the Texas Workforce Commission had to re review the developer submitted plans. And decide whether they were going to approve or deny those plans. And if they were to deny them, they had to give legal reasons that were justifiable as to why they were denying the plans. All this by the fact that they reviewed other plans before, they didn't want to, despite the fact that there was a federal investigation ongoing of the community. None of that mattered. And so the CCP, the community capital partners, alleged that the Texas Workforce Commission, by refusing to review the new documents, it was illegal to refuse to review the plans for the community. And then by filing a complaint against the com the the community, the agency was essentially stalling, was the argument that they made. And so the Texas Workforce Commission came out and, along with our attorney general, immediately appealed the decision from this Democrat judge to the 15th Court of Appeals, which we mentioned they were going to do last week on the show. Now, Ken Baxton came out and he put on a statement. He said, following my appeal of the flawed ruling that would have required the Texas Workforce Commission to unlawfully approve fair housing documents for Epic, I am glad to see that the developers will not receive such services as this lawsuit is proceeding. Epic City developers have sought out any possible way to evade the law and further the development scheme. He said, I will be relentless in ensuring that any attempt by Epic City to move its development forward in violation of the law is stopped. And so, of course, on top of the fact that they have to get the Texas Workforce Commission to approve all their stuff, uh, they also have to have Collin and Hunt counties approve a lot, and both counties have thus far rejected plans submitted, uh, but just because the required applications are incomplete, not because they're trying to stop it from being a muscle enclave. And so, of course, as I frequently highlight, this story comes up. First of all, this is great news because it it keeps them one step further away from completing their plans. And I know that our attorney general, that our governor, and that a lot of people in our legislature have said, don't worry, this will never happen. But as of right now, it just seems to me, and we'll see about this, it just seems like it's a matter of time. I know that we that they they're the ones saying it's a stalling tactic. I think they're right, actually. I I don't think we have a solid plan at all to stop them. Nothing they're doing, from my understanding, is illegal. Other than minor things here and there, like, okay, your application is complete, incomplete. Uh okay, so your your MUD, your municipal utility district, you didn't do that right and you're not eligible to be on it. Okay, well, we'll find somebody else. These things may take even years. But if you don't change the law, and it's gonna be very difficult to change because the law that you actually have to change is something that even on the right is an incredibly controversial law. And that is this is gonna be, you know, one of those moments where you hear me say this, and of course it sounds like something I'd say, but it's something that's going to take a massive fight if we ever want to get back to this kind of country. A country that is for Christians, not for Muslims. I have a lot of friends who, you know, they're in the boat of people that say, well, you know, it's not all Muslims. It's just the crazy ones. Right. You know, there's a lot of good Muslims out there. And I always say, well, no, actually, because they're either Muslim or they're good. Those are the options. Pick door A, pick door B. They could be a non-practicing Muslim, in which case they shouldn't call themselves a Muslim. They, if they're a practicing Muslim, if they are actually, you know, the same as if I'm a practicing Christian, I believe if they're a practicing Muslim, then they want you subjugated to Sharia law. And they'll do basically anything they have to do to get that, because their religion is, of course, more important than their friendship with you. Because that's how it works. This this meadow, this epic city, the East Plato Islamic Center building a city, other than the original marketing materials, all of the new stuff is essentially in line with their legal rights. They're not reserving it for only Muslims, they're doing that in the results because of the way that their HOA is going to work, but they're allowed to do that, right? Christians could do the same thing, Hindus could do the same thing. The problem is that once you allow them to start loopholding this based on fair housing laws and based on HOA guidelines, they're going to continue growing. And you'll have no idea what's going on in that community. You won't know if Sharia law is being implemented. You won't know if they're having, you know, judges that are separate, because no one's gonna tell, no one's gonna say anything. And it's only gonna be Muslims in there, so of course you're not gonna hear about it. They're not gonna tattle on their own people. And so what's gonna have to happen with our laws? If we want stuff like this to stop, you can stall it all day long. But right now, they are rather protected by their by their rights. And the problem is that we have so misinterpreted our constitution that we believe those rights exist. They don't. You don't have a right to worship Allah in my country in a private community. I'm sorry. That was never granted. No, that's not what the founders intended or envisioned for this country. And I know, I know they were they were terrified of centralized federal tyranny. That's the large reason that we have a lot of the rights that are spelled out so very clearly in our constitution. Unfortunately, because we changed the dynamic of this country through it, it was really the biggest issue for us is immigration. I know I talk about it all the time. There's a reason that I talk about it all the time, because it is undeniably the largest issue facing our country. It is. Because we wouldn't even need to talk about how we're going to fix the Islamic issue. We wouldn't even need to talk about how we don't want our governor celebrating Diwali, the Hindu holiday. Those wouldn't even be conversations we'd have to approach if we hadn't mass immigrated freaks into our country. Right? That that wouldn't even need to be a conversation. Why did we do that? Now we're having to say, man, we're really gonna have to reinterpret the Constitution back to the it's gonna be a massive fight to fix the Islamic influence issue in our country before it's too late. And it's gonna probably require, I don't want to say a war, but some at least miniature conflicts between states and the government where states are saying, yeah, we're not following the judge's interpretation of the constitution anymore because it's not protecting us. That's no fun. That's not gonna be good, it's not gonna be easy. I'm not even sure it's gonna happen. But that's only required now because you have Muslims here, right? Which the founders never intended that you would do. They never, they never pictured that you would bring in what they would have called Mohammedans, pagans, into the country, especially not in mass amounts. I don't think they could have fathomed us doing that to ourselves, but we did. And now you combine mass immigration of foreign religions into our country, and you combine that with the court misinterpreting really the biggest one is the First Amendment in regards to what freedom of religion actually means. You combine those things and you know what you get? You get Muslims taking over your country. That's what you get. You you messed the constitution up and you mass immigrated a foreign religion, and now you're getting mass Islamic influence. Well, I tell you what, if you want to change that, if you want that to stop, there's a couple things that are gonna have to happen. One, we gotta stop bringing them in. No matter what you do with legality, if you keep bringing them in, they're gonna one day be a majority. That's just what's gonna happen, right? That's that's inevitable. And every day we're still bringing them in and we're justifying it because it's legal. That must stop. That needs to end now. I I I'm I'm I'm sick and tired of giving our country away to un to people who hate the ideology of our country, of our values, of Western history, our heritage and our beliefs, and throwing it and giving it away to them. All because of what? Exactly, because they're not benefiting us in literally any way. We're just handing it over. That needs to stop. We also need to stop pretending like the Constitution was ever intended to protect the worship of Muslims and Hindus and Buddhists, and and the list goes on and on and on. No, it was intended to protect Christians from certain denominational differences. You, as a Baptist, don't get to tell me, as a Reformed Baptist, how I'm required to worship. That that was the intent. That's literally it. That was the design of freedom of religion was that, you know, the federal government will never pick a denomination and use it as a battering ram to force everybody to follow that particular denomination's interpretation of scriptural doctrine. That was it. That was literally the purpose. And unfortunately, we've rewritten that as a no, the founders actually meant that if you believe in worshiping a demon monkey god, that you can come to our country and build those on the side of the highway. Absolutely not. That was certainly not the intent of the founders. And it's certainly not my intent to allow that to keep happening. By the end of my life, Lord willing, I'll have made a difference. I'll move the needle. And I'll I'll, of course, continue to raise up a generation that moves the needle further. And I hope everybody else does the same. We have to keep fighting in this because this will destroy American civilization. Take a look at how Europe's doing right now. I I'm still one of the people that holds out hope that I actually think Europe can come back. I think it's going to be incredibly difficult. But I actually do believe that Europe is not over yet. Maybe they will be. I I don't think they're gone yet. They're getting real close. They're teetering on the edge, I'll say. But I don't think that the that Europe is gone yet. And we aren't either. But if we don't get our ducks in a row and stop caring about, you know, this modern interpretation of the Constitution, and if we don't stop caring about being called racist because of our beliefs about immigration, we're not gonna get anywhere. And it's gonna keep getting worse, and that'll be the end of it. With that being said, in the next segment, we're gonna come back and talk about these new details that have been released by the FBI, specifically in regards to the allegations uh about the Chinese hack of the UTMB during the COVID-19 era. Uh back early in the pandemic, COVID-19 researchers, Chinese hacker. Um, and we'll talk kind of all about those new allegations, those new details. Um, and this came out in testimony from an FBI agent late, late last week. So we'll talk about it when we get back. FBI Details On UTMB Hack
SPEAKER_11Welcome back, ladies and gentlemen. I'm your host, Michael Wilson, and you're listening to the Lone Star Conservative, a Chinese man accused of hacking the University of Texas medical branch email accounts in search of COVID-19 vaccine research, made off with apparently 1.5 gigabytes of emails, according to an FBI agent testimony late last week. Zuzaway confirmed his haul in a text message to a Chinese intelligent official who is in who apparently back in February of 2020, again, really at the start of COVID, asked him if he had found anything juicy or good from his intrusion into the medical branch's computer network. And this is all coming out from uh FBI special agent Benjamin Hyman. Now, Zoo, Zaway, who's 34 years old, was arrested last year in Italy and charged with nine federal felonies, including wire fraud, intentional damage to a protected computer, aggravated identity theft, all these sorts of things. And he was extradited to the U.S. last week, which is where we kind of re-reported on, okay, he's here now. And now we're getting FBI testimony. Uh and so U.S. Magistrate Judge late last week, Richard Bennett, ordered Zoo held in custody until his trial, citing the high incentive for Zoo to try to flee if he were released on bond, because he knows that if he makes it back to China, he's totally safe. He won't ever face charges. He just can't ever leave his host country. So of course that would be the attempt, right? If if you were being held in Mexico and you knew if you made it to the U.S., you made it back home, they would never extradite you. What would you what would you do if they gave you a bond? Well, you would do anything in your power to find a way to get across the border. That that would be what you'd do. And so they're saying they're not gonna let him go. Now, during the detention hearing, uh, you have the special agent Benjamin Hyman, who repeated much of the information that was revealed last year when Zhu was initially arrested. He and another man, Zhang Yu, were accused of hacking together into U.S. institutions at behest of the Shanghai State Security Bureau, uh, which is apparently like the Chinese equivalent of the CIA. So imagine the CIA, but with China men running it. Uh and apparently they were in search of COVID-19 treatment information back in the early days of the pandemic, finding out what the U.S. knew. And, you know, you're never really going to know what all they were searching for. Were they trying to search for COVID-19 research information because they needed help designing a vaccine? Were they trying to be the first to produce a vaccine for economic reasons? Maybe. Maybe they were trying to find out what the U.S. knew in terms of gain-of-function research. Because if we were designing a vaccine, we might know a whole lot about the virus itself and be able to tell that this certainly did not come from a bat in the market, right? There's no telling what all they were trying to find in these hacks. Right. And there's no telling that maybe even this particular hacker had no clue what they actually wanted to find. He was just supposed to deliver all the email messages, all that sort of stuff. I mean, this is the Chinese equivalent of the CIA after all. And how many times did the CIA lie in an attempt to get information that they would never have told you they actually won it, of course. So I'm sure China is no different. And so, you know, uh UTMB, which is located on the east end of Galveston, is home to some of the nation's top infectious disease researchers, right? Which is everyone is kind of aware of that. And so Zoo is believed to have used the credentials of the medical branch's IT administrator to gain access to the institution's virtual private network and continue to access emails. Now, authorities have not said yet, as of now, which researchers were targeted, but it previously said the targets included three virologists or immunologists. This is also, by the way, where the felony charge of aggravated identity theft comes from. They're also accused of acting into systems at a university in North Carolina and another university in the state of Texas. Now, in the case of the UTMB hack, the men are accused of using a vulnerability to read memory fields and then steal the administrators' credentials. FBI agents in Houston and Philadelphia were able to track Zoo down through an IP address, which was traced to a piece of code downloaded from a uh uh an organization called GitHub. Investigators subpoenaed that company to get access to email addresses associated with the accounts that downloaded the code and then used that information to locate an Apple account tied to the same email. That's how they tracked this guy down. That's when they found this guy's family photos, chats with his wife, alongside messages from February of 2020, 20. 20, 20, 20, February of 2020 about the hacks. So obviously connecting on none of the IP address stuff, they directly connected this guy back to the attacks. And so all this is going on. And so then you had the FBI director, Cash Patel, who went to Italy in order to kind of solidify this extradition from Italy back to the U.S. We finally get that taken care of. We bring him into Houston last week. He goes before a judge, the judge says he can't let him leave. And we get some testimony from the FBI about what went on, about what happened, right, and what he's specifically going to be charged with. And this is kind of where it was very obvious, right, um, that you know, we we can't let him go back to China, we can't let him leave prison. He's gonna be held until trial. He clearly did it. We have both the IP address, we have the Apple account photos, right? It all I think lines up very clearly. I think it's a very clear case the FBI has to make and the prosecutors are gonna have to make using FBI testimony. And so uh one thing that I'm actually not quite sure about, uh that I that I am wondering, um which which essentially is whether what what the sentencing guidelines are gonna look like. Because of course, you also have uh the the uh I'll say you have the defense attorney which is is coming in and saying, Oh, he's not actually guilty. Like here's a quote uh from the defense attorney the idea that some guy in a sophisticated hacking exercise is going to use his own phone, his own email address. Give me a break. I got my grandson, he knows how to spoof. I just think that's ridiculous. So the defense attorney is intensely saying, I know you got his IP address. I know that the Apple account has messages not only of his wife, not only of his family, and pictures of himself, but there are literally messages in his Apple account regarding the hack in 2020. He talked about it, and you're saying this ain't the guy because he'd be smart enough not to do that? I mean, it's so clear. Man, you think that a hacker would do that? Not usually, but if but I but he did. So what do you mean? No, he shouldn't have. That was pretty dumb. I agree. I could he probably shouldn't have done that, but he did. It's pretty obvious he did. And so we'll find out what the allegations uh you know ultimately say and and how it all goes and how the trial plays out. I actually also don't know not only what the sentencing is, but when the trial is actually slated to start. Nevertheless, he will remain in custody until that trial does begin and conclude. Southeast Texas Weather Outlook
SPEAKER_11Kicking it off, storm chances are ramping up again this week, bringing another opportunity, of course, for beneficial rain as drought conditions continue to ease across the state. Before that, we're gonna have a return to warmer, more humid conditions that's gonna take hold early in the week, with rain chances increasing by midweek as we have a more active pattern developed. Now, after a pleasant weekend that featured slightly below normal temperatures and comfortable humidity levels, it's gonna feel uh, let's say more like late spring this week. Uh, we're gonna start slightly warmer than recent mornings with lows in the 50s and 60s inland and lower 70s along the coast. Onshore flow is gonna bring gulf moisture back into the area, which is going to increase cloud covering the other day. It's also going to, of course, change the feels-like temperatures. That means that even though after nitrogen expected to reach the upper 70s, it might feel closer to the 80s. A brief shower, too, cannot be ruled out, though most areas today are going to stay dry. Tomorrow is going to follow a very similar pattern, warm, mostly quiet. Morning lows are only going to fall into the mid-sixties to lower 70s under, again, mostly cloudy skies, before we're going to have some partial clearing in the afternoon, allowing highs to climb into the upper eighties. Rain channels are going to remain low during tomorrow, but are expected to increase overnight tomorrow night as the next weather system approaches. Now let's talk a little bit about that. Rain and storm channels are going to increase Wednesday as a more dynamic setup is going to take shape. A dry line pushing in from central Texas combined with a cold front approaching from the north is going to help trigger showers and thunderstorms across Southeast Texas through the day and into the night. Forecast models are showing deep moisture and increasing instability in place, which are creating the sort of I'll say conditions that you need to support these sort of active organized storms. Some storms could become strong to severe. The Storm Prediction Center has placed much of Southeast much of Southeast Texas, especially areas in the long and north of I-10, as a level two out of five risk for severe weather on Wednesday. As it's still several days out, of course the details could change. It's day after tomorrow. Even that's still pretty far out for weather prediction, so it could change drastically. Now a shift in the pattern is going to arrive late in the week as a cold front moves in through southeast Texas on Thursday. In its wake, we're going to have slightly drier air, slightly breezy conditions, with temperatures easing from the mid to upper eighties early in the week to the lower eighties. Just a minor break, which is not exactly going to last very long, by the way. By this weekend, by Friday especially, ontour flows could return, bringing moisture back into the region, allowing humidity, and by extension, temperatures to climb again. Rain chances are expected to increase into the weekend as we have additional disturbances moving to the area with the potential for more widespread rainfall late in the weekend. That continued pattern of periodic rain, including potential storms, has already helped improve drought conditions, as we were mentioning earlier. In late March, we were experiencing severe to extreme drought. By now, those conditions have eased with more area shifting into moderate drought or just abnormally dry. And so hopefully that continues the trajectory so that we're not abnormally dry and we're just back to normal. That's of course everyone's preference. But with that being said, that'll do it for the first hour of the show. When we get back from the break, we're having Medicare Monday. That means Justin White from Senior Health Services will be coming on to talk all about Medicare, what's going on, newest updates, all that sort of stuff. We'll talk about it when we get back. Medicare Food Card Bait And Switch
SPEAKER_11Well, welcome back, ladies and gentlemen. I'm your host, Michael Wilson. You're listening to the Lone Star Conservative. It is Monday morning, specifically Medicare Monday morning. That means our good friend Justin White from Senior Health Service is going to be joining us on the air. Welcome to the show, Justin. Hey, good morning, everybody. Great to be here, Michael. Appreciate it. Of course. And I'm very excited because today we're going to talk about something very important that's going to combine a couple of different topics from the importance of character, the importance of the company that you do business with, and the importance of paying attention and of making sure that you are informed as to what you're eligible for. Yes. And so all of that. Let's kick it off talking a little bit about this commercial that you kind of told me about as we were getting ready for this segment. What's happening with this commercial about food cards? What's going on?
SPEAKER_04Well, yeah, I mean, it's the it's the usual thing. I mean, it's the latest one. Everybody that's listening to this, if pays any attention to this at all, has already heard it. It's a female voice and she's not on the screen, but she gets up there and talks about, oh, you need to get your food card because you deserve it. And call in because somebody's gonna get your money if you don't, and implying stuff like that. And it's uh, you know, for what it is, I mean, honestly, you gotta give credit where credit's due. Um, I think it's actually a pretty effective commercial. Um, but nevertheless, it's uh kind of misleading. And it's uh it's one of those things where people call in under one circumstance and end up in another one. And uh so I just thought we'd talk about and pick that apart a little bit this morning.
SPEAKER_11Right, absolutely. And I just want to say, just as a fun analogy, it's not an exact one-to-one because no one qualifies for this. But if I went on a commercial and said, you you could get, if you set up a Medicare with us right now, you could get a million dollars. And uh that'd be pretty effective at getting people to call in, but it would also be, I think, a little bit dishonest, to say the least. And so I was gonna say Yeah, I don't I'm not sure anybody qualifies if you're on Medicare for a million dollars. Uh, but I I wanna I want to talk a little bit about uh the dishonesty here. Uh you mentioned to their credit it works, but can we talk a little bit about who's actually eligible? Because you mentioned by being in one situation and then finding yourself in another one. Who's actually eligible and are most people calling eligible? What does that kind of look like?
SPEAKER_04Well, they're calling everyone, and uh, and most of the time, those food cards, especially the one when they say, Oh, I heard you can get several hundred dollars a month, and things like that. I mean, those are intended for people that are on Medicare and Medicaid, which is the low-income subsidy for health insurance and income and things like that. So it's it's just not something that the rank and file actually qualify for. But people here, and of course they're interested in that. And so they call up because they're sort of changing the calling up to make sure that they they don't miss their chance or whatever the fin text is, and then they end up going, oh, you know, the the subject and the topic gets changed really fast once a couple of questions is asked, is oh gosh, you don't qualify for that. Surprise, surprise. And then they basically it's a classic bait and switch, and then they're they're talking about something else and trying to just so they can change you to something.
SPEAKER_11Right. And one of the big things about cold calling that they teach you in in sales classes a lot of the time is the difficulty with cold calls are that the people are usually uninterested in what you're offering unless you have specific leads. Well, if people are calling you, even if it's for something they don't qualify for, you've now got somebody on the phone that at least you know is in your target audience uh and that is interested in talking to you. And so it is a classic bait and switch. Uh and I think it's very important because you mentioned that most people are not going to qualify for that. The people are aware, hey, you know, you need to call somebody uh that's gonna be honest with you and and that's not getting you in, even if it's good marketing, that's not getting you in uh with a level of I don't want to say manipulation, I want to throw those out there, but I I do want to say with a level of um not disingenuity. It's it's it's disingenuous at best.
SPEAKER_04Right. And Medicare has crack cracked down on some of that of late. Um, in fact, I was a little surprised when I saw that for the first time, and uh and you know, and I marveled at it a little bit. I was like, yeah, you know, let's kind of get several people to call, but it was it was just the same animal, and and we've already had to explain that many, many times about you know how it works. And and you know, and and if you're lifting up there and you do have Medicare and Medicaid to the state, then you might actually qualify for that benefit. And it's never the you know, oh it's 900 a month or whatever. No, it's nowhere near that. But it is a decent benefit and it does help people that actually qualify for it, but it's just a very free flipper, and I practice my alliterations this morning, a very free flipper of that tree of people that call in or actually anywhere in the ballpark of qualifying for that. And there are some food cards that are available for people that are not on Medicaid, but where the benefit is like very small. It might be, you know, it might be a few dollars a quarter or something like that, but it's not for the reason they're calling in, and you know, and that's what they want. They just want you on the phone. That's what they're doing.
SPEAKER_11Right, and I think that's another really good highlight uh for senior health services to say, look, and you said before, like, no matter who you call. And you said, you've been honest, you said, look, you don't have to call us, but you have to call somebody who's vetted and who cares about you. Um and I think I again I don't want to come out against other companies, but I do want to say, I think part of that is calling people who have the character to just be honest and say, look, you're probably not gonna qualify for this. I'm gonna be honest with you, I'm not gonna try to get you in here by saying things that are very clearly probably not the case for most people. I'm gonna tell you the truth as it is.
SPEAKER_04Right. And there's there's good agents out there, there's no doubt about it, but they're normally not they're not calling you illegally and things like that. You normally have to reach out to them, right? Is essentially how it works. But yeah, it's just a matter of just sitting down. There's enough people out there that have problems with drug costs to their doctor left the network, or they hate their plan, or the prices of their supplements going up a lot. I mean, there's plenty of way, way, plenty of problems out there when you're having to invent something, and then just you want them into something that's you know just for the sole purpose of making it fail. And unfortunately, there's a lot of that. You know, I had a guy that I talked to just the other day, and I'm just kidding, he owns a business and he said they get 50 to 100 calls per day. 50 to throwing away the highest number I've ever heard of. But he's still getting you. 50 to 100 a day. All I can do is just stare at him and say, I'm sorry, dude. I don't know. I mean, it's so bad that they're doing that. I mean, it's obviously not us because we don't we don't operate a phone room and never have, but the fact that people are having to deal with that kind of an onslaught just kind of illustrates the problem.
SPEAKER_11Right, absolutely. So I think it's important that people are given honest, honest and accurate representations. Because again, you mentioned there are enough problems, right? We've had you on the show for a while now uh on Mondays, Monday mornings at seven. And we've gone over a lot of them. Uh there are issues. I mean, even so basic as what kind of plan do you fit into? What are your costs going to be? What works best for your income and your level and what you need and what medication you you require, what your issues are. There are enough of there's enough of that. All the changes with how much reimbursement's get being given back, what that means for prices, there's enough of that without there being other issues of well, I thought I'd qualify for this thing. We don't have to throw that in there.
SPEAKER_04So for all Yeah, and that's I was just saying that's a good point, Michael, because the the problem the the problem that's out there, it's all confusion. It's all based in confusion. So that's the thing. Every there's enough confusion out there for everybody to share in. That's what these people are taking advantage of. They're calling and they're exacerbating the confusion so they get their toe in the door, and the ones the near duels go and they've got a they've got somebody that they can prey upon. But it's all it all starts with confusion, which unfortunately starts with Medicare itself, and the way that they allow things to be marketed and just the lack of intuitiveness that comes with government programs and plans and things like that. And then the people get in there and take advantage of it and cause problems.

Magnolia Mayor Lawsuits And Fallout
SPEAKER_11Specifically, uh, the mayor of Magnolia is now facing his third federal lawsuit related to the sexual assault and retaliation allegations. And so a third this third federal lawsuit's been filed, further intensifying this growing legal and we'll say political crisis that we've seen unfolding over the past several weeks. Originally a report on this a couple months ago, back before it was a lawsuit uh and just allegations from an individual. This newest lawsuit is coming from the city's former administrator, who alleges he was fired in retaliation for speaking out about claims that Math Mayor Matthew Danzer assaulted City Secretary Christian Gable during a work trip. The new filing, this new lawsuit, accuses city leadership of punishing him for raising concerns tied to the same allegations that are now at the center of both criminal charges and multiple civil cases. With three federal lawsuits now filed, a criminal case underway, and a new mayor preparing to take office, Magnolia, as a city is facing a pretty complex and and we'll say uncertain path uh forward in what's going on. And so again, the latest case marks the third federal lawsuit connected to Danzer in just over a month. You already had Christian Gable, the woman who was allegedly sexually assaulted, as well as the HR human resources director Christy Powell. They both file federal lawsuits alleging sexual harassment, retaliation, and failures by the city to properly investigate claims. Both of those women say that they faced consequences after reporting alleged misconduct. Gable has publicly described what she says was a pattern of inappropriate and escalating behavior that began after she started working at City Hall. She alleges repeated sexualized comments, including being referred to as the mayor's sexeter and claims the situation then escalated to physical issues instead of just, you know, sexual comments during a work conference back in October in Fort Worth. According to Ga Gable, the mayor allegedly attempted to pull down her pants in public, later grabbed her by the throat, pinning her against a structure outside a hotel while she was five months pregnant. And she says that surveillance video reviewed later by investigators captured that incident, which then eventually, after the city did not do their due dil diligence and just kind of let the whole thing go. Investigation by the Texas Rangers, which then the Texas Rangers started charging him an indictment including aggravated assault of a pregnant person, official oppression, and he was arrested on a warrant and later released on bond. Now he's denied all allegations, as as people do until they, you know, plead guilty or are caught or are or are found guilty, stating that he maintains his innocence and intends to defend himself throughout the legal process. Then also got his magnolia voters elected a new mayor, uh, which, by the way, does not resolve all the ongoing cases. I mean, he remains under criminal indictment, continues to face these multiple federal lawsuits, and city officials have previously indicated that removal from office would require either resignation, a court petition, or a criminal conviction. And the overlap between both the leadership transition and those active legal proceedings, I think leaves several questions that are unanswered for the city, including how incoming leadership is going to address those allegations, potential policy failures, because this is more than just the mayor did a bad thing. I I think it also includes, well, how did the city address it? Because the reality is you can't just blame the mayor for something. That would be an easy pawn off, move the monkey over here and then play us place all the blame on the person who did the crime. Sure. And he bears much of the blame. But where does the responsibility fall for the refusal to actively investigate? Of course, you want the Texas Rangers involved anyways, but why did we get to a point where the actual investigation only happened because of the Texas Rangers? Where was the city in doing their due diligence to ensure that people were safe and protected in those positions? Where was the rest of city leadership? Because it's not just the mayor, right? And especially once you have the HR director that's fired, once you have retaliation against allegedly the city administrator on top of the original crime committed, you have to wonder where was the rest of the city at? Wh where was the rest of the board? Where was the rest of the leadership in saying, you know what, this is a very important investigation that we need to actively conduct? Because it was merely thrown by the wayside to the point where we found out they just said, yep, we didn't find any this is he said, she said, he said, she said, so we're just gonna move on and do nothing about it. Uh and on the bright side, as a blessing, we had the Texas Rangers that did actively conduct an investigation and and found enough evidence to get an indictment. But the city had multiple failures. And so moving into new leadership, there will be not only a conversation about the mayor himself, but there will be a lot of conversations about city policy, how those investigations are conducted, uh, how to make sure, you know, there was surveillance footage that they didn't even look into that the Texas Rangers looked into. How is the city going to do a better job so this doesn't happen in the future, even if you have, God forbid, another really bad mayor, another mayor that is alleged to have done these sorts of horrible things. How is that going to be handled differently to make sure we don't have another case where the city doesn't do their job? All of that is part of a very big conversation, not just about Magnolia, but about city policy in general in other cities. Um, and so that'll continue to move forward. We'll talk more about who the new mayor is, policy changes, going into the investigations themselves, all the different criminal trials and civil cases, the federal lawsuits, and all of that as they continue to come out and as trials kind of move forward. In the meantime, when you get back from the break, we're gonna jump over, we're gonna talk about the Texas Supreme Court, who has now upheld a hemp-derived THC classification. Um, plaintiffs had conveniently interpreted the Texas hemp law to be a legalization of an artificially manufactured THC. Texas Court Upholds Delta 8 Ban
SPEAKER_11So Texas Supreme Court has upheld the state's classification of hemp-derived Delta VII THC as a Schedule I controlled substance. Hemp businesses and producers had been claiming that the scheduling undermined the intent of the legislature, but now the Supreme Court has said that's simply not the case. State had previously been enjoined from enforcing the classification by lower courts. Now, for some background, in 2019, the Texas legislature, in alignment with the Federal 2018 Farm Bill, passed the Texas Farm Bill, which essentially established the state's legal definition of hemp. This law, now called the Texas hemp law, established that it is the policy of Texas that hemp is a viable agricultural crop and an agricultural commodity in this state. Abbott signed that bill into law back in June of 2019. Delta tw Delta 8 THC, which is not mentioned in the Texas hemp law, is a naturally occurring psychoactive compound produced by the cannabis plant in small quantities. It is reportedly unable to produce any real or measurable psychoactive effect if consumed in its natural form. However, it's not being consumed in its natural form. Technological developments have made it possible to create artificial products containing a high concentration of manufactured Delta A THC, more than enough to create the high which is experienced by smoking straight marijuana. Businesses that sell these products claim the legislature opened the market for them with the Texas hemp law. With this understanding, many companies, including Sky Marketing Corp., reportedly entered the Texas hemp market. Now, State Senator Bob Hall, who was a sponsor of that law, said that's not what the legislature did. He said the legislature's intent in 2019 was a cat agricultural bill to allow for the growing and production of hemp products. They never intended to allow a psychoactive drug to be on the market with no regulation or control. Former Republican State Representative Bill Zedler, an author of the Texas hemp law, said that at that time we had the bill, we were not aware of the Delta VIII derivatives. They didn't uh they didn't understand that there were things that existed on the market that this bill would essentially protect or that this bill would be interpreted to protect that were ultimately psychoactive compounds. Uh the intent was never to allow the ultimate legalization of a marijuana substance that would produce a high. And so to clarify the state's position, former Texas Department of State Health Services Commissioner John Hellerstadt updated the DHS website, the SHS website in October of 2021 to classify hemp-derived Delta-8 THC as a Schedule I controlled substance. Now, a Schedule I controlled substance is considered by Texas law to have a high potential for abuse and no safe accepted medical use in the United States. There are severe legal consequences for the possession and distribution of such drugs. In response, Sky Marketing teamed up with other businesses and consumers to sue DH DSHS and its commissioner back in October of 2021, after he updated the website. Plaintiffs argued that the decision effectively outlawed Texas hemp production, contrary to the legislature's intent. Regardless of the fact that the legislature who authored the bill and who got it in and passed both said, yeah, that actually was our No, you're wrong. That was not our intent. Our intent was not to legalize your products. We didn't even know your products existed. We're not going to now turn around and pretend like you know what our intent was. You're wrong. And so they asked the court to order DSHS to rewrite the schedules of controlled substances and to block the state from enforcement actions based upon those modified definitions. The trial court, the lower court, uh granted a temporary injunction prohibiting enforcement of the Delta 8 rule changes. And the Court of Appeals affirmed that injunction. DSHS again appealed, this time to the Supreme Court of Texas, and oral arguments began back in January for this case. And so over the weekend, the Supreme Court of Texas reversed that injunction, upholding commissioners' actions. The opinion written by Justice Evan A. Young concluded that the lower courts had exceeded their authority. He said if the legislature desires to legalize powerful drugs, it has every tool it needs to do so. And to do so unmistakably, as we expect for such a major change to social policy. The role of the courts is merely to assess the state of the law as it is. And the court also noted that the legislature had also handed scheduling powers over to the DSHS, meaning even if they hadn't passed a law, that was under the authority of the DHS DSHS anyway. And so Young wrote, the legislature has charged the commissioner of the Texas Department of State Health Services with primary responsibility for overseeing the civil schedules of controlled substances. The statutory framework consciously, purposefully, and express and expressly authorizes her, indeed requires her, to undertake this task with a substantial and unusual degree of discretion. He said that legislative choice is at least in part explained by the need for the executive branch to be capable of responding rapidly and authoritatively to emerging threats to public safety from the development of illicit and harmful substances. If a new substance comes on the market tomorrow, you don't want to have to wait for a law to be passed in 2027. If something happens in and there's no special session, it happens in July of next year after the session is ended. You don't want to have to wait almost two years to outlaw a specific drug. Or if you have 10 drugs, you need an authority that can be granted. And you can do a law against it, right? If they if the DS the DSHS comes out and makes a substance, a scheduled substance, the legislature has the full power to overturn that decision. They have granted the authority in the meantime for the DSHS to do that. But they could come in and they could say, no, no, no. We think that you made a bad decision with this particular drug, that it doesn't have the potential for abuse and no safe legal contaminants. We're gonna we're gonna reverse that and we're gonna expressly legalize. Because law is not just what's illegal, it's also about rights and what is legal. They could certainly come in and say, we're actually going to expressly make this particular drug illegal if they wanted to do that. And so they needed somebody in place in lieu of the legislative session that can do that when they're not in session. They can that can essentially decide what drugs are dangerous and which ones are not. And so it is essential that we have a branch and a and a form of government that can do that. And so Justice Young also eventually slammed the trial court for extending injunctive relief beyond the parties involved in the lawsuit. And it wasn't just SkyMarket Corp and other people. Uh they prohibited enforcement of the modifications against anyone in the state. Any any company in their mom could start selling psychoactive compounds hooked to weed, and there was nothing that that that the law enforcement could do about it. Okay, I guess you can yeah, I guess you're allowed to just smoke this stuff and to eat this stuff and get high. And so he said, We have held that orders issued pursuant to the Texas rule of appellate procedure 29.3 cannot grant relief to any and all non-parties who may find themselves in circumstances similar to the plaintiff's lawsuit. Let me let me give you a little bit of an analogy just so you understand. Remember when you had the Ten Commandments that were on trial that went to, of course, the the appeals court only the cities that were explicitly sued were the ones that couldn't put up the Ten Commandments. Everyone else still had to in the meantime, right? It's not that every single once one person sues that the law is just struck down, it's for particularly the plaintiff. So if you were in Houston ISD and you sued Houston ISD for putting up the Ten Commandments, well, and and it got an injunction, well, then in the meantime, only Houston ISD could not put up the Ten Commandments. They didn't apply to every other district. And so in similar fashion, the injunctive relief that the trial court applied and that the appellate court agreed with said, Oh, yeah, I guess, you know, we'll just let anyone produce this. No, that was not the intent. That's not the intent of an injunction. It's to protect the particular companies that decided they wanted to sue. If you wanted to be protected, you better join the lawsuit. He said, We caution Texas courts to ensure that any injunction they issue is no broader than necessary to protect the rights of the parties before them. And so the court ruling essentially means that hemp derived Delta A THC will remain a schedule one controlled substance in the state of Texas. It also means that we can now enforce it. Not only is it a Schedule I, as it was the whole time, but the injunction is also struck down, meaning that as we move forward, that law enforcement has the authority to essentially ban these products and to say you're not allowed to sell them, period. Now lawmakers are expected to again take up new legislation regarding THS uh T THC in the upcoming legislative session coming early next year, which is coming very soon. Um that'll that'll again be on the agenda for the next legislative session. But in the meantime, t d specifically Delta VII THC this, the non-natural version, by the way, because the natural version that doesn't produce psychoactive compounds is still totally legal. And I I've heard a lot of people that have come out and said, well, this is great for medical use. No, it isn't. If you're saying that, then you don't know what you're talking about because what we're discussing in regards to this particular controlled substance has nothing to do with natural hempteri products. That has to do purely with the psychoactive side of things. Right? A lot of people talk about the medical uses. Yeah, the medical uses are totally legal in the city of Texas for the things that can be used for medical procedures. For the things that can be be used a lot of times for pain relief, stress relief, et cetera. Those are still totally legal. There's nothing against it. This is purely for the psychoactive compounds that are produced in a lab that are designed, manufactured to get people high. That's all that's on the table right now. That's all we're discussing. And so anyone that's defending it either doesn't know what they're talking about or they want to get high. Those are your options. There are people who don't know what they're talking about and people who like getting high. That's it. That is, well, and and you know what, I'm wrong. I said a s I said a false statement. There's also a third party, and that is the libertarians that think drugs should not be banned. But again, this goes back to the importance of understanding what you're dealing with. Hemp derived Delta 8 THC is not the same as the medical uses for cannabis. They're not the same thing at all. And pretend like they are is insane. And it's so funny because people that are pretending not to know the difference also pretend like they see a difference somehow in the Second Amendment when it comes to what kind of gun the founders would have meant. Well, I know they said arms, but does arms really include weapons of war, like assault rifles? Right? They go into that. Bonnie Wallace, we talked about her, was escorted out of an HISD board meeting after reading passages, uh, for lack of decorum, even though those books that she read passages from are found in school libraries. So they're not so inappropriate that kids shouldn't have access to them, but they're so inappropriate that you can't read them during board meetings. HISD Speaker Removal Sparks Lawsuit
SPEAKER_11Houston Independent School District officials are facing a new federal civil rights lawsuit after police escorted conservative activist Bonnie Wallace out of a school board meeting where she read from a sexually explicit library book the district makes available to students. The suit argues that Houston ISD violated her First Amendment rights by silencing her because of her viewpoint and then having her removed even after she complied with the presiding officer's order and returned to her seat. This all happened back a couple months ago in March, on March 19th, where Wallace spoke during the public comment period of an HISD board meeting that included an agenda item on instructional materials and library content. Before reading, Wallace explicitly warned that her remarks would include explicit language and suggested that any children present leave the room, saying that she was addressing sensitive material that is already available to students in HISD libraries. She then began reading verbatim from A Court of Silver Flames by Sarah J. Mass, a book that her complaint says is on the shelves of at least three HISD school libraries and contains graphic sexual descriptions. According to the complaint, HISD's own meeting video shows Wallace speaking calmly within her allotted time and staying on topic as she used the passages to criticize district libraries. The filing says that the presiding officer, Board Vice President Angela Lamone Flowers, interrupted Wallace, ordered her to stop, and issued escalating warnings even after Wallace explained that the explicit language was the point of her criticism. Wallace ultimately stopped, left the podium, and returned to her seat. Even after she was seated and no longer speaking, Flowers directed three police officers to remove Wallace from the meeting and escort her out of the building and off district property. Wallace was not cited or charged with any crime, but the complaint states that Texas law makes it an offense to intentionally disrupt a lawful meeting and argues that nothing in the record shows that Wallace disrupted the proceeding. Filed over the weekend in U.S. District Court for the Southern District of Texas, the lawsuit name is HISD, Board President Richard Campo in his official capacity, and flowers in both her official and individual capacities. Wallace is represented by attorneys with remnant law who describe her as a taxpayer, community parent, and child rights activist, as well as regular school board speaker. The complaint calls Wallace's remarks core political speech on a matter of public concern, whether sexually explicit and profane books should ultimately be accessible to minors in school libraries. By opening a public comment period tied to a posted agenda item, HISD created at least a limited public forum where it cannot discriminate against speakers based on the content or viewpoint of their speech, the suit argues, citing both the Supreme Court and Fifth Circuit president. Wallace's attorneys say she did not exceed her time limit, go off topic, or cause any disruption whatsoever, and that she was removed solely because of the content and viewpoint of her remarks. Specifically, her criticism of HISD's decision to purchase and circulate sexually explicit books. The filing labels HISD's actions as text point, viewpoint, discrimination, claiming the district allowed favorable speech, but shut down criticism of its library policies when that criticized when that criticism highlighted passages the board obviously did not want heard aloud. The complaint also leans on a recent US Supreme Court decision, that is, uh Chile's versus Salazar, which says it reaffirmed that government bodies cannot silence speech simply because they disfavor the viewpoint, expressed, or find the content uncomfortable, and cannot rebrand speech as conduct to escape First Amendment scrutiny. It also cites Fifth Circuit decisions holding that presiding officers who remove speakers from a public public comment forum because of their viewpoint can be held personally liable. And so while this is bringing multiple claims under federal civil rights law, first, she alleges that HISD and Flowers violated her First Amendment rights through content and viewpoint-based discrimination. Second, she claims they retaliated against her for engaging in protective speech by interrupting, censoring, and removing her, which she says created a chilling effect that makes her hesitant to speech at few speak at future meetings for fear of removal or even trespass charges. A separate claim seeks hold HISD itself liable by arguing that its written board policies and written customs give the presiding officer unbridled discretion to silence speakers based on subjective notions of decorum, offensiveness, or inappropriate content. Wallace contends those policies are unconstitutionally vague, fail to define disruption or inappropriate content. They just say, well, it's inappropriate. Well, if you get to decide inappropriate, then anything that disagrees with you, you could just call it inappropriate and boom, we don't get to talk about it. And she says they've been enforced in a way that targets criticism of district library policies while allowing other viewpoints. She also argues that at the state level, so those are those are constitutional issues. At the state level, HISD violated the Text Open Meetings Act by removing a non-disruptive speaker who was addressing a posted agenda item contrary to government code section 551.007's requirement that boards allow public comment on specific agenda topics. Because she didn't come in and just read a passage from a book based on nothing. It was specifically discussing library policy and and what's considered, you know, decorum for those policies. And so she's seeking a declaratory judgment that HISC's actions were unconstitutional and for injunctions blocking the district from removing speakers based on viewpoint, including critics of library policies. She also seeks compensatory and nominal damages, punitive damages against flowers, and attorney's fees. And so the complaint says that HIC's treatment of Wallace sends a message that undesired voices risk removal or even trespass charges if they attempt to read from books the district itself makes available to students. Wallace argues the outcome doesn't just affect her case. It implicates the right of all Americans to freely speak and seek redress from their government in public meetings. And so I think it's very important what the court rules on this, how this case goes, because the reality is I mean, you should be able to do that anyway. But considering these are books that are literally on library shelves for the school. These are in your school libraries that children are able to pick up and read. And if you're saying it's a lack of decorum, first of all, you don't get to choose what is decorum and and silence someone because their content makes you uncomfortable. But this is this is content that's in your libraries. This is content that you have. And so it is incredibly frustrating to see that the and as she highlighted, it really is a chilling effect of based on vague, unconstitutional language that you can just silence anyone, censor anyone, and remove anyone because you don't like the things they have to say. Because you don't approve of the content, which you do approve of because it's in your own school libraries. This case will move forward. We'll find out when it goes to trial and make sure that we're highlighting that. With that being said, we will be wrapping up the show in the next segment. So we have one final break. Pearland Election Turnout Warning
SPEAKER_11You're listening to the Lone Star Conservative, and I'm your host, Michael Wilson. I want to talk for just a moment as we wrap up about the importance of showing up for elections, even ones that are non-popular, even ones that are uh, you know, not on a typical election cycle. Particularly in this case, I want to talk about the Pareland mayoral election, which took place this past weekend. We had this guy, his name is Quentin Wiltz, I believe. Um, and he won. Uh Quentin Wiltz won with 51.1% of the vote versus Tony Carbone's 48.9%. Now, Paraland municipal elections are what are called nonpartisan, which means they don't have party labels on the ballot. You're not running as a Republican or a Democrat. And so the only way you can tell what someone is, because they're not it in in policy, in a legal perspective, but in a practical perspective, you can kind of analyze, okay, who is this person? Who is Quentin Wiltz? Is he, you know, a Democrat? Even if there's no D next to his name in policy. And in a lot of the stuff that he campaigned on for Parland mayor, it'd be easy to say, no, it seems like a um, you know, center kind of person. All right, he campaigned on economic development, infrastructure and growth management, public safety, city services, better budgets, you know, things, things like making sure that we are dealing with the outgrowth from Houston into these sort of suburban areas, um, you know, uh finding out a lot of his fiscal policy has to do with reducing debt, lowering tax burdens, improving budget efficiency. But if you kind of get in to his position uh because he actually has served before in the community, he was the former chairman of Paraland Parks and Recreation Board and a former board member for the Paraland Chamber of Commerce, and he did a lot of good. We can also get a little better idea because he had an emphasis on uh diversity and inclusion, right? Specifically, he supported creating a diversity and inclusion board for city participation, okay? Um, he mentioned climate-related local impacts, uh, pandemic preparedness, all the sort of language that you'd expect from a Democrat. And he won the election as someone who was very clearly running as a conservative. Now, Pearland, part of Missouri County, has consistently uh, you know, tracked five to fifteen points for Republicans, even though we don't have registration, we can see based on presidential elections and the like, you had a f plus five to plus fifteen points going Republican for most recent elections in Pareland. And yet you had the very clear non-conservative win. And I want to highlight what the actual voting turnout looked like. Uh, because you had a total vote cast of about 11,743 people. And registered voters, we we we have a rough estimate of 70 to 80,000, which means that the turnout was was roughly 15% of registered voters. On just 15% of the population, 15% of registered voters that showed up. And we allowed a climate DEI activist to be elected to that mayoral position, despite the with 15% of people showing up. Because Republicans didn't show up to vote. We can't win if we only show up to vote during massive election periods. And of course, I think that we should do a better job. We should require policy that has more uniform elections. I don't like when we're doing, you know, May 2nd elections. It doesn't make any sense. No one's gonna show up. But we have to, we have to be consistent. We have to say, I know that this takes away one of my days, but I need to go and participate if we want to win in these small elections because now the mayor of a massive city of a city that Houston's growing into is uh largely Democrat aligned.
