What exactly is Slip and Fall Law?

Many people consider a slip-and-fall accident to be a minor occurrence. While the majority of slip-and-fall accidents are minor, they can often be life-changing. Slip-and-fall accidents are classified as either common or unusual. Slips and falls are common when someone trips over a flaw on a sidewalk or other public area. Cracks, holes, and debris are examples of flaws. An unusual slip and fall occurs when a person slips and falls on a foreign object such as a piece of merchandise, a slippery substance, or a foreign substance. A person slipping on a wet floor in a grocery store is an example of an unusual slip and fall. Both of these slip and fall accidents are considered personal injury accidents, and it is critical that you retain a personal injury lawyer to assist you with any claims. In order to receive compensation for a personal injury accident, you must demonstrate that the responsible party was negligent. It is very common for a person to slip on something and sustain injuries in a slip-and-fall accident. In many cases, a person may believe that the accident was their fault because they were careless or failed to properly assess the situation.

Can You Sue If You Slip on a Wet Floor?

Slip and falls are among the most common types of accidents. If you slip and fall in a public place like a store, restaurant, or hotel, you can sue the company for negligence. The law allows you to seek compensation for your injuries and losses caused by the company's negligence. If you slip and fall in your own house, you may be able to seek compensation. Some states, such as Delaware, allow you to sue for damages even if the business owner was not at fault. In many cases, businesses that maintain floors will be responsible for floor maintenance. When a business fails to clean the floor properly, the owner may be held liable. The type of damage you can recover is determined by the nature of your business and what caused the floor to become wet.

What is the time limit for filing a slip and fall claim?

Slip and fall accidents happen on a daily basis. When these accidents occur in someone's home or place of business, strict liability claims may arise. Strict liability cases arise when a defendant has a legal obligation to keep his property reasonably safe. If that duty is breached, a plaintiff may seek compensation for their injuries. To have a case under strict liability, a plaintiff must show that she fell as a result of a dangerous condition on the defendant's property.
