So you have been working on this bill. The Senate has been working on this bill for over a year. Do you believe it can get across the finish line this week before you leave? Or is this something to attack when you're back?
SPEAKER_00No, ma'am. This is something we should have the first vote before we leave without any question. Uh John Zune has an opportunity to teed up for a vote before we leave. And frankly, we'll be here longer than just the next two days. We might be here much longer. So the good news is we have the time to get it done. This is in the best interest of protecting consumers and allowing innovation to happen here in America. Really important time for us. We'll get it done. Republicans are coalescing, and that's great news. That'll bring Democrats along.
SPEAKER_06So, Senator, is it still the same issues? I know that President Trump has shown a willingness to accept language on ethics in the bill. So we've gotten that from President Trump. Was that enough to placate the Democrats who don't want the president to uh benefit from any crypto business, or is it largely what Josh Hawley is worried about, and that is what the banks have to say about the crypto platform. What's holding it up?
SPEAKER_00Well, Maria, the truth of the matter is the Democrats have been stonewalling for a year now. Every time we say yes, they move the goalposts. This goes back to President Obama, President Biden. We continue to see the goalposts move. Democrats have that as an ultimate strategy. Here on the area of clarity, what we're seeing are the same kind of stalling tactics they've been using for more than a year. When banking committee Republicans coalesce around the bill, everyone getting in line, then we were able to get Democrats to come aboard. We'll do the same type of strategy once we have the vast majority of Republicans saying yes, I believe the Democrats come to the table and find a way to yes. They don't want democratization, it appears to me. If you want democratization, if you want single mothers to have more access to their resources immediately, you want cryptocurrency digital assets to blossom here at home in America. Democrats can join us and make democratization a reality for everyday working Americans today.
SPEAKER_03Good morning, everybody. Hello, and welcome back to another episode of your favorite crypto news-related channel. And today is a very exciting episode for the Good Evening Crypto community because we're joined by the one and only John Deaton, the attorney who represented over 75,000 XRP holders just a couple of years ago. Well, now he's running as the Republican nominee for the Senate seat in Massachusetts, and we couldn't be more excited to have you on our program this morning. And I think the timing is almost divine because it is Clarity Act Week. We've been calling it that. And now you're here joining us on this Thursday. So before we even dive into the details, how are you feeling this morning? And what's on your mind on August 6, 2026, in the midst of all this chaos, Clarity could be on the way.
SPEAKER_01I'm doing great, guys. Thank you for having me. I really appreciate you. Hi, everybody out there. I'm feeling great. Uh, you know, this Clarity Act thing, it just goes to show you how broken our Congress is. The fact that uh over one out of four adults in America owns crypto. We're talking somewhere between 50 and 75 million Americans have exposure to crypto. If you consider the Bitcoin ETF, it's higher than that, no doubt. And so the fact that they're dragging their feet this long on something that is overwhelmingly uh good for America, good for consumers. I mean, just think about this. After FTX, uh after even people that are watching are familiar with LinkedIn, what's going on with LinkedIn, imagine right now, if if Coinbase, the largest exchange in America, were to file for bankruptcy, it would be a question of whether or not my account, your account, would belong to Coinbase or belong to us. The Clarity Act would establish bankruptcy protection and make it the law that consumer accounts are consumer property. That mere fact alone, that consumer protection alone warrants um supporting and voting for this. And so I'm just hoping that Thune, the majority leader, forces a vote. The worst thing that can happen, guys, is that they let this die on the vine and say, oh, we'll get back to it after the August recess in the fall. The closer we get to the midterm elections, the less work's gonna get done. But at a minimum, if it's gonna die, make every United States senator go on record whether they support it or they don't support it. And let the Josh Hollies of the world on the Democrat side as well say, no, my job is to protect the incumbent banking system. It's not to protect American people, not to protect the American consumer. I'm worried about the banks, the banks that actually are the predatory banks that have victimized regular American consumers for decades. I'm gonna protect them and not the people. Let them go on record so that they could feel the consequences later.
SPEAKER_03And we went out on a limb maybe six or eight months ago, John, where we talked about all we can ask for at this point is a vote. We want to hold these people accountable. We want to figure out who's working to bring the digital asset class forward and who's doing everything they can to make this about Democrats versus Republicans. And unfortunately, we are going to be playing a very brief clip here from Elizabeth Warren, your former opponent here. Now, guys, I do want to give a big thank you to Mr. D. This is a brand new clip from Elizabeth Warren that just came out earlier this morning. And one of the biggest problems she has with the crypto bill is it helps the crypto industry. That's not my words, it's hers. Here it is.
SPEAKER_07Okay. So um, you're opposed to the Clarity Act. Do you think there's anything that could happen to change it so that it would be appeasing to you in any way?
SPEAKER_04Of course. We need crypto legislation. I've been saying this for a long time. I put together a crypto bill. Like crypto legislation that has been written by the crypto industry to protect and advance the crypto industry, and that helps Donald Trump make his next $1.4 billion on crypto scams, and that puts our national security at risk, and that puts our economy at risk, and it just encourages cheating people. That's not good crypto legislation. That's just a big giveaway to this zillion-dollar industry. Let's face it, crypto thinks they can buy a Congress that will do what they want. That's what they're trying right now out in Minnesota. That's we have to fight back against that.
SPEAKER_03And she said that this bill should be dead on site, John. Now, I'm gonna keep my opinion very brief. We know the deposit flight narrative was proven false by the data. We have something very similar here happening with the Trump issue, where if Elizabeth Warren is really about shutting down Trump's unethical behavior, the best way to do that is to regulate the industry. If clarity does not pass, President Trump can doing, can keep doing exactly what he's doing and more. But I'd love to hear your response.
SPEAKER_01Floor is well, let me first say, guys, thanks a lot. Just when I was recovering from the PTSD, because let me tell you something, I've overcome poverty, I've overcome cancer, I've overcome the Marine Corps training in boot camp, but nothing in life prepares you to lose to Elizabeth Warren and what it does to your ego. So thanks for uh setting my PTSD back. But listen, you know, she says that she has uh she wrote a crypto bill. Uh well, guess who wrote the crypto bill? She didn't write it, the banking policy institute wrote it. Who's the chairman of the banking policy institute here in America? Jamie Diamond, CEO of JP Morgan Chase. Her crypto bill actually banned the self-custody of Bitcoin and XRP or Ethereum or any other crypto here in America. If her bill would have been passed, the only exposure that regular people could have to crypto would be through ETFs, through the BlackRocks and the Vanguards and the Morgan Stanleys and Goldman Sachs of the world. Elizabeth Warren is the single biggest bank lobbyist in America. I've said it for years, I'll say it again. Uh, so everything she says is absolutely a lie. This is the best consumer protection that we would have in many years. Actually, for me, guys, the Clarity Act doesn't go far enough. Like, I want you and I to be able to get yield from passive holdings of XRP or Bitcoin or Ethereum or whatever is the cryptocurrency of a person's choice. Why shouldn't we be allowed? And think about this: I'm a capitalist, I'm a hundred percent capitalist through my body. I come up from poverty, food stamps, and welfare. A capitalist society, you either innovate or you die. You either adapt with innovation or you die. And so why is it the job of these US elected officials to protect the incumbent banking system? They have the ability to adapt this technology, innovate, offer staking rewards and all that. But I realize that you have to compromise. So, you know, I wish the Clarity Act went further on that kind of stuff, but we need a bill. It's better than no bill. And the fact that um uh we're struggling this long, this hard to get something that's so common sense is beyond me. It shows you how broken our uh Congress is.
SPEAKER_05Well, John, it's either that or more importantly, it shows you how our Congress is. First of all, if you had a hypocrisy meter, it would have been broken with the with the thing she was spewing out because absurd wrote this crypto bill. You don't think the pharmaceutical industry didn't write pharmaceutical bills? You don't think the banking industry hasn't written the banking bills? Of course that's how it works. So she's in her line right to her teeth. Only because in this case it's in her favor to do so, and there's nobody on the other side to counter-argue it. But that's how this stuff works. Unfortunately, our system is set up, and John what what kills me is the reason why we don't have this bill passed, because this is my opinion, is because there's several banks that are still anti-cryptible, don't want it, and they have enough senators in their pocket, right? You said why can't we get to vote? Well, because we know why. Because these senators aren't funded by you and me and the American people, they're funded by the banking line. Right? That's where they get their funding to be able to run, and they're not gonna and they're being they're being told what they can and can't vote for, and that's why this thing is thinking so hard, and you keep hearing all the senators and are loomis, they keep moving the needle because they thought, hey, we had something, and then the needle moves. Why? Well, that tells me that the banking industry just doesn't want there's certain dangers or certain I should say certain banks that just don't want this to happen, and I think that's why we're getting the pushback. Now the question I have for you, John, is do you think now that finally I think the the the problem is they're giving them some state AG enforcement options? And now that that's in there do you finally think we're close enough where we're gonna get to get this thing passed? Or do you think the banks are gonna be like, ah, you know what, let's keep pushing more, we'll just push this thing into next year because then they know it's not gonna happen. And I'm I hope that doesn't happen, and I think at a minimum we need to get a vote just to get these guys on the record. So hopefully Thune is gonna do that. If not, he's doing a disservice to everyone. But I'm curious of your opinion, if you think this is just the banks, the anti-crypto banks trying to stall, or do you think we're finally gonna get this thing now that we have the state AG enforcement option?
SPEAKER_01Well, it's why when I was at the XRP uh conference, I said that if we were gonna get clarity passed, that the best chance was before the end of May, and that when it went past May, the closer you get to the midterms, the the more politics come into play. So, for example, you know, that political argument out there that, oh, Trump's aren't big on Bitcoin and crypto and Don Jr. and and Eric Trump with World Liberty and all of that. And so therefore you're helping Trump get a legislative victory, right? They don't want to see Trump do a legislative victory lap for accomplishing something over be just on the eve of the midterms, and so there's that politics in play. Uh that's why the only way we're gonna get this is if you hold a vote. Fair shake, that's one thing that they can fear. There's $200 million or $195 million that Fair Shake has in a in their pack. So if a Democrat or even a Republican, instead of hiding and trying to play both sides, oh, I am for clarity, but we needed to work out the ethics. And once you get them on a vote, they're gonna have to be faced with that decision. I'm up for re-election. Do I want to feel the wrath of crypto voters, the wrath, the fair shake, and the the and and make my race much more difficult? So that's the best chance. You know, you even heard on the clip from uh from uh uh Tim Scott, where he said that uh if we get a vote, they're they're becoming more optimistic because it'll force those people to take a stand. And because you really, what are you gonna say about Trump? You are listening do I like the fact that President Trump made $1.4 billion in crypto? That's more than Coinbase made in profit. Uh no, uh, I've been critical of the Trump meme coin. I've been critical of all mean coins, first of all, but I've been I've been critical of the Trump meme coin from the very beginning. But the reason he's been able to do it is because we haven't had clarity. And and just think of Washington logic. I don't like something that happened that if this bill was in place wouldn't have happened, but I'm not going to vote for it because I don't want it to happen what already happened, when you're gonna leave the the status quo where he can do it even more. Like that makes no sense. And so the only chance we've got is if Thune forces a vote.
SPEAKER_03So here's where it gets interesting as well, John is that I'm thinking everybody knows how slim a lot of these elections are. And there are 70 million Americans. You said one in four American adults owns crypto. That's 18-year-olds, that's college students, that's retirees, that's parents, that's children. Everybody has exposure to this digital asset class. And it's evolved so much since the end of 2024 when it went from this anti-crypto policy being very popular, the anti-crypto campaign that was led by Elizabeth Warren, it had a lot of supporters, a lot of misinformed people out there. But it's a different ball game here in 2026. And a conversation that I would love to get into with you is why it's important to have pro-crypto politicians like yourself representing the industry in Washington, D.C. Because one of the things that I don't think we have right now in America is somebody like yourself who's in DC, labeled themselves as a pro-crypto politician, and also is coming from a democratic state like Massachusetts. Now, everybody who watches this program knows I moved from Florida to Massachusetts at the end of 2024 to be around family. It wasn't because of the policies. If anything, the policies of this state are what made me hesitant about coming home. But it's been one of the best decisions I could have ever made. And so I want to play one brief clip here before we get into that discussion, guys. We already got over 2,300 live listeners here. If you're having fun, smash that like button. But with that being said, here's a brand new clip talking about if Democrats are forced to cast their votes, we can see a very different picture unfold over the next few days. Here it is.
SPEAKER_02Speaking to some folks in DC yesterday, it looks like we finally got something around ethics, which is the big holdup because it's it's politics, it's a political season. If we can get to a vote, it's I think it'll be very interesting because right now if you're if you're Chuck Schumer, you're looking at the elections midterms, you want to take back a majority. It's gonna be hard. And these races are so razor thin that if there's anything that pushes the election in any jurisdiction in one direction or another, we care. So I think that there's a lot of um math going on right now, uh electoral calculus, if you will, um that's gonna really factor in because look, like it or not, Fair Shake has been very effective in the past.
SPEAKER_03Not only have they been effective, John, they're undefeated 48 for 48 in 2024, as you understand. So I think that's a phenomenal piece of data in and of itself. I did want to make sure I reference this as well. I thought it was so funny that Elizabeth Warren was talking about the crypto lobby thinks they can control the industry with their money. What's the banking lobby doing right now with the Clarity Act? But floor is yours wherever you'd like to take it.
SPEAKER_01Yeah. Well, uh Chris, that was who was being interviewed, a good guy uh on Scott's program, uh, is right on point. I think it's gonna be close. And imagine if you are the if you're the one or two votes that stop clarity from happening, and you're in a competitive race, that's gonna put a target on your back. Let's take Massachusetts to give everybody some perspective. Massachusetts is has 7 million people, and what I've been told is that there's somewhere around 1.01 million people that own crypto. So it's one out of seven. If you strip out the the kids, then it's going to be consistent with one out of four, just like other states, right? As far as adults. But if those million voters show up and vote, um all I need to win is one point. I need the same amount of votes I got uh in 2020. The average midterm turnout is 2.5 million. I got 1.35 million votes. So if I were to get those same votes, I win. That's for sure. That's the math. Imagine if those million crypto voters show up, the 300 to 400,000 veterans show up that would favor me over Markey. And you could see that even in a blue state like Massachusetts, that's considered so blue, uh, it could make the difference in election. Uh absolutely. And that's gonna play out um uh all across the board. There's no doubt that that crypto helped put Trump and the Republicans in office because the Democrats made a mistake of allowing crypto become a bipartisan become a partisan issue because of their hatred for Trump, because of their TDS of Trump. And you guys know I'm not a big Trump guy, but because they hate Trump so much, they allowed crypto to become a Republican thing or a Trump thing, and it's an American citizen thing. Listen, the last thing I'd say about it is people are struggling. You know, when I was young, part of the American dream was to buy a home. Well, and if I worked when I worked my second job, all right, I was saving down to buy a house, or I was saving for law school. Now people are working two jobs to make rent and pay the electric bill in Massachusetts. They can't afford a home. A starter home is $600,000, okay, in Massachusetts. So the tokenization of assets is a way that you could achieve things today uh that you that have become uh unaffordable. So the fractionalization of real estate, you could be in an apartment building, the apartment building is is tokenized and it's on the blockchain, and you own a token that represents a half a percent or one percent of it's allowed the American dream to continue. And so it isn't a partisan thing, it's an American thing.
SPEAKER_03Totally agree with that. And I want to actually elaborate on something once more because you were asking about, or sorry, you had referenced that one in four U.S. adults own crypto. Look at how many Americans have reached out to their senators in just the last couple of months: 25,000 in Arizona, 100,000 in Florida, 32,000 in Pennsylvania, New Jersey had 34,000. There are a lot of voters who really care about these issues. And think about it: if you have a hundred thousand people in Florida making the phone call, there's probably a million people who are tracking the issue inside that state alone. And so I vehemently agree with the point that positioning yourself as a pro-crypto politician will benefit a lot of these participants in November. Now, I want to ask you a question because I think a lot of our listeners just don't simply understand. If you were to win the Senate race and you were to be working alongside Elizabeth Warren, how would that impact discussions like these? Would you also be, you know, doing interviews like we played from Elizabeth Warren talking about these things? How does that process even work? Would you be working together? I just don't have the insight.
SPEAKER_01No, that's a great question. Well, first of all, everyone watching um is more sophisticated than say your. Your average folks outside of crypto. Do you know that when uh I talk to a state legislator? So someone who's in the state legislature in Massachusetts, do you know they asked me questions like, well, isn't Bitcoin and XRP or whatever, John, used by Hamas or Hezbollah or terrorists or drug lords? They're asking questions that you and I were addressing in 2015, 2016, right? A decade ago, we we were addressing those. And that's why Elizabeth Warren is so effective, unfortunately. She knows how to control the narrative. So she'll say things like it's just for illicit purposes, then she'll get Jamie Diamond to say the same thing in a hearing. And that's what people learn. So getting someone in office who can counter that is important. As far as working with her, listen, that a U.S. senator's job is to have one test. Is it good for Massachusetts in America? If it is, you support it. You could call it liberal, you could call it conservative, you call it progressive. I don't care. I don't care who the president is. If it's good for my state and my country, I support it. And if it's not, I don't. And so uh I think I would be very effective at countering her gaslighting about crypto. See, because she wants, and and just so everybody understands what Elizabeth Warren's future vision is, I had a hard time figuring out why she was so anti-crypto. If you think about crypto, progressives, liberals, people on the left, you think they would gravitate to it. The democratization of giving people who normally don't have uh access to assets, assets that can appreciate the only people that have done really, really well in America since the 2008 financial crisis are people who've owned things gold, real estate, stocks, bonds, bitcoin, XRP, whatever. So giving people more access to appreciable assets is how you get people out of poverty. It should be a left thing, it really should be. Like, uh, it's because Elizabeth Warren wants there to be five major banks, a consumer-based CBDC that we can control, that the government can control. And that's a future that you know is a is George Orwell's big brother coming to life. And so that's the that's what motivates her. She wants to control the banking industry uh through uh and have a CBDC, and and that's a disaster. So uh having someone in office that can counter that is imperative.
SPEAKER_03You know what's great, John, as well, is that in this race, you're a young man. Everybody you're competing against, you've got 25 less years than than they do. And I think what's really interesting about that, and we had a brief discussion about this, is that there's actually a really big disconnect between the baby boomers and what's happening in the crypto space because it's just so different from the world that they grew up in. And it's so different from the world of even back in 2012, 2014. We're now in the first stages of a digital era of finance. And I think it's it's unrealistic to expect somebody like Ed Markey, who's 80 years old, he's been massively successful, he's been a politician for 50 years, extremely popular. Why would he learn these new things? He's at the end of his run. So for me personally, just to give my message and I guess my a little endorsement here, one of the reasons that I'm so excited about John is that I've seen not only that you've stuck up for the everyday Americans with the XRP holder narrative, but also your opinions are constantly growing and evolving. And I think that process is going to be really impactful in a state like Massachusetts, where it seems like our most important politicians, they're unwilling to learn about this issue. And every time they do, it's to the angle that this is for the banks, this is for Hamas, this is for nefarious players. What about good, hardworking Americans who own a little bit of Bitcoin and can't afford a home? What about college kids who get exposure to these ideas and they bought some XRP four years ago, they've made some money, they're excited about the asset class. I think that's the majority of token holders. And I think that crypto is gonna become this everyday, every American type of issue. We're just on the cusp. And I'm so excited about the Clarity Act officially getting a vote, even if it doesn't pass, because this is gonna shed a lot of light on the industry. And it's gonna, it's gonna, I how do you say this? Like it's gonna shed light on the people who are really holding things back behind the scenes. And that's why I'm excited to get some transparency. SPEAKER_01No, no, listen, I appreciate it. To everybody out there, listen, I put in my own money as much as I can afford. So even if I know times are hard, even if it's 10 bucks, uh, if you can help out, even if you're not in Massachusetts, it's a U.S. Senate seat. So every decision on foreign policy, look at the Clarity Act, that affects every state. And if you had a senator who understood it and voted for it, uh it would help. So it impacts the nationwide. So if I've done anything that you like or support and you can throw 10 bucks, 50 bucks, 100 bucks, or more, please uh do so. We we can win this race. Um, even a public poll came out by the University of New Hampshire that has me up uh amongst independents against Ed Markey. And since 67% in Massachusetts are unenrolled, aka independent, we've got a shot. Uh I have an internal polling that has me down five points with 15% undecided. So this isn't like the Senator Warren race. I don't have a primary opponent. We got a real shot. And so your support, uh, I appreciate you guys, and anyone out there, I appreciate you.
SPEAKER_03And Johnny Crypto, people may think I'm exaggerating. This is who Ed Markey is on screen, and congratulations to him. He's had a phenomenal political career, but I gotta admit, I am rooting for his opponent. And somebody else has shouted out the idea that you were in the Marine Corps. So thank you so much for your service, John. One thing I did want to break down all throughout today's episode, guys, and we are approaching the 30-minute mark, so we're gonna let John run after about five minutes here. SPEAKER_05Well, it's more so of, you know, I look at it this way, John. We absolutely need we, meaning US citizens, absolutely need somebody like you in the Senate, right? I mean, as as Ab said, you're gonna be one of the youngest guys there. Which you're looking at. I mean, we got these old goats in there, and I'm not, I don't mean to be disrespectful, but they just don't even understand the technology, John. They don't understand what they're even voting on. And yeah, look at this old guy, right? I bet you he couldn't even explain what a crow what what uh what a cryptocurrency even is, right? So the point is that the industry needs you, the people need you, so I'm very grateful that you're running. Uh, I encourage everybody to please, you know, consider donating for you, you know, for John, even if you're not in the state of uh Massachusetts, because as you said, this is a U.S. NFC, and we need better representation. We need voices who understand this and can educate other senators, right? And you'll be able to have that ability, John. If you're sitting there on the floor, you're gonna be rubbing shoulders with all these guys, right? And you're the type of guy that's willing to go across the aisle to shake hands and make it work together. That's the most important part. So I'm rooting for you. Five points is not that bad at all, especially considering you know, I know abs and I we've played some some screenshots of videos here where you can see there is uh I think it was by state abs. I don't know if you had the numbers of how many voters are crypto voters per state. And there's a good chunk of them out there, right? So it can definitely, I think, make a difference this year. And John, I hope to God that they do that Toon brings this thing to a vote on the floor. Because at a minimum, let's just get them on the record, let them vote, so then again, that will then be used against them. I think I think against the crypto industry. And that's why I think the Democrats are fearful to vote. I don't think they want this thing to go to the floor. They don't want this thing to happen. But um, but in your your opinion, John, I guess as we leave you here, I'm just curious. If you had a pick, if you had a pick, do you think we get the Clarity Act this year or not? What do you think?
SPEAKER_01I have to say, unfortunately, if I had to predict, no, but I wouldn't be surprised if he forces a vote that that we get the votes, that we get the 60 votes. Like, um that's why I said it's the only chance. And uh it's up to Thun to get that vote on the record. Because I think with the 200 million fair shake and everything that we've talked about, the stats, the cause of people, these elected people, the one thing they fear is money from the other side and voters. And if they piss off the voters enough, they'll be worried about their own skin. And so I think that would force them to do the right thing and vote for the bill. So um it's no, it's never happens if we don't get this vote before August, in my opinion. But if he forces a vote in the next several days, I won't be surprised if we see it passed.
SPEAKER_03Let me ask you one quick question here is that if Senator Thune doesn't call a vote, would that be, I guess, a bad angle? Because this is what we've been promised. I mean, I've been tracking this every single day for six months. We were told we were gonna have a vote in May, in June, July, and here we are in August. And some part of me is getting frustrated with the process of like, at some point we got to get it done. And with the August recess only 48 hours away, as somebody who's less informed than you about these issues, I'm sensing a uh a little bit of frustration from crypto investors on X because it's like, we could have called the vote. If we just get the vote, that's all us are really asking for at this point. So I'd like to hear from you. If Thune doesn't call a vote, what would you say to people? Would you say that's a reason to be frustrated, or is that just kind of how the process works?
SPEAKER_01No, I I think it's a reason to be outraged. Uh, we need to get rid of the zombie filibuster. That's a silent fill filibuster, which means that uh if if they informally count the votes and don't have 60, they just table everything. That allows the minority to control the majority. So we've got it in that. If Thune doesn't get this to a vote, then then he's he's incompetent as far as I'm concerned. And what he's doing is playing politics and letting people off the hook. But you got to remember, one of my bills, my first bills, if I get to the U.S. Senate, is the Washington Clean Hands Act, which seeks term limits and it seeks ending regulatory capture and all those things. But one of the things it calls for are single issue bills where you just you have an issue, you vote for it. You know, the Ukraine funding bill should be called the Ukraine funding bill. The Clarity Act is the Clarity Act, and you don't mix Social Security and education with foreign funding and all this, and you make senators take a vote and go on record so that there's accountability on every single issue. Uh, but if if it doesn't go to a vote, then that's Thune rewarding people uh during an election year so that they don't have to be held accountable, it would be a disgrace and he should lose his job as speaker for that.
SPEAKER_03So the frustration, according to John, again, he you feel very similar. And this is something that I've been saying for a long time is that if Republicans do not get a vote, meaning if Thune doesn't call them and get these votes on the record, I think all of our frustration should move away from the Democrats and onto the Republicans who sold us this narrative that we were going to get a vote. And we've heard it this week from Tim Scott, Senator Loomis, Rick Scott. We've heard um Senator Kennedy say he wants a vote. So it's time, guys. We got to get these issues done. And I think Republicans need to consider the fact that if they don't get a vote and they don't get this on the record, all that energy that they're saying is gonna hurt the Democrats may swing the other direction and end up hurting Republicans. But Mr. Dayton, John, I want to give you a huge thank you. Just two rapid fire questions because I want to give people a chance to communicate with you here. This person, Craig, is awesome, and he's been here for a long time. Thank you, Craig. He says, John Deaton, thank you for all you do, sir, especially with Link2. I'm one of those who's patiently waiting. Can you give us the latest update? I'm not sure we haven't talked about this, but if you have anything in regards to that, I'd love the floor is yours.
SPEAKER_01Yeah, uh very unfortunate uh in the fact that two Mondays ago was going to be the exit day out of bankruptcy. And literally on Friday, there was information that Schwab, which acquired Forge, which is going to be the manager of the liquidating trust, uh, had some kind of objection, literally at the 11th hour. And so right now they're negotiating uh how to deal with that. I've spoken up in court and said to the judge that, you know, we're talking about the Charles Schwabs of the world. So our shares should not be diminished one more dollar. If this delay of, let's say it takes a month, if this four weeks of delay adds another four million dollars in attorney's fees, that four million needs to be paid by Schwab or Forge or whoever you know breached the deal, um, because it shouldn't come off our shares of Ripple or Kraken or Circle or whatever. Um, I think, and also if they don't reach a deal, then there'll be a motion that asked the judge to enforce the deal because we were really on the eve of being out of bankruptcy, meaning like within 70 hours when this went down. And so the judge can basically order Forge to comply with what they already agreed to, and that Schwab just has to deal with it. So I'm cautiously optimistic that um, but I said that before, so I don't want to sound like a broken record because I do, right? I thought we'd be out of bankruptcy, you know, uh by the by the end of July. And uh I'm I hope it's by the end of this month, but the people's shares are there, and uh and and as of right now, uh people are looking at a loss of say eight percent. So what that means, if if you owned a hundred shares of ripple, you know, right now when it comes out of bankruptcy, your value would be 92 shares uh of Ripple, which would pay for the lawyers, which is still a very good result out of bankruptcy. Because uh and that includes the upside. So obviously, you know, full disclosure, I've been doing this pro bono, what I do in Link to, but at the same time, I have a $495,000 invested in the platform, so I don't want to act like it's completely selfless on me, right? I have a vested interest too, because my $500,000 is probably more worth like $1.2 million or something like that when you count the upside. Same for everyone. So I still think we're gonna get a good result. It's just this frustrating last minute curveball in bankruptcy. But hang in there as soon as I can do, I can really give you detailed, specific update. I will I'll do a spaces, I'll make sure it's uh recorded and I'll tweet it out. And uh you guys can even maybe promote it uh for your audience, and I'll provide you up the best update I can as soon as soon as I can.
SPEAKER_03Well, I want to give you a massive thank you for joining us today. One final question here, and this is from Library Blockchain. Thank you so much. He said, John, what do you think about the SEC and CFTC guidance calling LBRY credits a digital commodity after you fought for secondary holders? Now, I have no context to this, John, but if you have a response there, floor is yours.
SPEAKER_01I mean, it goes it just goes to show you the shame of regulation by enforcement, by the fact that uh the LBC uh library credits uh were being called securities by uh Gary Gensler's SEC. It actually bankrupt library, uh a small American entrepreneur uh who was competing with the YouTubes of the world, uh really an American story and and regulation by enforcement shut it down. So um it's great. Uh it's unfortunate that it costs an American business um uh to to bank be bankrupt because of it. That's why we need clarity. Like that wouldn't have happened, right? So Coinbase being sued wouldn't have happened, Kraken being sued wouldn't have happened, ripple being sued wouldn't have happened. And just think about you know, ripple alone spent 200 million in fees, Coinbase had to spend around 200 million in fees, then you add Kraken and the others, you're talking about a half a billion dollars just in legal fees for regulation by enforcement. Then when you count FTX and Voyager and BlockFi, if you count all that stuff, which the Clarity Act would have protected, um lawyers made over a billion dollars in the FTX bankruptcy. Imagine that, guys. I went in the wrong law, man. I should have become a bankruptcy lawyer of uh if I'd have known this. I mean, their average fee is like 1500 bucks an hour, and they made over a billion dollars in lawyer fees while consumers got screwed. It's because we didn't have clarity, and so shame on Josh Holly, shame on Elizabeth Warren, shame on all the others out there, whether they're Republican or Democrat, for allowing politics in the banking industry to tell you what to do. It's a disgrace, they should be ashamed of themselves. And if I get to the Senate, you know, uh I'll probably walk into some of their offices and tell them what I think.
SPEAKER_03It's not if, it's when, from my perspective, John. And if I could get one question to the XRP community, because I don't think we addressed it yet. You had a phenomenal interview with digital perspectives a couple of weeks ago, and you said the Clarity Act would be the green light for large assets like Bitcoin, Ethereum, and the XRP ledger. Can you elaborate on that for people who maybe don't have the context that you do? What do you think would happen if we did get this clarity bill? Floor is yours.
SPEAKER_01Yeah, you what people got to understand is that when there is just look, if we don't get Clarity Act and the Democrats take control of the Senate, who is the chairperson on this banking committee that oversees the SEC? Elizabeth Warren. Now imagine a Democrat becomes the president, and let's say the anti-crypto army takes over, they can invalidate all of this SEC stuff and CFTC stuff that's been positive because it's all rulemaking, it's all guidance from regulatory agencies, it's not the law. If we get Clarity Act, then it's the law. The chances, even if it's a Gavin Newsom becomes president and Elizabeth Warren is in charge of the banking committee, they're not gonna be able to just redo the law, right? It's written in law. They'd have to, you know, have an entire thing that we've seen for the last year, and it's just not gonna happen. So that gives the uh big institutions and banks the green light that this is well settled now. We're not gonna keep going from one extreme to the other, we're not gonna go from banking joint choke point 2.0 to okay, it's okay, back to choke point 2.0. It'll be settled for decades and the capital will fly to it. You already have Morgan Stanley's uh JP Morgan Chase is talking between one and 10% of an allocation in your portfolio should be to crypto. So the ETFs are going to explode more. The tokens themselves, people are going to build on the XRP ledger and and all of that. It would just be a massive green light for small businesses and big institutional businesses like Schwab, all right, which is you know got $10 trillion or $9 trillion to come in. And uh, I think it would be explosive growth, especially for any token that has utility whatsoever. You know, and even even even the store of wealth, uh store of value thesis on Bitcoin uh and its limited scarcity would would be a great thing and be great for Bitcoin and the stable coins on Ethereum be great for Ethereum and XRP Ledger's payment technology and the things that it can do, it would be great for that and others as well. And so um it's really a way for young people, and I appreciate you calling me young, and just put that in perspective. I'm not a young man, but Ed Markey's first year in elected office, I was six, just to put that in perspective. Okay, six years old. Um, but for young folks who've been priced out of the American dream, and it's becoming harder and harder and harder. This is an asset class. To escape poverty, to build wealth, what do you need to do? How did John Deaton do it? John Deaton got access to appreciable assets. It wasn't until my 40s, but I did. And you know, stocks and real estate and and and Bitcoin and other. XRP. I bought things, those prices went up. To escape poverty, to build wealth, you need to get appreciable assets in the hands of regular people. Cryptocurrencies, uh, blockchain technology, all of that is one form of way of doing that. And it's it's why I call crypto Bitcoin uh the modern day version of the American dream for many people.
SPEAKER_03Well, John, I just want to give you a huge thank you for joining us today. And if you think about where the American economy is headed, it's undeniable that digital assets, they're gonna be integrated into the banking system. Eventually, we're gonna have stable coins, we're gonna have central bank digital currencies, we're probably gonna have UBI on some level, some sort of a government. And that's all gonna be done on chain. So I'm excited that we're at the beginning of this innovation. And although we've had to be very patient through this entire process, like you said, I've been here since 2019, you've been here even longer. It's been quite the journey as an XRP investor, but it seems like everything is beginning to align towards the back end of this decade. And by the year 2030, I think we're gonna be looking at a radically different version of the crypto space. It's gonna be regulated, it'll probably be decadrillions, there'll be smart contracts at scale, there'll be tokenized assets at scale. I think we're at the inception of this thing. And it's brilliant that you're known as the crypto candidate because when, not if John's elected, we're gonna have a pro-crypto politician in the state of Massachusetts representing us.
