In this Deep Dive we look at a legal order, Judge Loretta A. Preska grants a motion allowing the defense to cross-examine Dr. Sebastian Lattuga regarding his alleged participation in medical fraud schemes. The defendants aim to challenge the doctor's credibility and motives by highlighting past accusations of performing unnecessary procedures and inflating costs for financial gain. While the plaintiff argued that such evidence was unfairly prejudicial, the court determined that the information is highly probative of potential witness bias. To ensure a fair trial, the judge noted that a limiting instruction could be used to prevent the jury from misusing these prior allegations. Ultimately, the ruling prioritizes the defense's right to investigate the professional integrity of a key medical witness.
