   Slam the Gavel welcomes Stacey to the podcast for an update. She was last on the podcast November 18th, 2022, Season 3, Episode155.  Stacey's family’s story goes back to the year of 2013 when she filed for divorce to protect her children from a variety of abuse.  However, her ex is an attorney formerly for CPS and current Public Defender.
     While she knew sometimes law enforcement and the courts might cut some slack for "friends or family" on things like minor traffic infractions, Stacey never thought things would turn out to be so dirty when presented with life and death matters of children.  So she trusted her high-paid attorney to do the "right things."  Unfortunately, she literally served Stacey right into the "conflict of interest" courts where her ex appears regularly and is known by everyone.
     Stacey explained that she is being called vexatious litigant for filing meritless petitions. The Supreme Court Judge read all the applications but didn't give the content of the applications and he mentioned three motions in particular the previous disqualified for cause, one application was for custody and the other was to vacate orders from the previous judge and that judge did step down, which is proof of merit. This has caused retaliation for asking the prior judge to step down and also perceived as a favor to the ex to silence Stacey in January 2022.
      In July 2022, regardless that Stacey was ordered precluded from filing but Stacey filed an Order to Show Cause for Custody again because of things happening in the household of the ex with her children and police were involved. The judge stated he would still entertain that Stacey was precluded from filing despite the fact that her ex now had four CPS indications against him....When Stacey received the letter of the four indications, Stacey asked the judge to please do a hearing on the Order to Show Cause, but he held a conference and yelled at Stacey the whole time. Stacey, a PA of 23 years, asked him if she could take her children to the doctors and he did not give her any relief.  Her kids are still in his custody even though there is one of four indications and one is lack of medical care. Stacey said to the judge, that this would be better dealt with in Family Court where the kids could be better represented. However the ex said that she was precluded from filing, so she can't file in Family Court. All Niagara County judges recused themselves as they had a conflict of interest with her ex and a visiting judge came in and creating an order appointing the same attorney over her children and was never signed nor served it. Her children's interests were never protected.
     We discussed 18 USC 2071,  and Stacey discussed how important it is when filing for divorce, to file in another jurisdiction and why. We also talked about the importance of court watching and how powerful affidavits are and how powerful a Non-Party Witness Affidavit is. Stacey also talked about a discussion she had with the FBI.
