Can I sue my employer for workplace injuries?

In most circumstances, Maryland's workers' compensation system prohibits employees from suing their employers directly for workplace injuries. Instead, injured workers can submit a workers' compensation claim to receive payments for medical expenses, lost income, and disability. However, there are several circumstances in which suing an employer may be appropriate. If your damage was caused by your employer's willful harm or gross negligence that went beyond usual working dangers, you may be able to file a lawsuit. Furthermore, if a third party, such as a subcontractor or equipment manufacturer, was responsible for your injuries, you may be able to file a separate personal injury claim against them.
