But"},{"speaker":"Harold Field","startTime":198.51,"endTime":203.25,"body":"other recipient third way to"},{"speaker":"Harold Field","startTime":203.25,"endTime":206.67,"body":"violate it is to call"},{"speaker":"Harold Field","startTime":203.25,"endTime":206.67,"body":"individuals who have not given"},{"speaker":"Harold Field","startTime":206.67,"endTime":210.35999999999999,"body":"this and this in particular goes"},{"speaker":"Harold Field","startTime":206.67,"endTime":210.35999999999999,"body":"to automatic dialing systems and"},{"speaker":"Harold Field","startTime":210.35999999999999,"endTime":214.41,"body":"calling cell phones. But for"},{"speaker":"Harold Field","startTime":210.35999999999999,"endTime":214.41,"body":"individuals who did not give"},{"speaker":"Harold Field","startTime":214.41,"endTime":218.42999999999998,"body":"explicit written consent to be"},{"speaker":"Harold Field","startTime":214.41,"endTime":218.42999999999998,"body":"called. Those are the simplest"},{"speaker":"Harold Field","startTime":218.42999999999998,"endTime":222.78,"body":"of the easiest ways to violate"},{"speaker":"Harold Field","startTime":218.42999999999998,"endTime":222.78,"body":"the statute, a TCPA violations a"},{"speaker":"Harold Field","startTime":222.81,"endTime":226.82999999999998,"body":"technical violation, it's like"},{"speaker":"Harold Field","startTime":222.81,"endTime":226.82999999999998,"body":"akin to a technical violation or"},{"speaker":"Harold Field","startTime":226.82999999999998,"endTime":230.01,"body":"a technical foul in basketball,"},{"speaker":"Harold Field","startTime":226.82999999999998,"endTime":230.01,"body":"there doesn't have to be any"},{"speaker":"Harold Field","startTime":230.01,"endTime":234.14999999999998,"body":"harm done to the plaintiff. The"},{"speaker":"Harold Field","startTime":230.01,"endTime":234.14999999999998,"body":"call just had to have taken"},{"speaker":"Harold Field","startTime":234.14999999999998,"endTime":239.25,"body":"place, right in violation of the"},{"speaker":"Harold Field","startTime":234.14999999999998,"endTime":239.25,"body":"law. One is"},{"speaker":"Harold Field","startTime":269.34,"endTime":273.24,"body":"most of us know the Fair Debt"},{"speaker":"Harold Field","startTime":269.34,"endTime":273.24,"body":"Collection Practices that the"},{"speaker":"Harold Field","startTime":273.24,"endTime":275.82,"body":"second one is the Fair Credit"},{"speaker":"Harold Field","startTime":273.24,"endTime":275.82,"body":"Reporting Act. So it's the"},{"speaker":"Harold Field","startTime":275.82,"endTime":281.21999999999997,"body":"FDCPA, the FCRA, and then"},{"speaker":"Harold Field","startTime":275.82,"endTime":281.21999999999997,"body":"there's the TCPA. So it is it is"},{"speaker":"Harold Field","startTime":281.21999999999997,"endTime":284.46,"body":"in that top three, if you look"},{"speaker":"Harold Field","startTime":281.21999999999997,"endTime":284.46,"body":"at the frequency, so there's"},{"speaker":"Harold Field","startTime":284.61,"endTime":291.45,"body":"around 6200, CFPB complaints per"},{"speaker":"Harold Field","startTime":284.61,"endTime":291.45,"body":"month of those 6200. A number of"},{"speaker":"Harold Field","startTime":291.45,"endTime":295.26,"body":"those turn into individual"},{"speaker":"Harold Field","startTime":291.45,"endTime":295.26,"body":"actions and then class actions."},{"speaker":"Harold Field","startTime":295.53,"endTime":298.95,"body":"If you look at the TCPA. In"},{"speaker":"Harold Field","startTime":295.53,"endTime":298.95,"body":"particular, for the month, we'll"},{"speaker":"Harold Field","startTime":298.95,"endTime":305.64,"body":"go back to July of 2021. They"},{"speaker":"Harold Field","startTime":298.95,"endTime":305.64,"body":"had 108, there were 180 TCPA"},{"speaker":"Harold Field","startTime":305.64,"endTime":310.92,"body":"lawsuits filed, and 52% of those"},{"speaker":"Harold Field","startTime":305.64,"endTime":310.92,"body":"were class action. So roughly 92"},{"speaker":"Harold Field","startTime":310.92,"endTime":314.96999999999997,"body":"of them were class actions. Now"},{"speaker":"Harold Field","startTime":310.92,"endTime":314.96999999999997,"body":"that's a one month okay. Keep in"},{"speaker":"Harold Field","startTime":314.96999999999997,"endTime":318.18,"body":"mind that the average class"},{"speaker":"Harold Field","startTime":314.96999999999997,"endTime":318.18,"body":"action settlement does settle,"},{"speaker":"Harold Field","startTime":318.69,"endTime":322.2,"body":"settles around $6 million. So"},{"speaker":"Harold Field","startTime":318.69,"endTime":322.2,"body":"the numbers can be pretty good."},{"speaker":"Harold Field","startTime":322.2,"endTime":326.07,"body":"catastrophic, okay, so with"},{"speaker":"Harold Field","startTime":322.2,"endTime":326.07,"body":"FDCPA, in particular, which is"},{"speaker":"Harold Field","startTime":326.07,"endTime":334.02,"body":"the leader, they have 600 debt"},{"speaker":"Harold Field","startTime":326.07,"endTime":334.02,"body":"623 cases in July, only 24% of"},{"speaker":"Harold Field","startTime":334.02,"endTime":337.62,"body":"those were a class action, so"},{"speaker":"Harold Field","startTime":334.02,"endTime":337.62,"body":"roughly 152. So you can see how"},{"speaker":"Harold Field","startTime":337.62,"endTime":340.65,"body":"the, there's a much higher"},{"speaker":"Harold Field","startTime":337.62,"endTime":340.65,"body":"percentage of class action"},{"speaker":"Harold Field","startTime":340.65,"endTime":345.9,"body":"lawsuits from TCPA violations."},{"speaker":"Harold Field","startTime":340.65,"endTime":345.9,"body":"And the settlement value at 6.6"},{"speaker":"Harold Field","startTime":345.9,"endTime":349.53,"body":"million on average, is pretty"},{"speaker":"Harold Field","startTime":345.9,"endTime":349.53,"body":"catastrophic. And that's why we"},{"speaker":"Harold Field","startTime":349.53,"endTime":352.32,"body":"all should be pretty concerned."},{"speaker":"Harold Field","startTime":349.53,"endTime":352.32,"body":"I mean, this is this is a very,"},{"speaker":"Harold Field","startTime":352.32,"endTime":357.9,"body":"very big issue.
