What does the Balance of Probability mean, and why was it used in the Ben Roberts-Smith civil case, and then used in the criminal charges against him? Balance of Probability cannot be used in a criminal case, so why did they use it any way? Doesn't this already negate the truth of the case even before it goes to trial?
