Alright folks, welcome back to another episode of The Lethal Library. I am Stephanie.

and we are a True Crime podcast. We talk about cases mostly in the Pacific Northwest. and today Danny's gonna be telling us a story of yet another dumb criminal. What do we got on the plate? Danny?

Dani:

I didn't even write an intro for this. I didn't know where to start. So let's just get straight into it. Let's jump in On August 3rd, 1983 in Shoshone, Idaho, Jamie Charvin was shot by Marilyn Arbor. After an alleged sexual attack of Marilyn's youngest daughter, age 13, yikes. Marilyn unloaded her 22 caliber gun into the side of Charvin O'S truck. While he was in it, bullets hit him in the right elbow and leg. She was charged with aggravated assault. Salt in August of 83, but earlier that year in January, Marilyn and her father James had went to the Jerome County prosecutor, Dan Adamson, in an effort to put OW in jail, Marilyn had bruises from a reported fight with Char, but because Marilyn admitted to hitting char in the head with a frying pan. Adamson said the couple had engaged in a mutual combat and that he was unable to press charges to

Stephanie:

hit someone in the head with a frying pan. If that's how it starts, that's one thing, but if that's what you do to try to stop it, that means it was pretty intense. I've almost hit someone in the head with a frying pan once. No shit. I'll tell you the story later, but, yeah, like literally, you know how you can, I'm really good at flipping a fry pan in my hand from working at like fast food restaurant or like restaurants. so I was like, you're gonna get it. You're gonna get it. I'm doing the shit it with someone attacking someone else. Oh,

Dani:

Not attacking you. So that's why. But so if a frying Pam's involved and it's not the initial contact. Someone's probably acting up,

Dani:

but she also, while he was in his truck, I'm assuming trying to leave. Yeah. You can't shoot people when they're sleeping, just unloaded her

Stephanie:

gun, pop, pop, pop, pop, pop, pop, pop. A lot of people don't know that. They're like, even, even if someone was stabbing you, if they are running outta your house leaving, gotta be careful with your gun laws in your state. They're different everywhere. Take a concealed carry class. They'll let you know what, what's under the law and what isn't. You can't just shoot someone'cause they're on your property in most states anyway.

Dani:

charges against Marilyn were later dropped right before her trial because of an incident in Jerome County where Char Bruno attacked Maryland. I. Lincoln County prosecutor Doug Rose, stated he had instructed ow to stay away from Maryland and avoid any contact, but char ow com compromised the case by contacting her and I don't know the level of the, I don't know, attacked I, there was no details, but there was some interaction there that he

Stephanie:

was where he shouldn't have been.

Dani:

Yeah. It's like, oh, the lady that shot you up? Yeah. Don't fucking talk to her. Do not be around her.

Stephanie:

Don't go to her place of work. Don't, eh,

in the grocery store.

Dani:

Turn the other way. Yeah. Something happened. So

Stephanie:

anyways, drama all over the town.

Dani:

And we're just getting started. Um, so I don't know. Marilyn was off the hook for shooting, unloading a gun into the side. They said, uh, you know what? Yeah. Okay. On June 13th, 1984, Marilyn, age 36 and Char. 24 had their divorce finalized. They had only been married for a year before they separated.

Stephanie:

Ooh, that escalated quickly.

Dani:

Yeah. Uh, they met in July of 1982 and had a very stormy relationship. So, I mean, we're two years into this relationship. Divorce has already filed back and forth fighting, whirlwind

Stephanie:

of drama. I mean, I think we've all seen that kind of relationship before, whether it's your own or your friends or your families. I think we're, we're getting the vibes here. I just

Dani:

think if you're shooting at your partner.

Stephanie:

Red flag, at least one. Where's the red flag guy? Yes. We need the gigantic red flag like this. It's gone too far there. I don't know how you reclaim a relationship after things like this. No. And this is happening after like a year?

Dani:

Yeah.

Stephanie:

How do you get back? I don't care who the therapist is. You're not therapy yourself. Out of this.

Dani:

It's not fixing. No, they were in a constant state in those two years of breaking up and getting back together and apparently shooting each other and, or shooting,

Stephanie:

shooting, frying, pan, all of that shit sick.

Dani:

A warrant was issued for Char in late June, 1984. He was charged with first degree kidnapping and rape. Oh my God. Marilyn told police that on June 21st, sharp, Bruno kidnapped her as she left work as Marilyn was leaving her waitressing job. At the Butte Cafe, he entered her car and refused to leave. Do you think this was the only restaurant in Butte?

Stephanie:

Is it the only restaurant in Butte? I,

Dani:

I kind of feel like it was,

Stephanie:

there's maybe two

Dani:

small town charvin. sharper note, then choked her until she became unconscious. When she woke up, she was in Lincoln County where he raped her. Marilyn was able to finally escape while her car was stopped at a stop sign. She escaped from the vehicle. Marilyn's car was later found high centered on a rough road, and completely burned in Yhe County. Yeah.

Stephanie:

Completely burned.

Dani:

Mm-hmm. And also, I did read reports where the VIN had been removed. This is so funny. So I, I'm sorry. It's funny. So the VIN had been removed in the obvious places, where you see it, you know, yeah. Back in the day on the door in the, in the dash, whatever. But. One. One newspaper reported, but they found the VIN in a hidden place that's only known to police.

Stephanie:

Oh, super. Secret police, vin. Well, I mean now most of these cars have like the computers in them that can tell em exactly how fast you were going. Did you break? But yeah, no, that's a great idea. Even for just stolen cars to have a secret vin and why wouldn't they? How much does that cost?

Dani:

But there was a secret vin hidden secret vin, Later her backpack was found. In Battle Mountain, Nevada.

Stephanie:

Damn.

Dani:

You're gonna see what's going on. And lemme just tell you about Char.

Stephanie:

Tell me about Char.

Dani:

He was a rodeo man. I.

Stephanie:

Oh, so the Montana and everything's coming into play here,

Dani:

and Hawaii County. Yeah. And all that stuff. He, even pictures of him, he is dressed in like those cowboy shirts that have like, they're buttoned and then they have that extra flap. Oh yeah. Yep. Yeah. That's over. Mm-hmm. Like, and the little bow tie thing. Bolero. Like the string, not the string, the actual scarf.

Stephanie:

Oh, okay. Yeah, yeah, yeah, yeah, yeah. Are you feeling the vibes? I feel the vibes. Okay. And listen, rodeos around this part of the country, not only this part, but there's many states where rodeo is a huge thing and these boys are like rock stars, even if they're not making it big or winning all the time.

Dani:

And he, he's 24 and she's 36. Yeah. What are we doing? What are we doing? I, I don't even think I could relate.

Stephanie:

I thought it was the other way. I didn't realize that. I wrote down the ages, but not with the names. So thank you for clarifying. Yeah.

Dani:

and also you're going to hear about Marilyn's daughter who was 17. Awkward. Not good. No. And, and, yeah, there's, it's just

Stephanie:

the fuckery is real.

Dani:

Yeah. I don't, I mean, Marilyn was beautiful still. I just, for me, the, the finding that commonality, like, yes. Thank you. Is that a word?

on July 1st, sharper, went to Marilyn's home in Jerome, Idaho and let her horses out of the corral. Marilyn saw they were out and went out to gather the horses back in, into the corral. Mm-hmm. at 11:38 AM Marilyn's two daughters called the Jerome Sheriff's Office and said they heard shots fired. Tiffany Arbaugh, Marilyn's daughter picked up her mother's rifle and went to the barn. Marilyn was sitting on the ground and Sano was standing over her. Sano turned and pointed the gun at Tiffany and told her to leave. Marilyn also told her daughter to leave. She did. She's like, go.

Stephanie:

Both of them were saying to leave, but very gutsy. Grabbing that rifle girl. I'm very proud of her being, oh, she wasn't loosen up

Dani:

wasn't, she wasn't fucking around. I love that. See what's going

Stephanie:

on out here. But then both of them telling you to leave, like, ugh, for a kid. Mm-hmm.

Dani:

Uh, au told Tiffany he was going to take her mother to the hospital. Tiffany went back into the house where she heard more shots. Oh my God. Yeah. I can't even imagine how scared I would be

Stephanie:

today As an adult.

Dani:

Yeah,

Stephanie:

as a teenager. Fuck

Dani:

Tiffany then grabbed her mother's car keys, so Char Bruno couldn't leave. Smart girl. She ran back to the barn to find Marilyn lying on the ground and Char Bruno was gone. The daughters called the Sheriff again saying their mother was dying, and that Char Bruno had fled into a field near the barn. Marilyn had been shot 15 times. You got

Stephanie:

to be shitting me. That's out of fucking control. Especially knowing that someone else knows, knows that what you're doing out here, like I am so happy that he didn't go for those girls because

Dani:

isn't it, we just, at that

Stephanie:

point you think your brain would be like. Well, she already knows that we're out here and I've got a gun. She heard the shots. I gotta go take care of business. So I'm just so glad that I think he knew that she was gonna shoot him.

Dani:

I think so too. Sharp. Bruno was arrested a short time later. In the field behind Marilyn's home. Just to kind of give you an idea of what Jerome, it's Jerome is desert

Stephanie:

and like some farmland,

Dani:

a lot of farmland, but also a lot of sagebrush. Mm-hmm. Uh, so when they say a field, I just imagine just sage brush and dirt. Yeah. Out there. I mean, it could have been a. It could have been a farmer's field. actually now that I say that, I do believe it was a wheat field now that I'm remembering my research, because they were looking for items out there and it was very difficult. So yes, it was a wheat field, but still there's lots of stage brush. And Jerome, it's. It's fucking, it's Nevada Desert.

Stephanie:

Yeah. High desert.

Dani:

you think of the hangover where they meet in the desert. Yeah. That's southern Idaho.

Stephanie:

And a lot of people don't realize what High desert is because they're like Idaho. You get so much snow. How could it be a desert? It with the amount of actual precipitation you get. It is, it's a different desert than like sand dunes. Even though Idaho does have sand dunes. Surprise, surprise.

Dani:

The largest sand dune in North America.

Stephanie:

We've, listen, Idaho has everything, so, and then some boom. Um, but yeah, high desert climate. And so it affects like what plants you can have here. A lot of people come here and are just so surprised how dry it is and all their house plants die because, or they buy like whole house humidifiers because they just like it better or they have lots of plants. So it's a very interesting and diverse climate that Idaho has. So high desert. Look it up.

Dani:

Char Bruno 24 was charged with first degree murder, first degree kidnapping, and grand theft in Jerome County. He was also charged with rape in Lincoln County. And these are, I just, drum and Lincoln are like,

Stephanie:

they're besties.

Dani:

Yeah, they're besties, they're bestie counties. they're right next to each other. Defense attorney Golden Bennett asked Jerome County officials to move Char Bruno from the Jerome County Jail to another location for his safety. Someone had apparently banged on an outside jail window and shouted your dead meat in the area where she was confined.

Stephanie:

Well, so was it two though? How did they know if he didn't? There's other inmates in there.

Dani:

Didn't it say, Mr. Jamie, ow, you're dead meat. They just said you're dead meat. But also,

Stephanie:

and this somebody was really saying that in a threatening tone, was that lingo so popular that you would say, you're dead meat.

Dani:

you are dead me. And it's a serious threat. Now. That's like something I would, I would, I would, it was probably some

15-year-old kid that was dared to do it.

Stephanie:

Right. Go tell those.

Dani:

And how do you touch the jail windows? I just, yeah, I don't know. I just walk up to the ADA County Canyon County jail and just bang on some windows.

Stephanie:

Knock, knock. Hey, how y'all doing?

Dani:

You're dead

Stephanie:

meat. You're dead meat. I'm gonna start use, I'm gonna bring, we're gonna, we're bringing it back. We're bringing dead meat back. Well, I guess I can't recommend this for everyone because your HR might not make a point too kindly. But maybe the next time Rick pisses me off. I'm gonna say, you're dead meat. Will you record a please, pal? Listen, pal, you're skating on thin ice. Dead meat. Meat. You're dead meat. So now he needs a transfer because of that. Wow. Very sensitive.

I do have to tell you. No, I'll tell you later. Okay. Uh, in August, Charvin Oak pleads not guilty to all the charges. Oh, NAMI, NAMI. I was

nowhere near there.

Dani:

This is, this was bizarro to me. Do you like my made up word there? Bizaro.

Stephanie:

I think that's a fish probably in the dictionary.

Dani:

Two trial dates are set. October 1st is for the murder trial. And December 3rd for the kidnapping and grand theft charge.

Stephanie:

Are we putting the horses before the cart or the carriage or whatever the saying is?

Dani:

Why?

Stephanie:

Because if you get, I mean, te test your theories on the kidnapping and if you lose that. Sucks. Oh, well now you have. Now you know what the defense is gonna do, strategery. Folks, what is happening here?

Dani:

The trial dates are set by the case number. The murder charge paperwork was returned to the judge before the other charges. Therefore it will be tried first.

Stephanie:

I feel like as a lawyer, you've gotta find a way to slow down one over the other then and be like, oh, we're waiting on a such and such. Can't do that one. It

Dani:

really wasn't the, and listen, it was the prosecutors. They're the one that files the charges. So maybe it was some strategery. There's another made up word, Mr. Golden Bennett is not happy with that and he wants to move the trial date. It's plus

Stephanie:

slave queen.

Dani:

He has a vacation planned. Super slave queen. Golden said. No one consulted him about his calendar. When the dates were set, judge said, not my job. I'm here to make sure we have a fair trial not to consult others' calendars.

Stephanie:

Especially for a vacation. I mean, let's think of a better excuse. This is But Golden

Dani:

wanted to go. I'm supposed to be in Cancun. No, he is probably going like, oh, let me picture what his vaca. He probably was going to Reno,

jackpot would be beneath him. Vegas, he would be too far above him. Mm-hmm. So I feel like he's a Reno. Kind of a gonna cry.

Stephanie:

I think he's an Reno kind of an attorney because he is literally working out of Jerome.

Stephanie:

Listen, they had a suite on the corner in Reno. At the Motel six, a suite, but judge didn't care, so

Dani:

Judge said You're burnt. Cancel your family. Vacate to Reno. Golden. Probably had all of his kids loaded up. They're gonna take him to the Circus. Circus.

Stephanie:

Yes. Drop'em at Circus. Circus. We're good. They're, they're, this is all made up because they're like

Dani:

fucking, they're like eight and 10. They give'em like 40 bucks and be like, yeah, mom and dad will be back in like three hours, hours. Don't talk to strangers.

Stephanie:

Six business weeks. We'll be back.

Dani:

Oh, Okay, golden Files a motion to exhume Marilyn's body.

Stephanie:

Oh Lord.

Dani:

He is claiming that Marilyn's daughter, Tiffany, age 17, shot her. Ooh, that is dirty. Do you see why I said Reno? Yeah. Okay. I mean, I

Stephanie:

understand the law. The thinking behind it. But that is, I mean, I know this is in eighties, but surely they know the difference between a rifle and what was he using?

Dani:

Stephanie:

Dani:

okay, please. No, Steph.

Stephanie:

Oh my God.

Dani:

Wait. Hmm. Golden. Might have been on to. A reasonable

Stephanie:

reason for this. Okay. Oh gosh. It's gonna come up now. I'm terrified.

Dani:

No, it's Charvin is claiming he saw Tiffany. Shoot her mother. And I wanna apologize, Tiffany, if I am saying your name wrong.'cause it, it's not Tiffany. It's Tiffany. So I'm trying to really say it correctly. Okay? Okay. Golden wants a detailed autopsy saying the pathologist. Failed to make a complete autopsy and testified during the preliminary hearing that he had left some bullets in Marilyn's body. Golden wants those bullets to be retrieved and tested.

Stephanie:

I mean, if it's true, that's a valid concern. They, I feel like that should never be. Left because that's evidence.

Dani:

Same. Same. But listen to this, oh Lord. Deputy Sheriff Larry Webb said exhuming, the body is unnecessary. He personally was there for the autopsy. And the bullets that were left in Marilyn's body were too fragmented to be useful in any test.

Stephanie:

83. Yeah. Yeah. In another motion, the defense is asking for a jury to come from northern Idaho because Marilyn born, raised there. Lots of family, lots of friends, and this newspaper. Mm, they were.

Stephanie:

Dani:

Um, yeah, they were all about it. Also, Mr. Goldie is talking shit.

Stephanie:

Alright, Goldie, what you got?

Dani:

He said he's surprised that the Jerome County prosecutor, Dan Adamson, has not removed himself from the case. Adamson's brother John was formerly married to Marilyn,

Stephanie:

a former sister-in-law. Yeah, he has a valid point, but I, and I, listen, I gotta say I like the delivery. Oh, I'm surprised. It's so like 14-year-old teenage girl. Yeah. Like. Oh listen sweetheart, that's so weird.

Dani:

Adamson basically said eat shit golden. I would prosecute my former sister-in-law. Suspected killer

Stephanie:

and what suck it. Appeals be damned motherfucker. We do what we want. Very Idaho. Very Idaho.

Dani:

You're not the boss of me. Even if you're No, and I'm in my research, Adamson was like, I have no ill will against, like, I have no ill will against my former sister-in-law. Like I, why would I even have? But also on the flip side, now that I'm thinking about that own argument in my head. If Adamson might be a little shady because of the alleged abuse against

Stephanie:

obviously being, seeing her beat the heck outta. Yeah.

Dani:

So there's kids involved and I don't know the relationship with the kids. They weren't his nieces, but

Stephanie:

it was very, it was volatile, no matter how you want to look at it. Yeah. Even, you know, if we're getting to the point of shooting and bruises that make someone drop your case about a shooting and a frying pan, this is out of control. No level's good, but this is far beyond.

Dani:

He was the one though.

Stephanie:

Dani:

Adamson was the one. I'm gonna go look. Adamson was the one when Marilyn and her dad. I believe he was the one that was like, there's no, I can't help you. It, he was so

Stephanie:

what? A tangled web.

Dani:

so, uh, golden. Did you not look at that? Like Adam's uh, he sounds like he's being pretty fair.

Stephanie:

Yeah, he already, she probably would've had a valid case and he said, it's not that valid. You don't have enough.

Dani:

Right. He wasn't take, and that's probably why they went to him. Mm-hmm. Instead of the poppo.

Stephanie:

Oh. Because they want advice. They they know someone. Yeah.

Dani:

Yeah.

Stephanie:

That can give them advice.

Dani:

The request for exhumation is denied. The district judge wants more evidence before he'll allow it. The pathologist said the bullets that were left in Marilyn's body were in her lower extremities and that it did not cause her death. She died from a bullet that severed her, a main artery near her aorta, and from collapse of the lungs. Mm.

Stephanie:

Well, I mean, she was shot 15 times. Good ness.

Dani:

And the judge also said, you're outta luck, Goldie, boy. We're not combining the trials nor setting new trial dates. Dunno why.

Stephanie:

SOLI think the judge is just a, is my house not your house? I don't care. I don't care. You're going to Reno bud.

Dani:

You're picking up on some good vibes. Okay. A motion to dismiss a first degree murder and the related charges against charnow are filed by Golden Bennett in the motion. He declares charges against Charnow. Should be dismissed because of gross mishandling of the case by the Jerome County Prosecutor and Sheriff's offices. Golden said he had a verbal agreement with Prosecutor Adamson. But he ignored the agreement,

Stephanie:

A verbal agreement. I don't know what the

Dani:

verbal agreement was.

Stephanie:

Uh, can you not charge him with the murder? Maybe just the kidnapping. I. Eh, that they had a drunken handshake at karaoke night or what?

Dani:

Probably. Probably at the Butte Cafe. We talked about this. Golden also said several pieces of evidence that were proved sharper. Note did not kill Marilyn had been purposely suppressed.

Stephanie:

What are these, you say?

Dani:

Adamson said the motion is frivolous and typical of Colby's actions throughout the proceedings. In the case, golden says Charvin admitted to wounding Marilyn, but he did not kill her,

Stephanie:

or did you just not see her die?

Dani:

He also wants the grand larceny and kidnapping charges dropped. The charges are unfounded and there is evidence that proves the incidents did not occur. Dunno if said evidence, but you know, Goldie says Golden also says the Jerome Sheriff's Office was aware that there were two guns at the murder scene, but the sheriff's office was only interested in one of them. He said it is now known that there were three guns at the murder scene. Guns On guns. On guns. During the motion for dismissal, Charvin testifies that Marilyn's daughter fired the fatal shot that killed her during the 10 days after the alleged rape and kidnapping. He hitchhiked through Nevada and into Jordan Valley and then back to his grandfather's ranch in Hawaii County. In search of work shoeing horses for ranches. So this next little bit that, that, and this next little bit is actually his testimony. Okay, so this is all allegedly from the horse's mouth, though unable to find work. He returned to Jerome and stayed in the barn of Marilyn's home several days before the Sunday when she was murdered. Sharper stated that he and Marilyn made love. Looked at the 22 caliber rifle he had purchased for her daughter Tiara. I hope I'm saying that right, Tiara, and got along well. Although Char Bruno said he wasn't hiding, Marilyn did not want her daughters to know that he was there.

Stephanie:

Mm.

Dani:

I could, with all the

Stephanie:

drama, I could especially, you know, I'll give your, your daughters are old enough to be like, what is literally happening? If that's the case, I could see it.

Dani:

And Tara was 14 and Tiffany 17. They're fully aware of what's going on. Oh, yeah. And they're, and I could see that being legit, like. What is out about all this? Why in

Stephanie:

the hell is he here?

Dani:

Yeah. Like, what are we doing? So I could, I could see that.

Stephanie:

Mm-hmm.

Dani:

he said, but then there's Bullshittery, so here we go. I mean, here we go. This is his testimony. But he slept on the floor and went without food from Thursday until Saturday evening, until Marilyn brought him lunch.

Stephanie:

He was hangry if he was there willingly. I can't see how that would happen. That's what if we have horses, oh, I forgot to go do this with the horse. Right. It would've been an easy excuse. The only thing that the kids would've recognized is, I'm sure they were helping with these horses. Mm-hmm. With bedding and feeding and whatever. They may have noticed that they didn't have as many chores, but there's always a reason to go out there. You can make up a reason. So

Dani:

out of the unbelievable story, I do believe that if he was there, Marilyn was like, Hey, but I don't know. I think would be reasonable. Yeah. For her to be like, the girls can't know you're here because I'm not ready to deal with that. Mm-hmm. Because I shot you and also you just kidnapped and raped me, so you can't be here. Yeah. So on Sunday, Marilyn came to the barn and told him she would finally tell the girls he was there. She then took the rifle to the house to show Tiara because he had bought that gun for Tiara, the rifle, which would not be outta line, considering the time and where they lived. Mm-hmm. Nope. Teenagers are having guns. Yeah, totally normal. she later returned with the gun and they were going to side it in, so she came back to the barn with a gun and they were gonna side it in. Marilyn, then loaded a handful of bullets into the gun. And that's when Char Bruno asked her where she had spent the previous night since her vehicle had not been home.

Stephanie:

It's an interesting story. I feel like most women are smarter than this if someone's staying on your property, but

Dani:

I also kind of feel like Marilyn didn't give a shit. I, I do feel that I, it's like I'm not hiding shit from you. She was to that point. Mm-hmm. I mean, we've known people. I've, I've been that person like, Hey, I don't give a fuck.

Stephanie:

Yeah. I, I'm helping you out by letting you sleep in the barn.

Dani:

Yeah. And I'm gonna do what I do.

And when he peeked back in, he claimed he saw Tiffany standing over her mother aiming the gun with both hands at her. He said he heard a shot and saw Marilyn's hair fly up. He closed his eyes again. He can only recall hearing one shot.

Only her defense being that Jamie had molested her two daughters. Both daughters denied these accusations under oath in Mr. Rose's office and Shoshone. Jamie loved and treated Marilyn's daughters as though they were his own having none of his own. Marilyn was released from the charges of shooting Jamie after she divorced Jamie. She still would not leave him alone. She called him. Wrote to him, went to his jobs until he agreed to come back to her. Then she told him she didn't want him in the house and she made him a bed in the barn at the house she rented. Marilyn again, tried to kill Jamie. She already had a loaded gun in the bar. She aimed at Jamie's head and fired it being a fully automatic gun. It had to fire once to bring the bullets into the chamber. Then the gun begins to fire automatically. Jamie and Marilyn then begin to struggle over the gun. The gun went off striking the lower extremities of Marilyn's body. Being on the ground in the barn. Marilyn then pulled Jamie to her saying that she loved him and that she was sorry for everything. Jamie then left the barn and went into a nearby field to await the arrival of the police to give himself up and to avoid further trouble with Marilyn's dad. Marilyn's father hated Jamie for being with Marilyn. We have all lost a sense of human compassion as to better feed and take care of animals than a human life. Even though a person may be incarcerated for a crime in jail that only shows, that only allows two meals a day and a shower only when permitted or to invade a person's right to privacy.

His eye became swollen and infected before his lawyer could get the Jerome gelatin to take Jamie to the doctor. In December, the rape charge in Lincoln County was officially dropped. The prosecutor, Doug Rose, is asking for the dismissal due to the lack of evidence. He said quote, it is not because I feel the crime was not committed, but rather because Marilyn Arbor the only witness. It will be difficult to prove. And of course, with all this drama going on with the case, prosecutor Adamson also lost the election in November. The county has a new prosecutor, mark Gouss. Adamson filed an affidavit for a special prosecutor to handle the case due to Gauss's inexperience. Special Prosecutor House will take over. So it's a fucking shit show down there we got. But he's basically filing and being like, yeah, like, well, this is a whole thing. So the case is supposed to start in the middle of January. And, but he is not the prosecutor anymore. Mm-hmm. And he's been on it this whole time. Right. And so now they have, and I went through the whole, I'm just tell shit show there was people that had no business running for a prosecuting attorney. One guy that ran, I can't remember his name, but um. He went to law school and passed the bar, and then he went and got a job at a, I wanna say it was like a chicken farm. It was something ridiculous like that. That's just what my brain is telling me like, and then he is like, Hey, I'm an attorney. I could be prosecutor, I'm gonna run, I'll put up some signs. Anyway, yes, basically this is, it's a very small county, slim Pickens, very small county, and odds are he had a good chance to win if he's a good old boy and had lots of family there. So anyways, but this new guy that's coming in Gauss is just, he doesn't have any experience and so he is like. All right. I'm gonna reach out and find somebody that can handle this case, so that's fair enough. That's where we sit. We are in 1985. God, it's been a long two years. Yeah. What's happened? Uh, Goldie. Mr. Goldie asked for a change of venue. He also files a motion for dismissal and an exhumation of Marilyn's body again,'cause he'd already asked for this. The change of venue is granted and the trial will be moved to Ada County. Let's go. The judge did not decide on the other motion. The Northside News sues the Jerome Sheriff. Over access to Char Mano. The paper is trying to interview him in jail and they were turned away by the sheriff. Char Beau wants to talk to the press regarding jail conditions. All uh, who was that motorcycle

So he's appointed a public defender, Randy Stoker. Ooh. But Golden says he hasn't been fired by Chao's Mother who is paying him and wants to stay on the case, and he plans on staying on the case to assist Stoker. Okay. And the judge. Okay. The plan to combine the trials, which makes sense. Let's get her done. And one big thing I thought, I saw through all my research was the cost of all of the shit to this tiny county. guy, they were over it in April. The trial begins in Boise. A jury is finally seated, consisting of six men and six women. It took nearly four days to interview 46 people before the jury was selected. Defense attorney Stoker is trying to get the statements made when OW testified during a motion hearing the previous year to not be entered in as evidence. Oh, do you remember that preliminary hearing? Yeah. that everything was, that you had his testimony? Yeah. Goldie was like, Hey, you want this? Dismissed. Get up there and tell him your story. Oh, yikes. Stoker says Charvin O was ill-advised from his attorney. That's still partnering on.

A coworker of Marilyn's, Chris Smart, testified that she had been invited to go to Gooding. With her on Saturday the night of the kidnapping. Marilyn later changed her mind and said she decided to go to Twin Falls instead because ow had supposedly been spotted in the Gooding area and that she was afraid of him. Fair sis.

She was reading when she heard shots fired. She ran to the horse corral with her mother's 22 caliber gun. Tiffany saw her mom sitting in the alleyway and Charnel was standing over her holding a gun. So there's been some, the first reports is that she was in a barn. But apparently between the corrals and the barn, there was what they quote called the alleyway. Okay. So they both asked her to leave. Tiffany then ran to the shop across from the cellar and called the police station and told them Jamie had just shot my mom. And then she went back to the house and got her sister out of the bathtub. And changed from her pajamas to street clothes as her younger sister also got dressed. Both the girls ran and took cover behind a wagon near the corral. It's a real wagon. It's a sheep wagon. Okay. Tiffany accidentally fired one shot from the gun she had. They heard another series of shots and ran back into the alleyway. Tiara brushed her dying mother's cheek and ran to call an ambulance at Tiffany's demand. One minute she was looking at me the next, she wasn't. I knew she was dead, so I closed her eyes. Shaana was gone. On cross examination. The issue of Tiffany being the one who shot her mother never came up because remember that was, they knew

He quoted Addison as saying the spent casing wouldn't be needed and it wasn't pertinent to the case and it could be discarded. Mm. Sto her asked cos if the situation was a little embarrassing, and COA was like, yeah, it is. Prosecutor Oz, ask Coates if he normally took orders from the prosecuting attorney rather than the sheriff. Quote, usually I don't, but that day I did. Good old boys. I'm just saying.

Or one of the bullets could have fragmented it before it struck Marilyn causing multiple entry wounds. Or a bullet could have ricocheted and entered her body twice, or she may have coughed up a bullet lodged in her throat before she died, or a 17th bullet that grazed her arm could have penetrated her body somewhere else. Um, February 15th, 2016, char Bruno is arrested in Star Idaho, not in Star. In star. That afternoon, a woman arrived home and she found Char Bruno hiding in her closet.
