FTC’s draft AI rules could force explanations for job & loan denials

The FTC just put America’s biggest AI “black box” decisions on notice. If you’ve been rejected for a job, loan, insurance, or benefits by an algorithm, these draft rules aim to give you an explanation and a way to challenge it.
On Sept 12, 2026 the FTC published draft nationwide rules for automated decision systems and AI workflow automation, covering hiring, lending, healthcare eligibility, and workplace monitoring. The proposal requires meaningful explanations, human oversight for critical cases, bias/impact audits, and contest/appeal mechanisms, with potential penalties up to $50,000 per violation.
