In about eight minutes I'll tell you who can lawfully detain someone in Indiana, when a stop becomes criminal battery, and what to do right after a confrontation to protect your rights or your business. Okay. Who can actually detain someone? Short answer some private people, but not like police. Here's what that looks like in plain talk. Stores have what people call shopkeepers privilege. If an employee reasonably believes someone just stole merchandise, they can detain that person briefly, and reasonably to investigate or call police. Sounds simple, right? But the words reasonable and brief do a lot of work. Private security? They act like private citizens. They can't pull out police powers. If they use force beyond what any citizen could justify, that's risky, criminally and civilly. And a private person can attempt a citizen's arrest in tight circumstances, but it's a high risk move. If done wrong, the person doing the detaining can be the one facing charges.

When Restraint Becomes Battery

So when does a restraint become battery? Legally, battery is unwanted touching that's harmful or plainly offensive. Think a shove that leaves a bright bruise, a wrist twisted until someone cries out, or a grip so tight a phone drops. It's not only physical injury. Offensive contact, contact a reasonable person would find insulting or intrusive, can be enough for a charge. Prosecutors look at the contact, whether it was intentional, and whether it hurt or offended the person. Here's the tricky part intent. If a clerk grabs someone to investigate a suspected theft, that shows an investigatory purpose. But if the force is unnecessary or disproportionate, a twist, a choke, dragging someone into a back room, that intention doesn't excuse the force.

So what do you do in the moment? If you're stopped as a shopper, stay calm, ask clearly if you are free to leave, avoid sudden moves, and if you feel endangered, say so and call nine one. If you can safely leave, do it. If you work in retail or security, use the camera, call police, and avoid physical force except as a last resort. Keep any detention short and in view of others. Train staff on low force containment and clear procedures. It protects everyone.
