Anyway, tonight I know a lot of you have been calling us on how to change the doctor that you're currently with because you're having problems. The doctor doesn't know how to get your cases accepted and what to do from there. And Chris has done all his research and his homework, and those of you that are almost no homework, just some research. Have been following Chris on Twitter. He put a little new whatchamacallit, a new law that he whatchamacallit, a new law that he found. And if you want to know what the new law is, you've got to go on Twitter.

But for the rest of you that haven't, I posted on Facebook today, or early today, when I was drinking coffee right out of bed, I was like, eh, I'm gonna do this thing. And so I posted it and I said, but go to Twitter to see it. And since then, I got an entire I got six new people on Twitter.

Like one of the topics we are gonna discuss, but you gotta go to Twitter to check it out because I know I think it was Diane that saw or somebody else called. She said she saw, no, there was a it was somebody from Iowa. Iowa was Iowa. She called while we were driving to Daytona and she says I just saw Chris's Twitter post and I had to call because now I need some more help. It's huge. See?

You gotta get on. So in the beginning, like for the last several weeks, I've been just playing around. Hey, maybe get on Twitter. Seriously, it's time. Like enough, get on. Because I'm just helping. And the information I'm putting on there is huge. You can't find it without doing hours of research. And why would you do that to yourself? I'm doing it. Yeah. So get on Twitter, get the information, share it with your friends, and tell them to get Twitter too. And everybody just get into 2019 and get social media and start with Twitter. You already did Facebook.

So start sharing the video. So tonight what we're gonna be talking about are these two topics. So we're gonna talk about change of treating doctors, what to do and how to do it, how to find qualified OWCP doctors, and the locations that we've trained the doctors in. And this is the one big topic that I get all the time, and I've been seeing it on the Facebook sites. You know, how to handle file anxiety, stress claims, PTSD, and being harassed at work. And can you file it? And how do you go about filing it? So, with that said, turn it over to you.

Alright, so stress claims. Stress claims can be either CA1 or CA2 claims, it just really depends on how it happens. Sadly, a story that I heard about was somebody saw a person who was dead on the route, and that happened in a single shift on that route. So that person suffered from a some sort of stress, anxiety disorder, PTSD. I'm not a psychologist, so I'm not sure how to describe it. But they it was an issue. But it happened in a single shift, and so that's a CA1 claim. Another person had been harassed by their supervisor over a period of time, multiple shifts. That harassment over a period of shifts was a CA2 claim. Both are and should be covered by OWCP. So all you've got to do is fill out your forms and turn them in. Okay, in the case of the one with the supervisor, find someone else. Find an HR, a postmaster, another supervisor. You are not required to report your harassment to the harassing supervisor. Alright, that's just one example. But the bottom line is you have to report the injury the same way you would if you blow out your knee or hurt your back. You report the condition. I've got this going on, and it's hard for me to go to work because every time I come to work, I suffer this mental anxiety, this anguish of some sort. And uh your supervisor will no doubt give you a hard time. Somebody's gonna treat you like something's wrong with you, but it's your right. Do not let go of that. It's your right to file. So handle that. From there, you're gonna need to go see a doctor. So it's a mental health condition. I don't want to call it disorder, because I think that's an ugly word. You have an issue that you need to deal with, okay? That you didn't ask for. It happened due to the job. This happens all the time. We hear about them every day. So you need to go to a doctor, preferably a mental health provider, psychologist, or psychiatrist. And uh see that doctor as long as it takes. If that person takes OWCP and actually knows how to write narrative reports that will get that claim accepted, stick with them.

But if they don't, then go see them two, three, four times, and then have them write a report that explains your condition and take it to an OWCP doctor and let them incorporate that report into their own report. And that's how you get your stress, anxiety, PTSD, your claim accepted that is a mental health claim. And don't be embarrassed. You know what happens is people say, Oh, I just I gotta hide this, especially men. Yeah. Okay, seriously. You don't need to hide it, it just gets worse. These things are covered, and your privacy is protected. And uh and so I recommend that you just fill out the forms, go to the doctor, and get it dealt with. Once it's once the form is sent to DOL from the supervisor's out of it. They have no right to know what's going on with you. And so you don't have to be embarrassed or ashamed or any of that. You have a right to get help, so do that. So whether it's a CA1 or a CA2, that's how you get that dealt with. And you just pretend that it's a back injury. What would you do there? Alright, so handle it. It was a knee injury, handle it. You've got a condition that needs to be dealt with. You didn't ask for this, it happened as a result of your job, so that's how you handle it. What questions do we have?

Okay, and we want you guys to understand. I know you guys text us, message us, call us. So, what goes on in the post office as far as your hours go and clocking in and all of that stuff, we don't know. We just focus on OWCP. I can help you a little bit.

Daniel Thomas says, hello, just a quick question. Can they call you and leave you a message to come in on your day off? This happened to me yesterday on my route.

They can do it, but I would definitely call the union next and say, hey, this happened. Should I come in on my day off? It's outside of OWCP. But one thing I'd say is you already have enough problems with management because they're jerks a lot of times. Not all of you. There's like at least one manager out there that's not a jerk, and I'm talking to you. But the rest of you are jerks, and it's hard dealing with management. And so when that happens and they're just they have bad intentions, let your union know, and then have the union intervene for you. Okay? They can do it. Should they? No, they shouldn't do it. That's not nice, but they can.

Yeah, we're talking about how to get your how to and can you get your stress, anxiety, PTSD claims processed, and can you do it? Yes, you can do it.

And those of you like where Chris is saying that the supervisor is harassing you causing this issue, don't forget we did a video we're at 24,000 views already with the rules and statutes for the supervisors that we'll probably go over again in a couple months. Yeah. But go back and watch it so you don't have to go down this route of having stress and anxiety. We've heard, sorry, we've heard like in Alabama, we've had somebody that she saw somebody dead on her route in a lake. So, like, all these things are covered. We've asked, higher level, and it is covered.

Yeah. Mary says, Can you be diagnosed with PTSD if you only have a physical injury and still being asked to work with the injury?

So the answer is look, if the question is, can you be? Yes, you can be. The issue is can your doctor intelligently, specifically outline in a narrative report how it's job related? And that's the key. Yeah. Okay. You can say anything, and doctor can say anything, but if they can't write a good narrative report, what's the point? But yes, the answer is yes, it can be. They just have to do a good job writing the report.

Mr. Alonzo says, I've had three surgeries, both shoulders and my back. What can be done with a schedule award?

Alright, so schedule awards are a bigger topic. Shoulders and back?

SPEAKER_02

Yeah.

So the shoulders are definitely covered. The back is not necessarily, usually not, but can be if it causes symptoms radiating into your limbs. To get a schedule award, you need to get an MMI. MMI is called maximum medical improvement, and that means that you're as good as you're ever going to get. And only your treating doctor can say that, or a medical doctor can say you're at MMI. Once you're at MMI, they do an impairment rating based on the sixth edition to permanent impairment, and that impairment goes or the percentage goes into a CA7 claim for compensation and for your schedule award that goes into DOL. For more information on that, you can call us directly. Yeah. Or you can contact Eric Blowers, a lawyer. If you want his number, he's spectacular, he's inexpensive compared to other lawyers out there that do what he does. He's a professional and she can give you his number. So if you want to just message her and she'll give you his number.

So Daniel says, I'm so stressed out over this job. Would be would it be a CA1 or a CA2?

SPEAKER_01

It depends, Daniel. It depends on did your stress come from a single incident in a single shift, or did it come from two or more shifts over time? By definition, there's not a third way to to uh to file a claim. It either happened in a single shift or multiple shifts. Right. CA1 or CA2.

Alright, so I and this is the reason why we're doing this topic now. All the questions are coming in. So, Chris, how about someone threatening to kill you?

Who who did that?

SPEAKER_02

Well, I don't know who did it.

If someone threatened to kill you, that definitely happened in a single shift, and that would be a CA1 claim. And uh you handle that accordingly. And so you just need to uh prove, number one, you'll have to prove someone threatened to kill you. I'm pretty sure that your word will not be good enough, sadly. Okay.

But she says it's it has caused a lot of stress and it's not.

Well, there's no doubt. That would cause me stress and anxiety because I'd like to live. So if someone has threatened to kill you, you've got to just document it. If there was a witness, that would be ideal. I would call the police for sure, get a police report on that.

Most definitely.

And then have the police talk to the person who threatened to kill you, and then you take all that information and that goes in a CA1. And then your mental health doctor, whether a psychologist or psychiatrist, takes all that information and writes a narrative report after evaluating you. And that's how you get that accepted.

So Laura says, What pitfalls do I need to watch out for a stress harassment claim?

SPEAKER_01

Number one, it has to be true. Here's the key. And I would never accuse a federal employee of fabricating or lying. I just never would. I would never do it. I've never even seen it, which is interesting. With thousands of people I've helped, I've never seen anybody lie about a claim. But number one, it has to be true. And number two, you have to be able to prove it. If you can't prove it, that's a huge pitfall. If there was a witness, that's huge. If you can get stuff in writing, that's ideal. So a pitfall in this is if it's my word against their word, that gets to be trouble. If you can get a witness or get something in writing, that would put you well on your way to success in getting that claim accepted.

We hear it from all agencies, all the different unions. Make sure you just when this stuff is going on, contact your district rep, comp contact your NBA, contact your union president, and tell them what's going on. Yeah, especially with a threat.

Everybody, contact us. And like Chris said, just go through what we said, file your claim, find an OWCP psychiatrist, psychologist, therapist that one that will take OWCP. They may go ahead and write a great narrative. They are the ones to know how to do this. And if not, visit them to two to three visits and then find an OWCP doctor that the treating physician can work with the psychiatrist. So with that said, is your phone still acting up? Yes. That's okay.

Alright, take a break from that. Alright, so here's the deal. You want to find a doctor. Number one, here's what you do. Write this down. Go to Google and in your search OWCP, injury doctor, and your city. So right now I'm in Daytona. OWCP Injury Doctor Daytona. That's how you find a doctor. If they are not on page one or at the top of page one, they don't want to be found or they don't exist. In that case, you go to ACS. Now ACS sucks. It's horrible. It's all the way terrible. But you can go there. So you go to Google and search OWCP ACS or D O L A C S, okay? And once you get to this site, you scroll down about halfway and there's a link that says provider search. And you go through all the stuff there and search for a doctor. More than likely, you're gonna call like 10 or all of the doctors on the list, and they'll say no, they don't want it. And so in that case, call us 877-787-OWCP, and we'll do our best to help you find a doctor that will help you, and that's what we do. Anyways, that's how you find a doctor. But Jeannie is looking for more questions. I'm anxious, I'm so anxious to get to the next topic. What I'm about to tell you, even after I say it, you're gonna think, oh, that's it. Okay. I requested OWCP review decision to deny medicine, and it's been a month. I was told that it had been referred to a DMA, which happens all the time. I'm now trying to contact the supervisor to find out reasons for. Alright, so supervisors have nothing to do with this. Unless you're talking about a claims examiner supervisor, then that's a good move. I'm so upset that a necessary medication has been delayed. Yeah, so here's what's gonna have to happen. Your medical doctor is gonna have to write a letter of medical necessity for this. Send that in to the claims examiner. You may even need to request that a nurse case manager, Robert, is added to your case. The nurse case manager will then cooperate with the medical doctor and find out that this is in your best interest and we'll probably speed that up. So write a letter, Robert, requesting that a nurse case manager be added to your case. Normally I write letters requesting they be removed, but in this case it looks like you need one. So do that.

And she came into our office and her case got accepted. It's that easy, guys. Just make a phone call. We know we don't have enough doctors in the United States. We're working on it. No. Okay, 20 CFR, the Code of Federal Regulation, says that you can choose your own doctor, that the supervisor cannot force you to go to a doctor that's employed by or under contract with the agency, and they have to tell you that it is your right to choose your own doctor. Yeah, you can choose your own doctor. It's your right. If you go to the company doctor, you will end up in a black hole of denials. And in a minute, when she lets me, I'm gonna tell you how to get out of that black hole. So go ahead and do your thing, but I'm gonna tell you how to get out.

Alright, seriously. So this has been. I've been playing, I'm not playing. This is really important.

Whatever doctor you go to, everybody knows if you're on this feed, there are not nearly enough qualified OWCP doctors that know how to get claims accepted. Everybody knows this. Okay? It doesn't matter how hard I try, how long I work, how many states I go into, how many offices I train, there's never enough. Okay? I've trained more than 25 doctors on how to do OWCP, and it's not enough. There are 50 states, lots of cities, okay, 2.8 million federal employees. My 25 doctors are not even scratching the surface. But I'm doing the best I can. And so here you are, if you don't go to a doctor that I trained, you're getting denied. Okay? One out of 13 federal employees has an accepted claim. Every time I go to any kind of meeting, any kind of convention, I ask this question what percentage of your co-workers are hurt? And I hear 60, 70, 80, everybody. Alright? So we all agree that half of your federal coworkers have some sort of work-related condition. Half. Okay, half is six or seven out of thirteen. But one out of thirteen has an accepted claim. That's a problem. But what's worse is you end up at a doctor. You're you got suckered into going to the company doctor. Your supervisor said you had to go to the company doctor and you went. You're a BA employee. You got suckered into going to the BA doctor.

Okay? And you thought you had to. But you didn't, but you thought you had to, because you never heard me say you don't have to. And so you got suckered into going to a nurse practitioner at an urgent care. And you got your claim denied. But you're stuck. You got suckered into going to a specialist like an orthopedic surgeon. Now, orthopedic surgeons are great surgeons. Many of them have no failed surgeries, but they're not an OWCP specialist. And so you get suckered into going to these doctors, and guess what happens? You're stuck because that's your doctor. And now OWCP, the claims examiner, has your attending physician treating doctor, the doctor of record, as that guy, that woman. Okay? Guess what they did? They got your claim denied.

All denials are the fault of the doctor.

All of them. You're not a doctor. You don't write medical reports. One of the five things is a medical report. And the medical report covers all five of the things. And so you don't get a doctor that can write that report, who cares to write five pages, who cares to do anything more than bill. Okay? All they want to do is bill an insurance company.

Or bill you. And they bill you and your claim gets denied. How about that? So now you're stuck in this endless loop because now you find out you that there are doctors out there. You find out there's doctors out there that can get claims accepted. Look, this is not a sales thing, I'm here teaching, but I'm gonna tell you something. Your doctor that got your claim denied is a joke. Alright? Any doctor that won't write the report to get your claim accepted is a coward. Write the report. I have doctors that say I can't definitively say that's work related. Are you kidding me? A postal employee who walks eight to ten miles a day and up to s carry lifts up to 70 pounds occasionally and carries a 35 pound satchel on their back and oftentimes a second one and has to step in and out of that vehicle that sometimes catches on fire.

You can't say that's work related. You're a coward. But you have doctors like that and you got stuck with them. And so now I'm telling you, hey, you gotta pick a right doctor, but you pick the wrong one. It's not your fault. You tried your best and they were the wrong doctor. But now the claims examiner won't let you switch doctors. You're stuck, right? You're not. I thought you were stuck. We've been working on this. We've been telling people like, ask your doctor to fire you. Just go to another doctor, request a change of treating doctor, and the claims examiner says, no. Most OWCP specialists are general practitioners. And so if you went to the orthopedic surgeon who refuses to write more than five sentences on a report, they're certainly not going to write five pages. You're stuck because the claims examiner says we can't approve or we won't approve a change from a specialist to a general practitioner. Well, you know what? Your specialist specializes in deny claims. That's their specialty when it comes to OWCP. But that general practitioner, they specialize in OWCP accepted claims. So what do you do? And that's why I'm talking tonight, because here's the game changer. Because now I'm telling you, you can get that doctor to relieve himself or herself from your case.

And if that doctor refuses to help you, you now have the initial selection of treating physician. You're back to choice one. And I put this on Twitter today. Those of you that refuse to get Twitter refuse to see this. Yeah. Because I put the exact place in the manual for Federal Workers Comp. The manual. I posted exactly where it's at. So you have the word for word of what to do so your doctor can release you from care and make you free to go and find a doctor who wants to help you. So get Twitter. Look, I'm not I'm not holding you hostage, I'm telling you what to do. But get Twitter, you would have seen this already. The 390-something of you that have already been on Twitter, you've seen it, okay? You can all go get a drink right now because you've seen this. But the rest of you want this information because you have a deny claim and you can't get out of the denial.

You gotta get out. So here's how. That doctor is gonna keep getting your claim denied. How do I know? Because one out of 13 people hasn't accepted claim. So they're gonna keep doing it. You're gonna get denial after denial until you throw your hands up and say, screw it, I don't want this anymore. You're gonna work for the pain, end up on disability, and by year or two have 40% of your income. Okay? That's what's happening. Alright? We have people calling us every day saying, I'm I don't know how to make my house payment. My kids are going to college, I don't know how to pay the college bills. Yeah. And it's because I'm hurt and I can't go to work. I'm hurting too bad to go to work and I can't get a claim accepted. So why would you stay with that doctor who can't get your claim accepted or who refuses to write the report to get your claim accepted when you can switch? Now I'm telling you, you can change doctors, and there's a way so the claims examiner won't tell you no. So everyone share this. Everybody knows somebody with a deny claim right now. Alright? Okay? So you've got to have your doctor write a letter to the claims examiner. Is everybody listening? This is it. This is the whole reason I did this live video tonight. Right now. Have your doctor write a letter to the claims examiner saying, please release me from this claim. They give the reason why they want to be released, which I'm honestly is they're not getting paid. You know how I know they're not getting paid? Because they can't get your claim accepted. Deny claims equals denied payments. The doctors aren't getting paid. They're gonna be happy to get off this clay, this case. Right now they're thinking, gosh, OWCP sucks. I don't want this anymore. It's because they did a bad job. So you know what? Bye, Doc. You did a bad job. Let them write a letter. So their letter says, please release me from this case because I'm not getting paid. I'm not able to help this person get their claim accepted. That's number one. They have to write on there your current status. Okay, they their restrictions are limited duty, they can only lift 20 pounds, and they need to live 70, so on and so forth. And then what your expected treatment needs to be. Okay, the doctor can write that stuff. They send that letter to the claims examiner, and the rule says the claims examiner will approve it. When the claims examiner approves it, you get to go choose a new doctor. Alright? You already went through this failure thing over and over. You're done with that. You've been watching this, you know how to find a doctor who can get your claim accepted. It's your time to get your claim accepted. No more denied claims. That's what we're doing here. So the reason for this tonight is to tell you, have your doctor fire you. But do that by writing a letter to the claims examiner requesting that you be that they be released from your claim. They will be more than happy to do it because they're working for free, and they're working for free because they did a bad job. You should not be forced to stick with a doctor who does a bad job or who refuses to do the right job. So that's it. Get Twitter tonight, get Twitter now. If you go to those other doctors and get a denied claim, I'll still read the denial, I'll still tell you how to fix it. I will always help you. Okay? As long as I can do this, I'm gonna help you. Yeah, so here's the deal. Look, this is a business for the doctor. And we train the doctor to do a great job and get your claim accepted, but when we do that and only three people show up, the doctor can't stay in business. Yeah. It's just there's got to be a volume of people that need help. Dallas is a huge area. Collin County around Plano is massive for rural carriers. The VA in Dallas is the second largest VA in the country. So if people don't commit to going to a doctor who will get your claim accepted, it's hard for me to open a practice there. I want to. I live there. I want to help. If you want us to have an office in the Dallas area, let us know what area you're in so we know where to go.

And let me say this I appreciate the invites. I love so much helping. And this is not fake when I'm telling you. I love helping federal employees with this stuff because I know the damage that's done by deny claims. And I know the damage supervisors do and the pain they inflict on you. And I feel like I'm the only person sometimes that's willing to stick up and fight for you because they can't fire me. They can't do anything for me to me for sticking up for you. I can take them all out behind the woodshed. What are they gonna do to me? And uh what's a woodshed? You gotta be in from Texas to know that. But no, seriously, look, it's my honor to do this. I take great pleasure in teaching. And in order to get me out to someplace to teach, I'm happy to go. I do it on my own dime. I buy our plane tickets. Yeah. You don't pay my plane ticket, okay? I pay for myself to go. It doesn't cost you anything for me to be there. But I don't want to sell. This is not a sales presentation, so I'm not interested in a booth. I don't need to bring brochures unless you want them. You have to let me talk, okay? I need to be able to teach for an hour, hour and a half, but at least an hour. And so if you can allow me to teach for an hour on stage in front of the group of people that I'm there for to teach for, I'll go. But I don't want to go just to set at a booth because this isn't a sales thing. And I don't want to go there just to pass out brochures. I want to go there to teach, to give out the information that I've got to you, to share the knowledge. And it takes about an hour. So I'm happy to come. I know we've been invited out to Michigan. We've been invited back to Wisconsin. Vegas. And Vegas. Seriously. She today she liked she said they want to know if we want to go to Vegas, and I didn't let her finish up, and I said yes. Just say yes. Definitely doing that. But in order to have us out at these conventions, I need to be able to speak for about an hour, and you need to fill the room. Okay, I don't want to show up and talk to 10 people because my goal is to spread this word the word out to 2.8 million people. Ten people is not getting it done for me. I'm gonna pay my way. We're both gonna show up. It won't cost you anything, but you gotta pack the house and give me an hour to speak. If you can do that, I'm in. Okay? I'm in and I'm with you all day.
