S1 E16 Tradesman vs Subin 2nd Amendment Complaint
This deep dive breaks down the "Second Amended Complaint" filed in the U.S. District Court for the Eastern District of New York by Roosevelt Road Re, Ltd. and Tradesman Program Managers, LLC (the Plaintiffs) against Subin Associates, LLP, and several individuals including Herbert S. Subin, Eric D. Subin, and Jorge Arturo Gonzalez Lupi, among others. The core of the complaint alleges a widespread fraud scheme involving staged construction accidents, fraudulent workers' compensation and personal injury claims, and unnecessary medical treatments designed to illicitly obtain payments from insurance carriers. The Plaintiffs claim damages resulting from this scheme, asserting that they were forced to incur substantial costs in defending against these fraudulent claims and paying out inflated settlements. The lawsuit includes RICO (Racketeer Influenced and Corrupt Organizations Act) violations and common law fraud charges, demanding treble damages and injunctive relief to stop the alleged unlawful conduct.
