Re Asdew, before Justice Treston, and the new Trusts Act earns its keep. The court takes jurisdiction over a trust whose proper law was elsewhere, through the trustee within the jurisdiction. A photocopy can stand in for a lost original deed where the indicia of authenticity are there, signatures, seals, the stamp duty notation. Inserting a governing law clause is a management power under section 178, extending the vesting date does not disturb the substratum and can be authorised under section 179, and transposed names are cured by rectification on the settlor's intention. Urgency mattered, the vesting date would have triggered substantial tax and transaction costs for a continuing family business. Alongside it, Genuity against IG Power, a contract construction judgment that works through text, context and purpose, deploys the maxims, the express mention of interest in one clause excluded its recovery under the general costs clause, and the specific provision prevailed over the general. Non publication orders in an extortion prosecution, and the power reaches beyond the complainant to third parties whose exposure would deter future complainants from coming forward. The deterrent consequence can rest on inference from the basic facts and ordinary human feelings, direct evidence is not required. A magistrate who prompts a party to consider seeking an order and prepares in advance is being prudent, not prejudged. And orders made under implied power during a proceeding do not bind all jurisdictions for all time, they remain open to variation by the court later seized.
