All right, welcome back to another episode of the Flying Monkey Podcast. And today we have a father who is out of Florida, and we are gonna talk to him today about his battle to see his child. How are you doing today?

Hi, Tom. How you doing?

Good, good. Well, same as you. It's it's it's horrible that the situation even exists. Um, but here we are with uh millions of us you know doing this, so that's why we're here to talk about it. So uh tell us about your story.

Okay, um, by the end of 2022, I was um married and living with my former wife and my daughter. I live all my life with them, all my together life, no. Um by the end of 2022, uh I put a petition in court because after seeing uh my former wife alienating my daughter against me for years and years, um, I and asking her to try to solve the situation, uh, doing family therapy, and she was refusing again and again. Um, at some point I decided to go to Kurt and ask for help um to get mandatory therapy. So I went to a lawyer to do the papers, and of course, this is what I'm learning now, because there was there is no money in a petition, in such an easy petition like that one, uh they create a divorce where there was no request for a divorce. And that's when the whole problem started. So right now it's two and a half years that I'm not seeing my daughter in a case with no domestic violence, no abuse, pretty much not false accusations of domestic violence. I don't do drugs, I don't drink alcohol, there is absolutely no reason why I'm not seeing my daughter. So the trick that they use in order to separate from my daughter is the trick that they've been using lately, in the last, I don't know, years, that is getting a guardian of lightning involved. When they get a guardian of lightning involved in your case, they say that they need reunification therapy. And when that happened, when the judge allowed them to bring a reunification therapy, it's pretty much game over. You don't see your kid again.

Yeah, it's funny because reunification therapy doesn't even work. I mean, it's the stupidest thing ever. And you know, they want to pretend it's some big thing. And as we've learned and studied, I mean, there's no there's no there's no training for reunification in university, there's no master's degree program. If they knew anything about learning theory, they would know um it's just an attachment problem that's been the child's attachment's been damaged if they are e if they're even rejecting seeing the other parent. In most cases they're not, um, and they're forced into reunification, which is ridiculous. Um if someone's kidnapped, you know, you don't, you know, if your wife or brother or sister or mother was kidnapped, you know, when they save them, they bring them home. They don't send them to a reunification camp or program where it's the most ridiculous thing ever heard of. So, you know, if parents are separated from their kids, just put them back together, they'll be okay. They'll reunify on their own. It's just, you know, putting them together is reunification, not under the family.

Family courts they use this, it's it's a scam. One, in order to make more money, those to prolong the case until your kid is 18. And then they they move on with the next victim because that's what they're doing, you know.

And all it does is a kid.

Yes, yeah, but they don't care about the kid, they don't care at all about the kid. It's it's a list of their um concerns, what happened to your kid, or the best interest of the child, those are things that they just only say uh in order to cover their activities um for themselves, you know.

Exactly.

And um, I try with two lawyers who they fail on me. Uh and now I'm pro separated. I'm pro se and so who you know.

So Oh yeah, no, of course it is, because they don't want it, they don't want you to do that, because then you don't have one of their their secret operatives trying to pretend to defend you and play the game that they play. It's the same story over and over. Everyone I talk to, and it's you know, the the the majority of lawyers don't do anything but make it worse. And they don't fight for you and they don't help and they don't object and they don't attack the problem. They just fall into the game of the whole system and it just prolongs it. Everyone's making money, and all they're doing is just destroying the kids and the families. You know, it's nuts. So now, so now where are you? You're pro say, doing it yourself. Have you found any support groups that have helped you learn and prepare?

Yes, a year ago, a little bit over a year ago, with a group of um the name me hope in darkness, and and they have a complete different approach. Uh, an approach that for me, in my opinion, it's right. When I had the first interview uh with the guy that um leads um this group, um, I was talking to him and he was explaining me um his name is Dr. Dubri. Um, he was explaining me the process, and at the time he was explaining to me what's going on, I was thinking, wow, this guy knows my daughter and my former wife better than me. Because he was the only one who really um who really view what's going on. Since then I participate in the group, it's it's uh it's a great support for me. They help me in everything, they give me ideas, they they tell me what to do, what I have to do next in order for battle um uh to get my daughter back, but still difficult for me because the system is um I don't know if you can say this, but it's completely corrupt. Yeah, it's completely corrupt, and they don't they don't they don't want the best interest of the child or anything like that.

Yeah, no, I know. When we you know we map out the statistics and we map out the stories and we put them all together, it's the same thing over and over again. And it's just it's ridiculous.

I mean they go against the target parent. They go against the target parent. Because they know that the target parent is gonna keep litigating and fighting to see their kids. Yeah, they're gonna be.

If you're watching a baseball game, you know who's winning the game. You can just watch the game. It's the same thing. Watching this the this entire family court system, it's it's a it's just extremely abusive and out of control.

I think they have no shame in breaking the law, breaking the state statutes, um, breaking your civil uh violating your civil rights, violating the constitution of the United States. Um they work with such an impunity that is um really difficult to believe in a in a developed country like supposed to be the US, you know?

Yeah, well, things have uh declined quite a bit. I mean, it's been happening for a long time. And it it's just you know, yeah, you you sit here and go, how can responsible caring adults in positions of authority how can they do this? I mean, how can you come to these conclusions and these these decisions and let this happen and be part of it? It's just it's it's just so destructive. And it's it's like they enjoy doing it. And they it's the same game plan over and over. Every case that we know we when we talk to people, it's the same stuff over and over. It's gotta stop.

They never allow me to speak. I I in two and a half years, and we have this case open. I never had 10 minutes to say, okay, this is my side of the story. You know? If you read the Florida statutes and the laws and the 14th Amendment and everything, the law is on my side. And that's that's what I'm thinking is they do not, they know the law is on my side. So for that reason, uh, they don't let me speak at all. They don't know my story, they don't know who I am.

Well, they don't care about the story, they care about the money. They care about and then there's I mean, you know, it just appears, you know, in my opinion, that I mean they know exactly what they're doing. And it's just it's it's destructive to society because you're just you're just screwing people up and you're just it's incre you know, it's like I don't know. It's just so traumatic to to live it. It's traumatic to watch it, and if people, you know, pay attention who aren't even in this situation start looking at this and you tell them these stories, they can't believe that it's happening. And then when they see that it is, they're in shock, going, how can this be? You know, what's done?

The threats by by the judges, you know. Yeah, they want me to pay um for my former wife um legal fees when they know they have money, but they go after me, and even if we have an agreement that she paid for her own debt and I pay for mine.

Is that a written agreement or verbal agreement?

SPEAKER_01

Yeah, it's a written agreement approved by the court. Yes, we we we have uh when we divorce, we have a mutual agreement. That's that's how we do it. And because it's me who are is the entrepreneur person, um they put a clause, they say stating that her um debts are hers and mine and mine, always um with the fear that something happened in my companies or something like that. But now they are not acknowledged the the same clause that they put. So they ask um uh the court me to pay um her legal fees, and because I say no, they say, Well, if you don't pay by Monday, um you have to turn yourself into the county jail.

Well, okay, so in that in that instance, just a quick question, sorry to interrupt you. Um so if you have that written agreement, did you not present that to the judge and say, Well, you know, you're ordering me to pay someone else's fees that they they're incurring, that's their problem, that's their responsibility, not mine. And here's the written agreement.

What did the no, they didn't care because I'm pro se and they have a and she has a lawyer that is very close to um to the judge, and that judge I put a complaint in the JQC, in the ADA. He has complaints all over. They could put a lawyer to defend him. Uh, and see me's gonna happen with the new judge that I'm having now that she's taking the same path, pretty much. So I appeal. Yes. I I put an appeal, and the appeal also never ever have a hearing. They never gave me the possibility to present evidence or have a hearing. And they just denied, and they turned the paperwork back to the trial court.

So your appeal was in the same was a state, was it a state appeal and the appellate court?

SPEAKER_01

Well, in the appellate court, uh, I guess it's a state. It's it's in the thirds in Florida. It's a one that I have to. Um I would like to see if I can have a chance to be in other districts, but I heard that it's really difficult. They don't allow it very easy to have your case going to yes, transfer the case.

Yeah, because they lose money. See, that's the thing, they want their money. So if you move the case, they want to move someone else's, even though they're in the same state, the you know, the county wants their money and the local the local courthouse wants its money. That's just yeah, that's it's uh it's so pathetic that that this is what I would like is parents, fathers, and mothers, because we are pretty much 50-50.

It's not that this is happening to men and not happening to women.

It happens to both, yeah.

Uh yes, I would like them to be prepared from the very beginning because most of us um you get married, you have a family, you are not thinking in things like this could happen. So at the very beginning, when you are in shock because of the divorce or everything, and um you don't know you trust the justice, you don't know what's going on. Um they cheat on you, they cheat your lawyer, they they put you in a scam that then it's really difficult to get out.

You know, no, I know. Once you're in, you're caught, you're stuck. It's it's so yeah, that's a great, great point for parents or for kids or people or anyone before who hasn't gotten caught up in this you know scam. Um it would be to to don't do not go to family court, do not hire lawyers to get a divorce. If you're gonna divorce, you know, go okay, you're gonna go to a mediation or mad at each other, you're fighting, you're bickering, you're you're disagreeing. But you know, take a deep breath, step back, folks, and don't go to family court, especially if you have children. Um all you're gonna do is destroy your children by letting these people get involved in their lives. And they're taking the kids away, they're abusing them, and they're just it's gonna destroy them for life. And to fix everything in society, we need healthy, positive, loving, cared for children growing up in that kind of an environment. So find, you know, get a mutual one lawyer to do it, or a mediator, and figure out an agreement and realize that you have to sacrifice and give some things up you may not want to, but do that, agree on it, both of you sign it, have the one lawyer or mediator take it to a judge in divorce court and have them sign off on it, and you're done. You'll save the money for your future homes, your future cars, your kids' uh college funds, your vacations, all the wonderful things, and you can get on with your life, and you're not gonna because all it does is destroy the the kids. I mean, divorce in itself is not a good thing, and it hurts your kids. That itself does a lot of damage to children. But to take them into this setup that they call family court now, with all the mental health people and all the lawyer shenanigans and all the court shenanigans, they just want money, you know, and just want money, yes. When you caught up in that tornado, or it's actually like uh the biggest category hurricane that exists. I mean, you're just getting thrown into a storm and you'll it it just destroys everything in its path.

They don't let you out. I imagine how bad the system is that um my daughter is 16 now, that I thank God that she's almost 18. Yeah, you know, I I think sometimes, yeah.

But she's already been it's already all the you know, a lot of damage.

She um uh she's caught up. She's you know, because of this that you said before, the attachment system. Um for my daughter, it's really difficult to get out of uh her mom's house and come to live with me. Um she's afraid, she's scared, she's trapped. Um, she cannot she cannot do it. She has to, you know, to put up with the situation and she's 18. Yeah I know for a fact, um, I heard that um she's saying she wants to see me again when she's 18 and and really free. And from those things I have evidence, but I never was allowed to um to present it. Yeah, they don't want to. And I don't want to present it directly into the court record um uh because I don't want my daughter to pay the consequences. Um until I have a judge that is fair and a judge that really follows the law, is it's things that I cannot do.

Yeah, that doesn't seem to exist anymore, at least in family court. I mean, and we're seeing that in other courts too, and how things have been other people have been treated with the system, you know. And uh, you know, the other day I just watched a guy who was in jail for 25 years for something he didn't do, you know. And I know someone personally who was put in jail for 20 years for something he didn't do, you know, and they and they finally found out they didn't do it, so they got out based on the evidence of the truth that they didn't do it and they were innocent. And that that's just that's sickening, you know. So the courts, you know, there's so many changes that need to be done in so many different areas across the board, and it just comes down to just do what's right, do what's fair, and do what's best for everybody and and be honest, and we've lost that. It's more it it w it's just it seems to be completely lost.

The same happened with the with the homes with older people. Once you they put you in there the only way the only way to live is dead.

Yeah. You know and and that the it's funny you say that because family court's kind of the same thing. I mean you just you're not locked up in a cage, but yet you're still locked up in a cage. They just have you you're incarcerated basically, quote unquote. By being caught in this system. And and the and the saddest thing about it, and for people who don't know or aren't in this situation, I mean, I don't know the numbers because a lot of countries don't keep track of statistics at all. And but I, you know, I've seen posters and stuff on on other advocacy websites and pages where you know 30 30 people are committing suicide, 30 parents that are being kept from their children for no reason whatsoever, they're committing suicide because of the hell they're being put through in the in the family court system. Yeah, 21 a week. But so if we if we've seen that, it's still worse than that.

One a week is crazy. Well, yeah, it's don't even tell the court that you feel depressed or or something like that, because they're gonna use that so in order you not to see um your kid at all, because um they use any excuse, you know, to separate from your kids. And um yeah, they don't feel responsible that you are depressed or whatever because of the job that they are doing.

Yeah, oh exactly. And that's you know, that's why, you know, when you're looking at it from outside, I mean it it seems intentional. I mean, they just want a label, and that's why they bring in the so-called mental health experts. It's just it's absurd. And they use that to get someone to say something, and then they say, Oh, okay, we got it. Here you go. Now you're done. You're the bad person, you're screwed up, you're a mess, you've got this label. You know, and what's depression? I mean, w why do we have to use that word? You know, uh uh you know, it you know, you're sad.

You feel you need at least two uh you need um Um more than one person uh for you to be crazy or have mental health issues. You know, if you are alone in an island, you don't have mental health issues.

Yeah, but you know, you're exactly right. Um, and it's like, but you know, for millions of years we didn't need it, we didn't have that those mental health baloney. Um, you know, it's emotional more than anything. It's how you it your feelings are emotions, you know. It's not some goofy thing happening in your brain. You know, it's it's it's someone causing it.

In my case, they steal the most precious things that I have that was my daughter.

That's right.

You know, and the fact that they cannot explain because if they had something on my record that they say, listen, Gonzalo, you cannot see your daughter because you are violent or whatever, I I would understand. But because they have nothing, they don't allow me to talk. Yeah, well, it's how they continue to go with it with persecuting you, and it it is, it's it's and the mental health that they recommend always they act like lawyers, they ask you for a retainer. When you when you go to a psychologist, do you pay retainer? No, but this one, yes, the runification therapy, they ask for retainers, yeah. Five, six, uh until eight thousand dollars retainer.

That's ridiculous. Well, we can you and I right now could take a parent that's been alienated from their kid, and I guarantee you, because well, we've studied, learned, and kind of been trained in it as well. In in behavior and and learning, behavior, not in some foo food. It's all about behavior in a book, and then in some of you know that they want to think and an opinion. Um, we could fix that in minutes, you know. Yes. It it's it's you know, the tests were done, the studies were done, and how to do it with primates in uh and the uh the other problem that most of the parents are gonna find is that um uh when they see you in a weak position or something like that, many people try to take advantage, you know.

There are very few. Like I feel, for example, in this group that I am hoping darkness that they really try to help. Most of the places they just want either to make money out of you or take advantage or introduce you to someone else that is gonna charge you and they get a cut. It's it's it is difficult to me.

Yeah, no, exactly. And you know, and and to be honest, I mean, yes, everyone needs to make a living. So if someone's gonna be doing a job for you and working at it, um, there has to be some sort of compensation. But it has to be that I understand, but exactly. But it has to be reasonable, it has to be honest and ethical. And we've lost being honest and ethical.

That's that's exactly I don't care even if it's expensive right now. But you are you gonna do your job? Are you gonna defend me? Are you gonna, you know, I present you all this evidence? Are you gonna do something about it? You know, it's not happening.

And they're not because they just they don't care, they just want to get paid and pretend that they it you know, it's about their egos. It's like that, you know, you just see all these things on on the internet too, all these advocacy groups, and I see all you know hundreds of thousands of people joining a page, and all they're doing is putting up stupid comments and making stupid videos that have nothing to do with fixing the problem. Yes, you know, and a few times you know there'll be somebody that posts something that's an example, but that's still not helping. I mean, a lot of these parents they're in dire straits, they've been totally debilitated and beaten down by this this process and the system, and they can't think straight, they can't sleep well, they can't focus. Um, and that doesn't say that they can't do it 24-7 with all things. So when it comes to the case or the situation, um i there's this hard hard it's hard to function and think clearly about it and to to voice exactly what you want to say or do the things you need to get done. When it comes to washing the dishes and maybe you know making phone calls or doing the grocery shopping or cleaning your house, those things can be done. So it's like it's the weirdest thing in the world how the trauma affects you. I mean it's just it it freezes you. And we've seen it said before too, where like you know, you're you're uh you're grieving a living child. So your child's alive, but it's as if they've died because they're not you're not allowed to contact them, they won't let them talk to you, and they take time. And alienation, you know, they they use the word parental alienation. Well, it's a parent who is alienating the child from the other parent. So that's parental alienation. It's not something magical in the brain, and it's not something that you know people who can't prove anything can you know prove uh one way or the other, which is difficult, but it's just based on their behavior. So when the behavior changes, then obviously there's a situation going on, and what's caused that change? Well, the place and the space where the child is and and the way and the people they're working with, you know, therapists, you know, little kids in therapy, but it keeps getting worse. Well, what good is that therapist? It's that the therapist is useless. I mean, there was a video going around and now it's been taken down. I haven't seen it. But it was an interview with psychiatrists in at a big huge convention of psychiatry and mental health, and they were asking everyone, uh the most well-known ones in the group, they were interviewing and saying, Hey, you know, how many patients have you cured? And every single one of them told the truth. I haven't cured a single patient. Well, what does that mean? What does that say? That what you're doing doesn't work, it can't work, and it will never work. So what's the point?

Yes, my my guess is also first doesn't work, but secondly, they don't even try to make it work. Because what I'm seeing so far is that they try to prolong and be and do billings the same as a lawyer. Exactly the same as a lawyer. Exactly.

And so whether and let's not put everybody in the box because there are good people out there with good hearts with that could care and and and want to make a difference and want to help people. So they're out there, yes. But you know, you you go you go ask for help and you find people that are like that that are actually really good and willing to work at it and want to tell the truth, but then they don't take the case because they they know what they're going up against, and they and they refuse, they refuse to to call out their colleagues and say, This is not okay. They just sit back and stay quiet, which makes them complicit in this abuse as well. And it's a sad state of affairs, my friend.

Um, once I went to uh pro bono meetings of lawyers when uh there was one that I would like it to retain, but once I told her that um there was uh request for reunification therapy, she told me no, there's nothing that I can do there. Imagine. And she didn't want to take the case. Yeah, and why is that? Because they're gonna forget. Because she she knew, she knew, she told me now that they are trying to um put you in front of reunification therapy is over. They're gonna prolong it until your daughter is 18. And she was honest and didn't want to get the case, and knowing that probably would be very difficult for her to bring results. This is a lawyer.

Yeah, well, she was honest. That's a that's a wonderful thing. That's a wonderful thing. You know, it's uh yeah, it's it's this is just this whole thing is just insane. It truly is. So where's your case again?

I have uh third judge in my case. Uh this one I present a couple of um motions. Um I asked for um um I asked to be able to talk to my daughter over the phone five minutes. Imagine when I have I I supposed to have her living for me 50% of the time talking on the phone five minutes, and I was denied. It's not only that I'm denied, Tommy. I never ever had um the chance to have imagine. I don't need them, no, because it's no uh it's a regular uh family relations case, not uh uh domestic violence case. Um supervision supervision visits with a police officer, yeah, supervised visitation, they don't even give me that. So imagine. Isn't that crazy? I mean so the court is uh the uh number one abuser.

Yeah, yeah. Well, it's all around the world right now and all the Western countries. You know, that's that's that says something too. Um when it's the same game plan all over and the same thing, as we've been seeing with a lot of other things that happen the past few years. Um it's not special.

But in the US, I think it's a little bit more extreme than other, or or at least in English speaking countries. Um one thing that I was born in Argentina, one thing that I um there is a difference um here, of course, there is corruption in the justice like everywhere. But if the judge feels the judge doesn't do things hundred percent wrong, um feeling that they have impunity, that nothing is gonna happen to them, you know. Um they bend the law, but they don't break it 100%. Like this is my feeling is happening in Day County.

Yeah, yeah.

So the good thing of this process for me, I I I don't have more fear like I used to have at the very beginning. At the very beginning, I was scared what is gonna happen, oh the judge, but now you know what you know what they're gonna do.

Yeah, you know exactly what they're doing.

I know what they're gonna do. I I I lost respect, to be honest, because if I don't see honesty, if I don't see um them abiding to law, you know, violating and breaking laws all the time, um, you lose respect.

SPEAKER_02

Yeah, no, I am, yeah, I know you do.

SPEAKER_01

But this is how I feel.

Yeah, well, no, it's your feelings. This is these are your opinions, and this is your experience, and this is your story. So there's nothing wrong with it. Um and I'm the number one abiding to rules. Sorry, say that again?

SPEAKER_01

I I'm the number one abiding to rules. I I I never listen. I've been over 20 years living in the US. I never had a fist fight. Never the police, a police officer come to my house, never a neighbor complained. And I live in a I used to live in a condo. Cameras all over, nothing, you know. So I I I still don't get why I cannot see my daughter.

Yeah, that's just because they don't want you to, because they know what damage they are.

They just want to prolong the case.

SPEAKER_02

Yeah, well, that that, but they also trust me, this this is they know what they're doing, otherwise, they wouldn't be doing it. It wouldn't be a consistent. I mean, it's just over and over, it's the same thing. It it's obvious. And so when you're looking at it, you can see it, and it's intentional, it's totally intentional, and they know it's gonna screw up the kids, and that's gonna screw up society, and that's gonna feed more into their you know, their mental health baloney and their billable hours, and over and over. It's a lot of money and control when you've got damaged, traumatized people. They're I mean, humans alone simply are just so easily manipulated. I mean, look at all the things that people believe in, and why do they believe in it? Because they were told to believe in it.

So my other advice for parents like, don't be scared, don't be afraid, keep fighting, because um that's what they want. They want you to be scared. If they ask you for 20, 30, 50,000, you go right away and you give it to them. Um don't do that. Don't do fight for your rights and um and keep going. Yeah. Because most of most of the parents they get scared and and they quit, or either they quit trying to see their kids, or or they make yourself.

Yeah, they either kill yourself, you give up and walk away because you can't afford it and they destroy everything you got, or you're so afraid that they take advantage of it and they take your money because you're so okay. I have no other choice. I have to do this, and what you know, what do I do? What do I do? And you don't know, you don't know what you're getting, even. You you just are f blindly believing that this person's gonna do their job and help you because they're a lawyer, and you know, it's a waste of money. So, where do you stand now? Um, yeah, exactly.

Well, now um probably once I finish this, I'm gonna start preparing my uh next motion. I'm gonna file a complaint in the judicial qualification. Um I don't remember JKC uh for this new judge.
