CIVIL PROCEDURE #45 | Can an applicant claim damages on top of judicial review ?
In this episode, we explain how Order 53 rule 5 governs claims for damages in judicial review, why damages are not automatic, and when an applicant must show an independent cause of action. We also discuss why courts treat damages as ancillary relief and when a separate civil action may still be required.
