Gun Rights Cases Are Colliding — Here’s Why It Matters

The courts are splitting — and for gun owners, that could be a very good thing.

welcome to the Live Sheet podcast. My name is Jeff Dwin. I've been a licensed farm dealer for the last 18 years. In this podcast, talk about all things related to the amendment. Sports story or anything else going in the world or anything I find interesting. So welcome welcome. So before we dive in just do wanna call out today's opening day in baseball. And Yankees won last night in the first game in the major leagues on Netflix of all places. But anyway we'll talk about that. Maybe another topic. But Rangers today at three o'clock gets the Phillies. Baseball season's done away, but. This week we're stepping back and we're gonna look at the bigger picture. 'cause if you've been following the gun rights news lately, you might feel like things are all over the place. One court strikes one thing down, another one upholds it. One state expands restrictions. Another challenges challenge gains traction. It's messy, and here's a reality. This kind of chaos. It's exactly what happens before, major change. And right now the courts are splitting and that may be the best news for gun owners that they've had in a long time. So I'm gonna break it down. So let's start with one of the biggest developments. Suites, a magazine ban, a federal appellate court out DC of all places, struck down a ban on the large capacity magazines. Now on its own, it's not a real big deal, but. This is where it gets important. The ruling is already being used to challenge bans in other states, including Illinois. And if the momentum builds, because once different courts start disagreeing, once you get that what's called that circuit split, the Supreme Court again almost has no choice but to step in. And when they do, that's where national precedent gets set. For gun owners, that's critical. 'cause it strengthened the argument that magazines standard capacity are not accessories. They're arms, they're in common use and under constitution. If that matters. Now let's talk about a case that's impacting millions of Americans. Supreme Court is currently considering whether marijuana users can be prohibited from owning firearms, and we're not gonna get into the debate and conversation about, whether marijuana should be legal or not. And all those policies around that, but. It isn't a fringe issue. And the people in these states where marijuana is legal, it affects 'em, people who are otherwise what would consider law abiding citizen question is simple. Can the government strip someone of their second amendment rights based solely on their status as a user of a substance? Whether that's marijuana, alcohol, whatever it might be, right? Again, a slip or soap. And more importantly, does that restriction have any historical basis? 'cause under Bruin standard there, if there's no historical tradition supporting a tra, a restriction, it shouldn't stand. If this fails, you're looking at one of the largest expansion of gun rights in modern history. Now, there's one that's been flying on the radar and it shouldn't be. There's an ongoing challenge of the federal ban on mailing handguns to the US Postal Office. So just for, an individual cannot mail a handgun. Through the US Postal Service they can send a long gun and, but they can't do handguns that a dealer is the only one that can do handguns. And one thing that's important to note is that carriers like FedEx and UPS have completely banned the ability for the individuals to ship firearms. So there aren't many routes. And me, as a dealer, that's one of the services I provide. But because dealers are the only one that can do it. But, going back to mailing them through the post office, which is a federal entity, right? FedEx, UPS. They can do whatever they want. Private organizations, right? The Department of Justice isn't even defending the law. Think about it. If this challenge exceeds, it could fundamentally change how firearms are bought, sold, and transferred across state lines. And enforce is something we've been saying a long time. Firearms are not saying class items. They're protected and treating them distantly from any other product. And that's getting harder and harder to justify. Now, let's be real. Not everything this week in the last few weeks have been in favor of Gunnar. The Ninth Circuit upheld restrictions on firearm possession for individuals with domestic violence convictions, and the Supreme Court declined to hear the case involving non-violent felons seeking restoration of rights. So yes, there's still losses, but look at the pattern. Courts are starting to draw a line between what they consider dangerous individuals and broad sweeping restrictions on ordinary law abiding system. The distinction matters because it shows what future battles are going to be fought. Now, at the same time, states like Connecticut are continued to push new restrictions, individuals bans on convertible firearms and expanded regulation of parts. This ties to a bigger issue we've talked about before, definitions. What's a firearm? What's a part? What's a machine gun? 'cause all those, as those definition expands, the more people get caught in that gray area, and that's where enforcement comes unpredictable and rights become vulnerable. So what's it mean to you? Let's bring it back. The gun owner, the Second Amendment advocate, what does it all really mean? Number one, the legal landscaping is shifting and it's shifting fast. We're not in a stable moment, we're in a transitional one. The Supreme Court is going to have to step in. You can only have so many conflicting rulings before something breaks. And number three, the arguments are getting stronger. Common use historical tradition limits on federal power. They are not fringe I anymore. They are front and center in federal courts across the country. So if you zoom out, the train is clear. For years gun gun controlled operation operated on expansion, more laws, more restrictions, more categories. Now we're seeing pressure in the opposite direction, challenges reversals, reevaluation, and most importantly, accountability. The courts are no longer just accepting these laws at face value. They're asking, where's the history? Where's the justification? What's the limit? This isn't the end of the fight. We always say on this podcast fight. 'cause we're not even close. It's a turning point. And because when the courts start to disagree, that's when the biggest decisions get made. And for gun owners, that's where real change becomes possible. If we're gonna be keeping our eye on these things, we're gonna be looking for the Supreme Courts to take up some existing cases they've been holding and haven't actually granted cert yet. So we will see what's coming.
