Hello everyone and welcome back. In today's episode, we'll be talking about debt settlement versus debt relief programs, the truth behind the promises. I'm your host, Attorney Epstatios Georgiou. Having represented both banks and consumers, I've seen how easily people can fall into debt traps and how the right legal strategy can pull them out. If you've ever turned your TV on late at night, you've probably heard something like this: cut your credit card debt in half. Get out of debt without bankruptcy. One simple program can make your debt disappear. All of these ads sound like hope, but often they're traps. Today we're gonna break down what programs actually do, what they don't do, and how attorney supervised settlement done legally and strategically with Georgieu Law is completely different from the risky one-size-fits-all debt relief industry. By the end of the episode, you'll know how to protect yourself, understand your options, and recognize real solutions from false promises. So step one, understanding what debt relief really means. Let's start with the phrase itself, debt relief. It sounds comforting, but in reality it's an umbrella. And most companies that advertise are not law firms, they're marketing agencies that collect upfront fees and pass your file to third parties. Here's what typically happens: you sign up, they tell you to stop paying your creditors, then they start collecting monthly program payments into an account that is often not yours. Meanwhile, your credit score tanks, your accounts charge off, and in many cases you get sued long before any real negotiations take place. And because the companies are not licensed attorneys, they cannot represent you in court or give you legal advice. So when the summoner arrives, you are suddenly on your own. That's why I always tell clients debt relief is not debt defense and it's not debt law. They're completely different animals. Step two, the legal framework, the FTC telemarketing sales rule. Here's where the legal distinction becomes critical. In 2010, the Federal Trade Commission amended the telemarketing sales rule or TSR to protect consumers from deceptive debt relief practices. Under the TSR, any company that markets debt relief services by phone or even internet cannot charge a fee until they actually settle or reduce your debt in writing. What does that mean? No upfront fees, no enrollment or administrative charges, no payments until a written settlement is achieved and accepted by you. Yet many national companies still collect fees early by claiming that they are coaching or document preparation charges. This is a direct violation of federal law. At your due law, we follow the TSR strictly. You don't pay us until there's a documented, signed settlement that saves you money. And we take it a step further to the letter of the TSR law until the first payment is made to the bank. And because we're a law firm, not a telemarketing company, you also get legal representation, something those programs cannot offer. How attorney supervised debt settlement works. Now let's talk about what legitimate debt settlement looks like when handled by a law firm. It starts with strategy, not sales. We review your accounts individually, not as a lump sum, to determine which creditors are more likely to negotiate with you, which ones may sue, and which ones have already sold the debt to a third party. Once we have that roadmap, we work directly with your creditors or their attorneys to reach mutual settlements. Every agreement is in writing, reviewed for accuracy, and structured so you can actually afford it, whether it's a lump sum or a short-term payment plan. And here's the biggest difference. If a lawsuit is already filed, we handle it from filing your answer to discovery to settlement negotiations under the attorney client privilege. If you're with a national company, they can't do that for you. You're simply on your own. There's no gap, there's no handoff, and there's no we can't help you if you get sued. You get continuous representation for start to finish with Georgie U law. Step four, common red flags in debt relief companies. So how do you spot the scams? There are five red flags, and I want everyone to listen up. Number one, they guarantee results. Real settlements depend on negotiation, documentation, and timing, not guarantees. Number two, they charge upfront fees. If you're paying before they've achieved anything, it's most likely illegal, folks. Number three, they ask you to stop paying creditors immediately. This is simply dangerous advice because it can lead to lawsuits, judgments, and frozen accounts. Number four, they're not licensed attorneys. Ask them this simple question. Can you represent me in court if I get sued? If they answer no, then you're not getting legal protection. You're simply buying hope. Number five, they pressure you to sign today. Real professionals educate you. Scammers will rush you. I've represented clients who have come to me after being burned by these programs. They've often paid hundreds of dollars or thousands of dollars in fees with nothing to show for except for damaged credit and new losses. That's why education is so important. When you understand the rules, you stop being a target. Step five. What makes Georgiew law different? So what makes our approach different? We focus exclusively on credit card defense and settlement.
